HomeMy Public PortalAboutOrd. 0776-,-~;: ORDINANCE N0. 77( AN INTERIM ORDINANCE OF THE CITY OF LYNWOOD SUS- P~NDING THE GRANTING OF ANY HOME OCCUPATION PER- MITS UNDER THE PROVISIONS OF SUBDIVISION 5 OF SECTION ~4,00 OF CHAPTER N AND SECTION 14.12 OF CHAPTER XN OF CITY ORDINANCE N0. 570 PENDING STUDIES BY THE PLANNING COMMISSION OF AN ORDIDiA:vCE ELIMINATING HOME OCCUPATIONS AS A PERMITT~D US~ ~XCEPT AS TO THOSE ALREADY IN EFF~CT. The City Council of the City of Lynwood, does ordain as follows: Section l. Subdivision 5 of Section 4.00 of ChapterIV, of City Ordinance No. 570 and Seetion 14,12 of Chapter Xiti'/are temporarily amended as follows: No applications for a permit to conduct or carry on a business in a home pursuant to said sections of City Ordinance No. 5~0 shall be accepted ~ filed by the City Clerk, nor shall any person be granted a permit to conduct or carry on such business in a home in a given location pending studies, conducted by the Planning Commission, and/or the holding of a public hearing by the Planning Commission for the purpose of making a recommendation to the City Council whether or not to adopt amendments to City Ordinance No. 570 to eliminate home occupations as a permitted use except as to those already in effect, or recommending to the City Council adoption of a different type of amendment to Zoning Ordinance No. 570 effecting home occupations as a permitted use, and the regulation thereof, and pending said studies by the Planning Commission and/or said public hearing by the Planning Commission and the filing of the recommendations of the Planning Commission with the City Council and final action by the City Council on said recommendations subdivision 5 of Section 4.00, Chapter IlTand Seetion 14.12 of Chapter XIV o£ Ordinance No. 570 are hereby suspended, except as to home occupation permits granted by the City Council prior to the effective date of this ordinance. Section 2. The City Council pursuant to the provisions of Section 65,806 of the Government Code deems that it is necessary for the immediate preservation of the public sa£ety, health and welfare that this ordinance go into immediate e£fect for the following reasons: The City Council has requested the City Attorney to prepare, and he has prepared, the City ordinance amending Subdivision 5 0£ Section 4.00, Chapter IV and Section 14.12, Chapter XIVof City Ordinance No. 5~0, which, if finally adopted by the City Council, would serve to totally eliminate home occupations as a permitted use except those home occupation permits granted by the City Council prior to the effective date o£ said ordinance. The City Council has referred said City ordinance to the Planning Commission for the purpose of studies and/or the holding of a public hearing for the purpose of making a recommendation to the City Council whether or not to adopt amendments to City Ordinance No. 570 to eliminate home occupations as a permitted use except as to those already in effect, or recommending to the City Council adoption of a different type o£ amendments to City Ordinance No. 570 effecting home occupations as a permitted use, and the regulation thereof. The City Council is satisfied that the Planning Commission in good faith and within a reasonable time intends to conduct said studies and/or hold a public hearing for the purpose of making said recommendations to the City Council. The City Council pursuant to Section 65,806 of the Government Code adopts this temporary interim zoning ordinance prohibiting such home oecupation use subject to the e~eption heretofore noted and such other uses which may be in conflict with said ordinance as an urgency ordinance. Section 3. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper o£ general circulation, printed and published in the City of Lynwood. First read and finally adopted and ordered published at a regular meeting of the City Council of the said City held on the lst day of June, 1965, by the following vote: Ayes: Councilmen Duncan, Ham, McMillan Noes: Councilmen Siokos, Smith.
