HomeMy Public PortalAboutOrd. 0854 oRDINANCE rao. 854 AN ORDINANCE: OF THE CITY OF LYr1Ld00D AMENDING SEC'PION 10.66 OF THE LYNWOOD CITY CODE TO PRESCRIBE CERTAIN STANDARDS UNDER LdHICH THE CITY COUNCIL MUST ACT IN DETERMINING WHETHER OR NOT TO ISSUE AN ENTERTAINMENI^ LICENSE AND PROVIDING THAT AN URGENCY EXISTS FOR THE PASSAGE THEREOF. The City Council does ordain: Sebtioh 1. Section 10.66 of the Lynwood Municipal Code is amended to read as follows: "Minimum requirements. No entertainment license shall be issued under this Chapter until the following minimum requirements have been complied with: "(1) Minimum Requirements. It must appear that neither the applicant, rror the owner of the business wherein the entertainment is proposed to be conducted, whether he be partner, member, officer or manager or other person in charge of the said business or of the entertainment, has ever been convicted of a felony, or of a crime involving moral turpitude and that all of the persons hereinabove described are of good moral character. "(2) Action After Hearing. If from the evidence intro- duced at any hearing, the City Council finds grounds for denial, it shall deny the application being considered. Unless the decision of the City Council is announced at the close of the hearing, the City Council shall notify the applicant by causing the City Clerk to mail a copy of the decision to the applicant by registered or certified mail, addressed to the address shown in his application. In all cases the City Council must r~eaCh a decision within 14 days following the close of such hearing. If no grounds for denial of a license are found by the City Council, the City Council shall grant the applicant a license and the City Council shall notify the License Collector and instruct him to issue the license." -1- Section 2. Urgency. The City Council finds that an urgency exists for the passage of this ordinance for the following reasons: Applicants, owners and persons to be in charge of the proposed entertainment and the businesses where the entertainment is proposed to be conducted are likely to be persons not of good moral character and in some instances have been convicted of a felony or of a crime involving moral turpitude; that it is necessary for the protection of the safety, health and the public welfare of the residents of the City of Lynwood and others that this ordinance become effective immediately upon passage. Section 3. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed and published in the City of Lynwood. First read and finally adopted and ordered published at a regular meeting of the City Council of the City of Lynwood held on the 6th day of November, 1968, by the following vote: Ayes: Councilmen Byork, Green, Siokos, Smith, Stevens Noes: Councilmen Alone.
