HomeMy Public PortalAboutResolution 81-19811 RESOLUTION NO, 81-1981 A RESOLUTION. OF THE CITY COUNCIL OF THE CITY. OF TEMPLE CITY DECLARING ITS INTENTION TO ORDER THE ANNEXATION NO, 1 TO THE CITY-WIDE LIGHTING DISTRICT, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO WHEREAS, the City Council, by Resolution No, 81-1973, proposed Annexation No. 1 to the City-Wide Lighting District pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the California Streets and Highways Code); and WHEREAS, by said Resolution No, 81-1973 the City Council ordered the Engineer to prepare a report pursuant to Article 4, Chapter 1, Division 15 of said Streets and Highways Code; and WHEREAS, the Engineer did prepare and file such a report and the same was approved by the City Council on the 21st day of April, 1981, by Resolution No, 81-1980. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1, That the public interest and convenience requires and it is the intention of the City Council of the City of Temple City to order Annexation No, 1 to the City-Wide Lighting District within which the following work is to be done; to wit: 1. Maintenance and servicing of Street Lighting, 2, Any and all work and materials appurtenant thereto. In addition, said Annexation is to be formed to levy and collect assessments for said work.in accordance with the Act hereinafter designated. SECTION 2. The foregoing described work is to be located within streets and easements within said Annexation the boundary of which is more particularly described as the Annexation No. 80.4 to the City of Temple City as the same is on file in the office of the City Clerk of the City of Temple City, County of Los Angeles, State of California, at the date of approval of this Resolution, SECTION 3, That the contemplated work, in the opinion of said City Council, is of benefit to and the said City Council hereby makes the expense of the said work chargeable upon a district, which said • district is assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory within Annexation No, 80-1 to the City of Temple City, exclusive of public streets as the same exists on the date of adoption of this resolution, SECTION 4, Reference hereby is made to the report of the Engineer on file with the City Clerk and open to inspection, for a full detailed description of the improvements, the boundaries of the I Assessment District and any zones therein and the proposed assess- ments upon assessable lots and parcels of land within the District, SECTION 5. Notice is hereby given that on the 19th day of May, 1981, at the hour of 730 p,m, in the Council Chamber of the City Hall, any and all persons having any objections to the work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said district should not be Resolution No, 811981 Page 2 formed in accordance with this Resolution of Intention, Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing, Any such protest shall state all grounds or objection and if filed by a property owner shall contain a description sufficient to identify the property, SECTION 6, All the work herein proposed shall be done in accordance with the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 7, The City Clerk shall cause Notice of the hearing to be given by causing the Resolution of Intention to be published, posted and mailed in the manner required by Part 2 of Division 15 of the Streets and Highways Code, APPROVED and ADOPTED this 21st day of April, 1981, ATTEST: UF-67#Deputy City C MAYOR I HEREBY CERTIFY that the foregoing Resolution, being Resolution No, 81 -1981, was approved and adopted at a regular meeting of the City Council held on the 21st day of April, 1981, by the following vote of the Council: AYES: Councilmen - Atkins, Dennis, Gillander's, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Chief Deputy City Clerk
