ORDINANCE NO. 1502.0
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING A PERMIT FOR
TEMPORARY HOUSING FOR TORNADO -AFFECTED PROPERTIES.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. Until September 1, 2019, the Director of the Department of Planning and
Protective Services may issue temporary housing permits to qualified residential homeowners of
a Tornado -Affected Property. The temporary housing permit supersedes Section 35-41.6(16) of
the City Zoning Code, and allows the holder to reside in a recreational vehicle, camper, or
camper trailer located on their property while their principal residential structure is being
repaired or rebuilt. The temporary dwelling may not be located on a City street or within the City
right-of-way.
Section 2. The temporary housing permit shall only be issued personally to single-family
residential property owners of record as of May 22, 2019 and shall not be transferrable. In order
to be eligible for a temporary housing permit, the applicant must have a current building permit
for their principal residential structure. All temporary housing permits issued pursuant to this
ordinance shall expire one hundred eighty (180) days from the date of issue or upon completion
of the principal residential structure, whichever occurs first. The Director of the Department of
Planning and Protective Services may extend the permit period up to an additional one hundred
eighty (180) days upon a showing of good cause by the owner. The Director may revoke such
permit upon a finding that any provision of this ordinance is being violated or that the temporary
dwelling is being maintained in an unsafe or unsanitary manner or in any manner constituting a
nuisance.
Section 3. The temporary housing permit holder shall comply with all City Code
provisions including those for health, sanitation, electric, plumbing, and property maintenance.
The use of portable generators is prohibited. The temporary housing permit holder may connect
their temporary dwelling to electric, water, and sewer utilities provided that the connection is
inspected and certified by the Building Regulations Division. The Director of the Department of
Planning and Protective Services may promulgate additional regulations governing utility
connections to temporary dwellings or to otherwise effectuate this ordinance.
Section 4. A Tornado -Affected Property is one that sustained damage as a result of the
May 22, 2019 storm event. The Director of the Department of Planning and Protective Services
shall determine whether the applicant's principal residential structure is a Tornado -Affected
Property.
Section 5. Any applicant or permittee under this ordinance aggrieved by a decision of
the Director made pursuant to this ordinance may appeal such decision to the City Council
within seven days of the Director's determination by informing the City Clerk in writing. The City
Council shall dispose of such appeal at the next available regularly scheduled City Council
meeting at which the appellant shall be entitled to be heard.
Section 6. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.
