HomeMy Public PortalAbout1962-09-29 Meeting135 COUNCIL MINUTES September 29, 1962 The Council of Bal Harbour Village met on Saturday, September 29, 1962 at 9:30 A.M. in the Village Hall. All members of the Council were present. Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk, Herbert Nadeau representing Thomas H. Anderson as Village Attorney. After roll call Mr. Hart moved to accept the minutes of the meeting of July 31, 1962. Mr. Faulkner seconded the motion and it was unanimously approved. Mayor White then asked for a report on the Tri City Library. Mr. Webb informed the Council that the City of Miami Contract had in— creased by $1,000 to $16,000 and the Village share would be $3,200. Mr. Hart made a motion to authorize the signing of a new contract for the Library at $3,200. The motion was seconded by Mr. Kirkeby and unanimously approved. Mrs. Beulah Butler and Mr. Faulkner as Trustees for the Library explained that a new organization had been formed to succeed the ori— ginal ladies group which originated the library and was now raising money for library equipment and other incidental projects but did not wish to assume any portion of the Library rental or upkeep in the new location. Mr. Faulkner informed the Council that the operation of the Library in their new quarters would entail additional expenses, i.e. ammortization, maintenance, janitorial services, etc. and that Surf — side would like to have the three Towns underwrite these expenses. In this connection Mr. Webb read a letter from Fred Bowen, Town Manager of Surfside, stating that the Bal Harbour share, figured on a 2-2-1 ratio, would amount to $1,000 yearly; this in addition to the $3,200 contract fee. Mr. Webb further advised that there were no monies allocated in the budget to cover these additional expenses. After discussion it was recommended that Mr. Webb and Mr. Faulkner meet with the other Town Managers and Trustees in an effort to obtain a break— down on these expenses and that the matter be tabled until the next meeting. Mr. Faulkner informed the Council that Bay Harbor Islands and Surfside had appointed an alternate Trustee and said they would also like to have an alternate. It was the recommendation of the Council that Mr. Faulkner and Mrs. Butler present their choice at the next meeting. Mr. Webb then asked the Council's approval for transferring funds between departments to balance the budget in accordance with the Charter's provision. Mr. Beatty made a motion to approve the transfer of funds to balance the budget as follows: Sept. 29, 1962 136 A total of $10,695.00 from Dept 01 - $200.00; Dept. 02 - $630.00) Dept. 03P - $1,630.00; Dept. 03F - $140.00; Dept. 05 - $6,290; Dept. 07 - $1,405 to balance Dept. 06 - $5,695 and Dept. 05 - $5,000. Mr. Hart seconded the motion and it was unanimously approved. The Village Clerk stated that the application for renewal of the Beau Rivage Liquor License indicated a Mr. Sanford Chobol as a new officer of the corporation and inasmuch as his fingerprints are being processed in Washington, requested that the Council approve the Liquor License pending the return of the fingerprints in order that the hotel will not be penalized. Mr. Hart made a motion to accept the renewal of the Beau Ravage Liquor License subject to the Village Manager re- ceiving his fingerprints. The motion was seconded by Mr. Kirkebv and unanimously approved. Mr. Webb informed the Council that Surfside passed a resolution asking the County Commission for help and assistance in the proposed widening of 96th Street inasmuch as this is a county line road and main arterial thoroughfare. Mr. Webb further stated that at a meeting in August with the County Traffic Engineer he was informed that the present plans call for a dog leg at the Bal Harbour Service Station, however, the County traffic Engineer was unaware of the proposed 15 acre shopping plaza that would channel considerable traffic on 96th Street and stated that this may put a different complexion on the present plans. An opinion was asked of Mr. Nadeau as to whether or not Bal Harbour Village should pass a resolution to the County Com- mission requesting assistance. Mr. Nadeau was of the opinion that no resolution be passed at this time as the problem of widening the street was mainly on Surfside. Mr. Hart requested that this matter be tabled until Mr. Webb receives more information about the plans from the County Traffic Engineer. Mr. Webb suggested that due to the fact there are four months in the year with five Saturdays, it may be more beneficial for auditing purposes to change the day of the Council meetings to the last Saturday in each month. Mr. Beatty moved that the last Saturday of each month be designated for the Council Meeting, seconded by Mr. Faulkner and unanimously approved. Council members were each paid a salary of $1.00 for their services during the fiscal year ending September 30, 1962. Mr. Webb informed the Council that the Singapore Hotel has a delinquent water account in the amount of $1,553.42, and briefed the Council on the facts leading up to this past due account. He stated that the original indebtedness occurred when Mr. Cohen was operating the hotel, skipped town, and subsequently the hotel went into bank- ruptcy. At the time in question, the Singapore Hotel was operating under the Contractor's Water deposit, but when Messrs. Brook and Romer took possession of the hotel, he immediately requested and received a water deposit of twice the amount of their monthly water bill, said September 29, 1962 137 deposit amounting to $1,800.00. Mr. Romer left town and Judge Choate appointed Trustees to handle the operation of the hotel, however after May 1, 1962 the Trustees made no attempt to pay the water bills and when Mr. Webb threatened to have the water turned off, he was ad— vised by Judge Choate that he would be in contempt of court. Judge Choate closed the hotel on May 29, 1962 as it was operating in the red. Mr. Webb and Mr. Nadeau appeared at a hearing in Judge Choate's office as the Trustees were attempting to have the court rule that the $1,800.00 deposit be returned to them. Judge Choate ruled that the $1,800.00 deposit be retained by Bal Harbour Village and applied to the water account. However, it is the opinion of Mr. Anderson that the Trustees be held responsible for the $770.01 water charges incurred at the hotel during their tenure and accordingly, petitioned Judge Choate to force the Trustees to pay the $770.01 over and above the reduction of the entire $1,800.00. A hearing on this petition was held two weeks ago and Judge Choate said he would not rule then but defer ruling until he returns from vacation. Motion made by Mr. Faulkner to instruct the Village Attorney to pursue the matter to collect the money from the Trustees on the balance due the water department of $770.01. Motion seconded by Mr. Hart and unanimously approved. Mr. Faulkner made a motion that the meeting be adjourned, seconded by Mr. Hart and unanimously approved. Beatty, Hart, Kirkeby and White Absent: Mr. Faulkner Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. Upon motion of Mr. Hart, seconded by Mr. Beatty, the minutes of the previous meeting of September 29, 1962 were approved as submitted. In the absence of Mr. Fred Faulkner and Mrs. Beulah Butler, Trustees of Tri City Library, Mr. Webb advised the Council that it was their intention to recommend the appointment of Mary Wetterer as Alternate Trustee. Mr. Hart moved to appoint Miss Wetterer as Alternate Trustee to represent Bal Harbour Village. The motion was seconded by Mr. Kirkeby and unanimously voted.
