Chairman's announcements Mr. Skidmore spoke about the CWPC meeting and that Mark Nelson had told them that the BOH regulation should be ready to be viewed in the next few weeks. 2. David &Rebecca Petras-270 Griffiths Pond Road-local variance request from the Leaching Facility Setback Regulation It was noted that the groundwater flow is towards the pond(diagonally)and the depth to groundwater is 20 feet. Ms. Dugan asked how far away from the pond the SAS was. Mr. Petras stated that is was about 240'-260'. Dr.Chaffee asked how old the system was. Mrs.Ice stated that the system was installed in 1999. Mr. Petras stated that the system is pumped out every three years and they have never had any issues with the system. The system is designed for 5 bedrooms but there are only 4 in the house. Motion: Approve the variance request to allow the SAS to remain 240 feet from the pond,based on the fact that the depth to groundwater is 20 feet,the system is 15 years old and the groundwater flow is diagonal towards the pond. Motion: Dr. Chaffee Second: Annie Dugan Vote: 5-0-0 Action: Motion carried 3. Status update on the Bedroom Definition Mr. Skidmore requested that the Board send any comments they have prior to meetings only to the Health Director and she can distribute them to the rest of the Board. He spoke about the discussion at the January 6th meeting with regards to the definition and asked what the Board wanted to do with it. He also reminded the Board about George Heufelder's statement about focusing on what a bedroom really is and designing the system to the house. It was noted that Mrs. Hughes was not present and was one of the Board members that helped produce the current regulation and should be present for any discussion on this. Mrs. Ice stated that she would recommend that the bedroom definition in Title 5 be the one that is used. This was continued until the next meeting. 4. Discuss the status of converting oil tanks to gas Mrs. Ice stated that since there is a moratorium on gas installations for the next several years,the Board needs to decide what to do with regards to the Oil Tank Regulations. The Board agreed that anyone selling their home with a single walled oil tank would have to either convert to a propane tank or install a new double walled oil tank. 5. Discuss the Design,Operation and Maintenance of Small Wastewater Treatment Facilities regulation Mrs.Ice told the Board that when these regulations were made,there were no DEP regulations for small wastewater treatment facilities. There are now regulations for treatment facilities over 10,000gpd. The BOH and the DEP regulations overlap each other. Mrs.Ice would like to run this by Town Counsel and get back to the Board. This was continued until the next meeting. 6. Discuss and possibly approve the revised Private Well Regulations There was a brief discussion and a few questions. This will be brought up at the next meeting. 7. Discuss Planning Board application for Map 27 Lot 73,0 Main Street Noted. 8. Discuss Planning Board application for Map 58 Lot 37,0 Breakwater Road Noted. 9. John Kauka-78 Old Red Top Road-lapse in Operation&Maintenance contract for I/A system Mrs. Ice told the Board that the County will be sending out a certified letter. If they get no response it will come back to the Board. 10. Health Director's mid-year review Mr. Skidmore and Mrs. Ice will meet and get this done. Mrs. Ice gave an update on her objectives. 11. Discuss February meeting dates The Board discussed this and decided that the meetings would be on February 3 &24 and the March meetings would be on the 10th and 24`h Informational items were noted.
