Chairman's announcements Mr. Skidmore spoke about the Town elections and having a new Board member. He noted that this would be Board member Joanne Hughes's last meeting and thanked her for her 9 years of service. Mr. Skidmore also spoke about the memo to the Conservation Commission regarding the vegetated buffer provision in the proposed Board of Health regulation. 2. Jeffrey Barber-Title 5 variance request for 28 Stony Hill Road The homeowner would like to build a garage on his property and is requesting the following variance: 1. To allow the existing SAS to remain 3 feet from the slab foundation Down Cape Engineering did submit a letter with two other proposals. One would be to install a completely new system;the other would be to build the garage right in front of an existing garage which is really not feasible. There were no issues with the septic system inspections other than it being a 30 year old system. Motion: Allow the existing SAS to remain 3 feet from the slab foundation. Motion: Annie Dugan Second: Joanne Hughes Vote: 4-0-0 Action: Motion carried 3. Dan Speakman-local variance request for 34 Captain Connolly Road Dan Speakman was present and requested the following variance: 1. To allow the SAS to be 129' from the pond. Mr. Skidmore asked about the groundwater flow. Mr. Speakman wasn't sure but thought it may be running towards the pond. Mrs. Ice stated that she believes it is actually going away from the pond. Mr. Skidmore asked what the depth to groundwater was and was told it was more than 20'. Dr. Scherzo voiced his concern about the SE part of the lot where groundwater would be flowing closer to the pond. Mrs. Hughes asked if the SAS was perpendicular to groundwater. Mr. Speakman said it was not. Motion: Grant the variance with the stipulation that a Drip Dispersal system is installed. Motion: Dr. Scherzo Second: Annie Dugan Vote: 4-0-0 4. Richard Sperling-local variance request for 153 Morning Star Cartway WWW.TOWN.BREWSTER.MA.US r y Bob Perry was present representing Mr. Sperling. He handed the Board some information about the property. He is requesting the following variance: 1. Allow the existing SAS to remain 162' from Greenland Pond. The septic system is about 20 years old. Groundwater flow would diverge along the shore of the pond. The depth to groundwater is 4' with the adjustment. If a new system was required the well would need to be moved. Although it is a large lot,there would be difficulty in reconfiguring it. Mrs. Hughes asked about town water. Mr. Perry doesn't think there are any plans to put it on this street. Dr. Scherzo stated that Greenland Pond is considered a"good pond"(not impaired). Gayle Tambolleo,Real Estate Agent for the seller told the Board that the owner bought the house 20 years ago and the house has only been used about l week a year since then. The septic inspector told her that the system was is perfect working order. The lot size is 3 acres. Dr. Scherzo asked about putting a Drip Dispersal system in. Mr. Perry stated that he is not a fan of those systems. Motion: Because the system is from 1988,there is only 4' to groundwater,groundwater flow is towards the pond and the system is only 162' from the pond,deny the variance request. Motion: Joanne Hughes Second: Annie Dugan Vote: 4-0-0 Action: Motion carried 5. Public hearing on the Bedroom Definition Changes were made in sections 1 &3. The Board went back to the basic Title 5 definition with the exception of the"sleeping area" section. The name of the definition was also changed. Attorney Stephen Jones made mention of a few grammatical errors. The Board asked that the definition be re-typed and brought back to them to sign. 6. Public hearing on the Variance Regulations There was discussion and a few changes requested. The Board asked that a clean copy be typed up with the changes,sent to Town Counsel for review and brought back for the Board to sign. 7. Discuss the proposed Small Wastewater Treatment Facility regulation This will be put on the June work meeting agenda. Mrs. Hughes suggested talking with Brian Dudley about this regulation. 8. Assistant Health Director's memo regarding Special Venue Permit for Candleberry Inn Mr. Skidmore explained this was on the agenda tonight because at a Selectmen's meeting in April,this letter was discussed and he felt that someone watching the meeting would think that the memo was incomplete and wanted to get the Board's support to go before them and explain why this memo was written and clarify things with them. Mrs. Hughes stated that she doesn't understand why she can serve to the public but still needs another permit. It was explained what the issues were. Motion: Annie Dugan Second: Joanne Hughes Vote: 3-0-1 (Dr scherzo abstained) Action: Motion carried 9. Topics the Chairman did not anticipate None. Informational items were noted.
