HomeMy Public PortalAboutOrd. 0813ro t~ ~~ d 3 ORDINANCE No. 813 AN ORDINANCE OF THE CITY OF LYWNOOD AP4ENDSNG SECTIONS 20.84 OF THE LYNWOOD CITY CODE. Be it ordained: Section 1. Section 20.84 of the Lynwood City Code is amended to read as follows: "Written and verified application for a special permit must be filed with the license collector on forms provided for that purpose accompanied by a filing fee as may be hereinafter required in this division. No application shall be considered by the City Council unless the filing fee has first been paid. All applicants for Special Permits to manage, conduct or carry on any closing out sale, going out of business sale, bankruptcy sale, jewelry auction or jewelry sale, or any sale of a similar nature, shall state in said application whether or not the business upon the conclusion of the sale will wholly cease and terminate and if the answer is in the negative, whether or not the business will be relocated in the City of Lynwood, and if so, the address of the new location and the approximate date the said business will be open for business at the new location. If the statement is made that the business will wholly cease and terminate at the conclusion of the sale, or if the state- ment is made that the business will not wholly cease and terminate at the conclusion of the sale, the permit, if one is granted, shall provide that the permit i.s conditioned upon the business wholly ceasing to exist upon the conclusion of the sale and that such business shall not be reopened by the person who was the owner of the business at the date the permit was granted, or by his personal representatives, successors or assigns in any location in the City of Lynwood for a period of six (6) months from the date 'of the conclusion of the sale. If the statement is that at the conclusion of the sale the business will be relocated in the City of Lynwood, upon the conclusion thereof, the business shall wholly cease and terminate at the location of the sale and neither the person who was the owner of the business on the date the date the permit was granted, ~. , nor his personal representatives, successors or assigns shall reopen the same or a'similar business at the location of said sale for at least six (6) months following the conclusion of said sale. 1f the application contains the statement that the business will wholly cease and terminate at the conclusion of the sale, or that at the conclusion of the sale the business will be reopened at another location in the City of Lynwood and the business is nevertheless continued at the location of the sale after the con- clusion of the sale, either by the person who was the owner on the date the permit was granted or by his personal representatives, successors or assigns, or the business is terminated or suspended at the conclusion of the sale but is reopened by said person who was the owner at the date the permit was granted, or by his personal repr°esentatives, successors or assigns, at the same location within six (6) months from the date of the conclusion of the original sale, the said owner, and/or his personal representatives, and/or his successors, and/or his assigns shall pay a license fee of $100.00 for each day, payable daily, that the business continues contrary to the representation in the application and the said conditional permit. This license fee shall be in addition to all other remedies that the City of Lynwood may have against said person or persons." Section 2. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said city held on the 15th day of November 1966, and finally adopted and ordered published at a regular meeting of said Council held on the 6th day of December ~ 1966, by the following vote: Ayes: Councilmen: Byork Duncan Siokos Smith Stevens ~.. ., STATE OF CALIFORNIA ) ss.
