ORDINANCE N0. 802 AN INTERIM ORDINANCE OF THE CITY OF LYNWOOD AMENDING CHAPTER VIII OF CITY ORDINANCE N0. 570 PROHIBITING THE OCCUPATION OR USE OF ANY BUILDING, LOT OR PARCEL OF LAND WITHIN CERTAIN BOUNDARIES OF THE CITY OF LYNWOOD HEREINAFTER DESCRIBED BY ANY PAWNSHOP, RETAIL ESTABLISHMENT SELLING, BARTERING OR TRADING IN SECONDHAND MERCHANDISE WHETHER OR NOT NEW MERCHANDISE IS ALSO SOLD, BARTERED OR TRADED IN SAID RETAIL STORE OR ESTABLISHMENT, AUTOMOBILE SERVICE STATIONS, AND PLACES WHERE INTOXICATING LIQUORS ARE SOLD PENDING STUDIES BY THE PLANNING COMMISSION OF AN ORDINANCE ESTABLISHING A NEW CENTRAL RETAIL SALES AND BUSINESS DISTRICT ZONE OF A MORE HIGHLY RESTRICTIVE NATURE THAN THE EXISTING C-2 ZONE. The City Council of the City of Lynwood does ordain as follows: Section 1. Chapter VIII of City Ordinance No. 570 is tem- porarily amended as follows: "No building, lot or parcel shall be used or occupied for and no building shall be erected, constructed, established, altered, enlarged, or moved into within the boundaries hereinafter set forth for any of the following purposes: 1. A pawnshop, 2. A retail store or establishment selling, trading in, or bartering goods, wares or merchandise, irrespective of whether or not new merchandise is also sold, traded in, or bartered in said retail store or establishment. 3. An automobile service station, and 4. An establishment where intoxicating liquor is sold, served or dispensed ~ whether licensed as an on-sale or an off- sale establishment." Section 2. No person shall be granted a certificate of occupancy for any of the said uses enumerated in Section 1 hereof. -1- •i > Section 3o The City Council pursuant to the provisions of Section 65858 of the Government Code deems that it is necessary for the immediate preservation of the public safety, health and welfare that this ordinance go into immediate effect for the following reasons: The City Council has requested the City Attorney to prepare and he has prepared a City Ordinance amending certain portions of Ordinance No. 570 (Zoning Ordinance) to provide one or more entirely new "Central Business Zones" intended to provide the retail core areas of certain central business districts within the City with uses to be intensive in nature. Uses to be permitted are to be major shopping facilities, financial institutions and personal service establishments which the entire group or major elements thereof are intended and designated to serve the particular region of the City as a whole and are to include major department stores, specialty shops, banks, financial. and business institutions, business and professional offices, and certain other types of high grade sales and service establishments. The City Council has referred said City ordinance to the Planning Commission for the purpose of studies for the purpose of making recommendations to the City Council. The City Council is satisfied that the Planning Commission in good faith and within a reasonable time intends to conduct said studies for the purpose of making said recommendations to the City Council. The City Council pursuant to Section 65858 of the Government Code adopts this temporary interim ordinance prohibiting such uses in a C-2 Zone as an urgency ordinance. Section 4. The boundaries within which this urgency ordinance shall take effect in the City of Lynwood are as follows: Area 1. That area bounded by Peach Street on the west; Imperial Highway on the north; California Avenue on the east, and Fernwood Avenue on the South. Area 2. That triangular area bounded by Century Boulevard on the south west; Abbott Road on the north, and San Luis Street -2- on the east. Section 5. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed and published in the City of Lynwood, First read and finally adopted and ordered published at a regular meeting of the City Council of the said City held on the 21st day of June, 1866, by the following vote: Ayes: Councilmen Byork, Siokos, Smith, Stevens.
