HomeMy Public PortalAboutOrd. 0737 ORDINANCE N0. 737 AN ORDINANCE ADDING SECTIONS 27,11 AND 27,12 T~ THE LYNWOOD CITY CODE TO PROVIDE FOR THE ISSU~NCE OF A PERMIT AND PAYMENT OF A FEE FOR CONNECTING TO A M~IN SEWER LINE CONSTRUCTED WITH FUNDS FURNISHED BY THE CITY. The City Council of the City of Lynwood does ordain as follows: Section 1. That Chapter 27 of the Lynwood. City Code is amended to add Section 27.11 thereto, to read as follows: "Section 27,11. Proportionate Construction Fees -- Sewers. A property owner who d.esires to connect a build.ing connection sewer to a main line sewer, which main line sewer was constructed and installed out of £unds provided by the city, shall file a written application for a permit with the City Engineer, on a£orm furnished. by him. No permit therefor shall be issued until the property owner has paid to the City Clerk a£ee in an amount estimated by the City Engineer to be the proportionate share of the cost of construction of said main line sewer of said property owner." Section 2. That Chapter 27 0£ the Lynwood City Code is amended to add Section 27.12 thereto, to read. as follows; "Section 27.12. Deferred Payments -- Whenever a property owner is required. to pay a£ee equal to his proportionate share of the cost of a main line sewer, as provid.ed in Section 27,11 hereof, the property owner may file a duly executed affidavit with the City Clerk and request permission to pay said fee in monthly installments, Such af£idav3t shall specifically set forth reasons why the payment of such fee in a lump sum will cause him undue hardship, shall list all o£ his assets and liabilities and. shall contain such other in£or- mation as may be requested by the City Clerk. If the City Clerk deter- mines that the owner is unable to make a lump sum payment or that the payment thereof will impose undue hard.ship on the property owner, the -1- City Clerk may permit the payment of the fee in installments, pro- viding the property owner executes and delivers to the City Clerk a promissory note payable to the city. The promissory note shall pro- vide for equal monthly payments over a period not to exceed eighteen months from and after the date of execution, shall bear interest at the rate of six per cent per annum on the unpaid. balance, and sha11 provide that the first payment on said. note shall be made within thirty days from the date of execution thereof." Section 3. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation printed. and. circulated in the City o£ Lynwood. First read at a regular meeting of the City Council of said city held on the 19th day of June, 1962, and finally adopted and ordered published at a regular meeting of said Council held on the 3rd day of July, 196z, by the following vote: Ayes: Councilmen Dunean, Finch, Ham, MeMillan and Rowe. Noes: Councilmen: None.
