HomeMy Public PortalAboutOrd. 0728/ ... a ORDINANCE N0. 728 ,~N ORDINANCE OF THE CITY OF LYN~i700D, ADOPTING A REVISION ~ND CODIFIC.~TION OF THE ORDINANCES OF THE CITY OF LYN~G,~OOD, CALIFORNIA, ENTITLED: "THE CODE OF THE CITY OF LYNWOOD, CALIFORNIA,'~ PRO- VIDLNG FOR TfIE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, WITH CERTAIN EXCEPTIONS, AND FOR OTHER PURPOSES HEREINAFTER SET OUT. Section 1. There is hereby ad.opted by the City of Lynwood, California, that certain Code entitled: °The Cod.e of the City of Lynwood, California," containing certain ordinances of a general and. perm&nent nature as compiled, consolidated, codified and indexed in Chapters 1 to 30, both inclusive, of which Code not less than three copies have been and are now filed. in the office of the City Clerk, and which is hereby referred. to and ad.opted by refererice as if incor- porated and set out at length in tkis ord.inance. Section 2. The provisions of such Code shall be in force on and after January 15, 1962, and all ordinanees of a general and per- manent nature adopted by the City Courlcil prior to February 1, i96i, arid not contained in such Code are hereby repealed from and after February l, 1961, except as hereinafter provided. Section 3. The repeal provided.for in the preceding seetion of this ord.instnce shall not affect any o£fense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing be£ore January 1~, 1962, nor shall such repeal affect any ordinance or resolution promising or guaranteeing the pay- merit of money £or the City or authorizing the isaue of any bond.s of the City or any evidence of the City~s indebtedness or any contract or obligation asaumed. by the City; nor shall such repeal affect the administrative ordinances or resolutions of the Council not in con- flict or inconaistent with the provisions of such Cod.e; nor shall it a£fect the annual tax levy; nor shall it affect any right or franchise -1- conferred. by ordinance or resolution of the City Council on any person or corporation; nor shall it affect any ordinance relating to the salaries o~ the City officers and employees; nor sha11 it affeet any ord.inance anneging territory to the City; nor shall it affect any ord.inance naming, opening, aecepting or vacating streets or alleys in the City; nor shall it affect any ord.inance relating to zoning; nor shall it affect Ordinance No. 484, ae amend.ed. by Ordinance No. 650, relating to sales tax; nor shall it affect Ordinance No, ~09, relating to taxation; nor shall it affect Ordinanee No, 1~8, relating to public utilities; nor shall it affect Ordinances Nos. 448 and 635, relating to air pollution; nor shall it affect Ordinance Na. 710 aceepting the requirements of Section 13522 of the Penal Code relating to the train- ing of law enforcement officers; nor shall it affect Ord.inance No. 520 relating to a Certificate of Occupancy; nor shall it affect any ordinance adopted after February l, 1961. Section 4. Whenever in the Code adopted by thie ordinance or in any other ordinance of the City any act is prohibited or is mad.e or declared to be unlawful or an offense, or the d.oing of any act is required or the failure to d.o any act is declared to be unlawful or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of such Code or any other ordinance of the City shall be punished. by a fine not exceeding Five Hundred Dollare ($500.00) or imprisonme~t for a term not exceeding six months, or by both such fine and imprisonment. Every d.ay any violation of such Code or any other ordinance of the City s$all continue shall constitute a aeparate offense. be Seetion ~, It is hereby d.eclared to/the intention of the City Council that the sections, paragraphs, sentencea, clauses and. phrasea of thie ord.inance and the Code hereby adopted are severable, and if any section, paragraph, sentence, clause or phrase of this ordinance shall be declared. unconstitutional or otherwise invalid by any court of competent juriediction, sueh unconstitutionality or invalidity shall in no way affect the remaining portions of this -2- ordinance or euch Code. Section 6. The City Clerk is hereby ordered and directed. to certify to the passage of this ordinance and to cause the same to be published ~nce in the Lynwood. Press, a newspaper of general circulation printed and circul&ted. in the City of Lyriwood. First read at a regular meeting of the City Council of said. City held on the 21st day of November, 1961, and fi~ally adopted and ordered. published at a regular meeting of said Council held on the 5th d.ay o£ December, 1961, by the following vote: Ayes: Councilmen Duncan, Finch, Ham, Rowe.
