ORDINANCE N0. 828
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD AMENDING SECTION 13.14 OF THE LYNWOOD CITY
CODE SETTING UP AN ENTIRELY .NEW SECTION UNDER THAT
NUMBER AND ADOPTING CERTAIN PORTIONS OF THE CALIFORNIA
ADMINISTRATIVE CODE BY REFERENCE AND AMENDING SECTION
13.15 OF THE LYNWOOD CITY CODE TO INCLUDE WHAT WAS
FORMERLY IN SECTION 13.14 IN SECTION 13.15.
The City Council of the City of Lynwood, California, does
hereby ordain as follows:
Section 1. Section 13.14 of the Lynwood City Code is
amended to read as follows:
"Various types of homes to comply with "D-3 Occupancy."
Homes for the aged, homes for the care of the mentally deficient
(both adults and children), homes for narcotic addicts, homes for
alcoholics, homes for the returnees from State and County institutions,
and all homes of a similar classification, shall be subject to the
following regulations:
"(a). Compliance with D-3 occupancy; exceptions. No person
shall locate, or cause to be located, or own, conduct or manage a
home for the aged, a home for the care of mentally deficient adults
and children a home for alcoholics and/or narcotics, and homes for
returnees from State and County institutions, except those returnees
from mental institutions certified in writing by the Superintendent
of the institution as cured and returnees from other County and
State Institutions who are indigent only and have no disease, weakness
of mind, physical disability or other cause rendering such persons
unable, unassisted to take care of themselves, and who do not, in
any manner present a danger to the safety, health or general welfare
of other persons, in the City of Lynwood, until he or she has
caused said home to be brought into compliance with, and at all times
maintains said home in compliance with, all of the requirements of
a "D-3" Occupancy as contained in Article IX of Title lg (Public
Safety) State of California Administrative Code.

Homes named not all inclusive
The homes specifically
named and described in subparagraph (a) hereof shall not be deemed
all inclusive, and all homes of a nature similar to those named
and described therein shall be deemed to be regulated and controlled
by this Section.
"(c). Certificate of Occupancy from Chief of Fire Depart-
ment and Building Inspector. Before any person shall occupy, or cause
to be occupied any type of home described in subparagraphs (a) and
(b) hereof he shall obtain a Certificate of Occupancy executed by the
Chief of the Fire Department, his assistent or deputy, and by the
Chief Building Inspector, or his assistant, on forms which shall be
furnished for that purpose by the City Clerk, except that if a
Certificate of Occupancy is required from either, or both of the
officials above named, or tther assistants or deputies by virtue
of other provisions of this Code or by uncodified ordinances of the
City of Lynwood, such Certificate of Occupancy when duly and properly
executed by the official in question and delivered to the applicant
shall be deemed sufficient compliance with this paragraph.
"(d). Adoption of Portion of Administrative Code b
Reference. There is hereby adopted by the City Council that portion
of the Administrative Code contained in Article IX, Title 19, except
such portions as are hereinafter modified or amended by subparagraph
(e) hereof which follows, of which code three copies have been and
now are filed with the City Clerk and the portions thereof selected
for adoption are hereby adopted and incorporated as fully as if set
out at length herein, and from the date on which this section shall
take effect, the provisions thereof shall be controlling within the
limits of theCity.
"(e). Portion of Title lg Amended and Modified. In

"(f). Cured and Indigent Returnees Commingled with Other

types of persons described in subparagraph (a) hereof, the D-3
Occupancy requirements as amended and modified herein shall control."
Section 2. Section 13.15 of the Lynwood City Code is
amended to read as follows:
"a. Violation of chapter, permit, council order, etc. --
of this chapter or fail to comply therewith, or who shall violate or
fail to comply with any order made thereunder or any detailed statement
of specifications or plans submitted and approved thereunder or any
certificate or permits issued thereunder, and from which no appeal
has been taken, or who shall fail to comply with such an order as
affirmed or modified by the City Council or by a court of competent
jurisdiction, within the time fixed herein, shall severally for each
such violation and noncompliance respectively be guilty of a mis-
demeanor.
"b. Same -- Continuance of violation, defect, etc., pro-

Any person who shall violate any of the provisions

Section 3• The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the same to
be published once in the Lynwood Press, a newspaper of general
circulation, printed, published, and circulated in the City of
Lynwood.

First read at the regular meeting of the City Council of
said city held on the 21st day of March, 1867,
and finally adopted and ordered published at the regular meeting of
said Council held on the 4th day of April, 1967 by the
following vote:
