ORDINANCE N0. 843
AN ORDINANCE OF THE CITY OF LYNWOOD AMENDING
CHAPTER XV (HEIGHT AND USE RESTRICTIONS) OF
CITY ORDINANCE N0. 570 TO ADD THE FOLLOWING
SECTIONS THERETO: SECTION 15.25 PROHIBITING
USES OF BEE KEEPING AND CERTAIN ANIMALS AND
FOWL AND SECTION 15.26 LIMITING THE NUMBER
OF CERTAIN OTHER ANIMALS AND FOWL AND REPEALING
SECTION 4.00 (4) OF SAID ORDINANCE.
Be it ordained:
Section 1. Section 15.25 is hereby added to Chapter XV
of City Ordinance No. 570 to read as follows:
"Section 15.25• Uses for Keeping of Bees and Certain
Animals and Fowl Prohibited.
"(a) No building or land shall be used or occupied for
the raising, propagating or keeping of bees whether commercially
or as a hobby or as an avocation; except that the provisions of
this section shall not apply to the swarming of bees in their
natural state on a tree, shrub, building or other object upon any
lot or parcel of land in such city; provided, the owner or occupant
of such lot or parcel of land had no part in causing such bees to
swarm in this manner and is not the owner or person in charge
of or in control of such bees.
"(b) No building or land shall be used or occupied for
the raising, propagating or keeping of the fowl or animals
hereinafter described whether commercially, or as a hobby or as,
an avocation... The said fowl and animals are as follows: Hogs,
geese, quacking ducks, guinea hens, mink, foxes, goats, bulls, steers,
horses, ponies, burros or mules, or any other animal whose fur is
used commercially, except rabbits and chinchillas.
"Section 15.26. Limitation as to number of fowl and
animals.

"(a) No building or land shall be used or occupied for
the raising, propagating or keeping of poultry or rabbit in
numbers in excess of the following:
"1. In an R-1 and R-2 zone for non-commercial
purposes only, twelve (12) rabbits.
"2. In an R-1 and R-2 zone for non-commercial
purposes only, poultry, except doves and pigeons not to exceed
twelve (12) birds, whether twelve (12) of the same kind or specie
or a combination of different kinds or species, not more than one
of which shall be a male, parakeets, and other domestic birds.
"3. In an R-1 and R-2 zone for non-commercial
purposes only, doves and pigeons not to exceed twelve (12) birds,
whether twelve (12) of the same kind or specie or a combination
of different kinds or species; provided however, that such pigeons,
and doves must be kept at all times in a pigeon house, dove cote,
cage or other enclosure and such pigeon house, dove cote, cage
or other enclosure must be enclosed in such a manner as to
prevent the escape of any pigeons or doves therefrom, except
racing or homing pigeons which are not raised or kept for the
market or other commercial purrposes may be kept and liberated for
exercise or racing within not less than thirty-five feet from
any door, window or other opening of any dwelling if a permit in
writing authorizing the keeping and liberating for exercise and
racing of such racing or homing pigeons is first applied for and
obtained from the Secretary of the Planning Commission. The
granting of such a permit, when conforming to the provisions
of this subparagraph of paragraph (a) of Section 15.26; is hereby
declared to be an administrative function of the Secretary of
the Planning Commission. The application for the permit shall
be made on such forms as are provided by the Secretary of the
Planning Commission and shall be filed with him. The Secretary
of the Ylanning Commission shall either issue the permit or give
applicant written notice of his disapproval within ten (7.Oj days

after the application is filed.
The determination of tl-ie Secretary
of the Planning Commission shall be final and conclusive in the
absence of an appeal. Within thirty (30) days from the mailing
of notice of disapproval, the applicant may file with the
Secretary of the Planning Commission a written letter of appeal
from his decision. Upon receipt of such letter of appeal the.
Secretary shall place the matter upon the agenda of the Planning
Commission for consideration by that body. The Secretary shall
thereupon, give the applicant by U.S. Mail postage prepaid,
addressed to the applicant at his last known address, ten (10)
days written notice of the time and place of such hearing. The
applicant may waive such written notice if he desires. The
decision of the Planning Commission shall be final.
"(b) No building or land shall be used or occupied for
the raising, propagating or keeping of rabbits or• poultry in
any other zone in the City of Lynwood whether commercially, or
as a hobby, or as an avocation except nothing herein contained
shall be construed as prohibiting the use,of a building or land
for the retailing of poultry or rabbits in a C-2 or C-2a zone,
or the wholesaling of poultry or rabbits in a C-3 or M-1 zone."
Section 2. Section 4.00 (4) of City Ordinance No. 570
is hereby repealed.
Section 3• The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the same
to be published once in the Lynwood Press, a newspaper of general
circulation printed and circulated in the City of Lynwood.
First read at a regular meeting of the City Council of
said city held on the 2nd day of April
