HomeMy Public PortalAboutOrd. 0827s " ORDINANCE N0. 827 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING THE LYNWOOD CITY CODE TO ADD A NEW CHAPTER THERETO NUMBERED CHAPTER 26A AND ENTITLED: "REGULATION OF NOISE EMANATING FROM MUSICAL INSTRUMENTS AND THE HUMAN VOICE IN PUBLIC PLACES, OTHER THAN FROM SOUND AMPLIFYING DEVICES." Be it ordained: Section 1. There is added to the Lynwood City Code a new Chapter numbered 26A and entitled: "Regulation of Noise Emanating from Musical Instruments And the Human Voice in Public Places, Other Than from Sound Amplifying Devices." Section 2. As the first section of Chapter 26A, Section 26.25 is hereby enacted to read as follows: "Section 26.25. Regulation of sound emanting from musical nstruments and the human voice. Any person.or group of person playing, or causing to be played musical instruments or singing, or causing songs to be sung in any public place, or where one or more persons are gathered in a place located in any "C" Zone as defined by City Ordinance No. 5~0 and are playing or causing to be played musical instruments or singing or causing to be sung songs in any of said "C" Zones shall be subject to the following regulations: "(a) The only sounds permitted are music or human speech. "(b) The volume of the sound shall be so controlled that it is inaudible from any point outside the place from which the sound emanates between the hours of 2:00 a<m. and 6:00 aom. "(c) At all hours of the day or night except those designated in (~b) hereof the volume of sound shall be so controlled that it cannot be heard by the human ear free from physical impairment of a person within a dwelling within 50 feet from the place where the sound emanates, and so that the volume is not unreasonably loud, raucous, jarring, disturbing or a nuisance to persons within the area of audibility." -1- Section 2. The City Council hereby declares that it would have passed this ordinance sentence by sentence, paragraph by paragraph, and section by section, and does hereby declare that the provisions of this ordinance are severable, and if, for any reason, any sentence, paragraph, or section of this ordinance shall be held invalid, such decision shall not affect the validity of the remaining parts of this ordinance. Section 3• The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood.
