HomeMy Public PortalAboutOrd. 0766 ORDINANCE N0, 766 AN ORDINANCE AMENDING SECTION 2.2 LYNWOOD CITY CODE TO AUTHORIZE CITY COUNCIL BY RESOLUTION TO ADJOURN MEETINGS TO A PUBLIC PLACE OTHER THAN THE CITY HALL LOCATED AT 11330 BULLIS ROAD„ LYNWOOD, CALIFORNIA, Section l. It is deemed necessary for the immediate preservation of the public peace, health and sa£ety that this ordinance shall go into immediate effect and the facts constituting such necessity are as follows: There is scheduled. on the agenda of the regular meeting of the City Council for December 15, Zg64, a public hearing of an appeal From a decision o£ the Planning Commission of said city recommending to the City Council that a zone change be denied; that the hearing of the application for this particular change o£ zone before the said Planning Commission was ad,journed to another public building of the city outside the Council Chambers and the City Hall, which accommodates approximately ten times the number of persons that the Council Chamber does; that almost all of the seats in this public building were filled by persons who d.esired to hear and to be heard on the application for said change of zone; that city ordinance 571~ of the City of Lynwood provides that the findings and the decision of the Planning Commission on an application for a change of zone are recommendatory only, and that the applicant has the right of an appeal of a d.ecision denying his application to the City Council, and that the City Council ahall hear and determine said application de novo; that already almost al1 of the same persons who attended the hearing of said application before the Planning Commission have stated their desire to hear and be heard at the hearing scheduled before the City Council, besides many more who did not attend, the said hearingj that the City Council Chamber has only eighty seats; that if the hearing were held in the Council Chambers, the halls would be jammed with persons clamoring to hear and to be heard.; that the Chief of the Fire -1- . . . , Department of this city, and Deputy State Fire Marshal, have notified. the City Council that they cannot permit crowds to assemble in the halls o£ the City Hall in such numbers; that all persons interested have a democratic right to hear and. be heard and the City Council Chambers will not accord said persons said right. Section 2, Section 2,2 of the Lynwood City Code shall be amended to read as £ollows: `~Section 2.2, Same -- Where Held. "Al1 meetings of the City Council, regular or special, shall be held in that certain building designated as 11330 Bullis Road., which building is known as the "City Hall of the City of Lynwood," except that the City Council may by resolution provide that an emergeney exists due to the number of persons that are likely to attend. and desire to hear and to be heard. on a particular matter or matters pending before the City Council, or for other good and sufficient reason, in the discretion of the City Council, and that the meeting be ad~ourned. to some public place outside the Council Chambers and. the City Hall with sufficient space and facilities to accommodate all persons desiring to hear and to be heard." Section 3. A resolition by the City Council to ad~ourn the meeting thereof to a public place outside the Council Chambers and the City Hall shall state the reasons why such an emergency exists. Seetion 4, A copy of this resolution shall be posted on the Council Chamber door. Section 5, The City Clerk is hereby ordered and directed to certiPy to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circu- lation, printed, published and circulated in the City of Lynwood. Approved and adopted at a regular meeting of the City Council of the City of Lynwood held on the lst day of December, 1y64, by the following vote: Ayes; Councilmen Duncan, Ham, Siokos, Smith.
