RESOLUTION AUTHORIZING THE TEMPORARY EXTENSION OF
SCAVENGER SERVICES CONTRACT IN THE BOROUGH OF
CARTERET
WHEREAS, the Borough of Carteret (the "Borough") is in the last year of solid
waste collection and disposal contract (the "Contract") with Manella and USA
Sanitation, inc.; and
WHEREAS, due to inadvertent confusion with regard to the end date of the
contract as a result of prior litigation forcing the re-letting of the scavenger
services contract prior to the conclusion of the previously awarded contract; and
WHEREAS, as a result of said confusion, it was initially believed that the present
contract expires on October 15, 2001 rather than the actual date of January 15,
2001; and
WHEREAS, the new uniform bid specifications for the collection and disposal of
solid and hazardous waste issued by the New Jersey Department of Environmental
Protection require that the solicitation of municipal garbage collection contract
bids be open for a period of at least 90 days, and require the Borough of Carteret to
make significant modifications to its existing scavenger services bid specifications;
and
WHEREAS, the Borough will likely need at least 120 days to prepare the
necessary specifications and solicit formal bids for a new garbage collection
contract in conformance with the NJ DEP Uniform Specification requirements;
and
WHEREAS, the continued and uninterrupted provision of garbage collection and
disposal services is vitally important to the public health, safety and welfare of the
Borough; and
WHEREAS, Manella and Usa Sanitation, Inc. has agreed to extend their existing
contract with the Borough for 120 days.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret as follows:
1. The present garbage collection contract between the Borough of
Carteret and Manella and Usa Sanitation, Inc. is hereby extended to
October 15, 2001 at a cost not to exceed $36,433.44 per month.
2. A notice of this award shall be advertised as required by law.
