AN ORDINANCE OF TIIE CITY OF LYNWOOD APQEDIDING SEC`PION
29.11 OF ARTICLE III OF THE LYNUIOOD CITY CODE TO
ALLOCATE CIGARETTE TAXES EQUALLY BETWEEN CAPITAL
iPrIPROVED4ENT FUND AND THE GENERAL FUND AND TO
PROVIDE THAT SAID TAXES 3E USE'D FOR STATE
PURPOSES ONLY.
The City Council ordains;
Section 1. That subject to the legal requirement that
cigar-ette taxes be used for .State .purposes, Section 29.11 of the
Lynwood City Code is amended to .read. as follows:
"Section 29.11. Allocation of Funds. All revenues
received by the City from State allocated cigarette taxes shall be
allocated as follows;
°a. One half to the .General Fund.
"b. One half to the Capital Improvement Fund All revenues
received in any fiscal year shall be allocated to the Capital
Improvement Fund and used only for capital improvements, new equipment,
approved replacement .items, land acquisition and retirement of general
obligation bonds."
Section 2. Eriumerated items found not to constitute a
State use, not to affect other items above enumerated. If any of the
items enumerated in Section. 1 shall be found not to constitute a
State purpose, this shall not affect .the validity of expenditures
from these tax .monies for uses that do constitute State purposes,
and if any section, paragraph or subparagraph of this ordinance is
found to be unconstitutional, this shall not affect the constitutionality_
or validity of any other. paragraph, section or subsection thereof
and these paragraphs, sections or sub„ectioia would have .been passed,
had the unconstitutional paragraphs, subparagraphs, sections and
subsections not .been included.

Section 3• The City. Clerk is hereby ordered and. directed
to certify to the passage of this ordinance and to cause the same
to be published once in the Lynwood Press, a newspaper of .general
circulation, printed, published and circulated in the City of Lynwood.
First read at a regular meeting of the City Council of
said city held on the 6th day of August, 1968, and finally adopted
and ordered published at a regular meeting of said Council held on
the 20th day of August, 1968, by the following vote:

Noes: CouncilmehNohe.
Absent: CouncilmehNOne
