HomeMy Public PortalAboutOrd. 0709~ ORDINANCE N0. 709 AN ORDINANCE OF THE CITY OF LYNWOOD ESTABLISH- ING REGULATIONS FOR MAKING EXCAVI~TIONS AND PERF~RMANCE 0i+ OTHER WORK IN PITBLIC STREETS IN SAID CITY. The City Council of the City of Lynwood d.oes ordain as follows: Seetion 1. Work in Street Permits. A person shall not commence any work or place any obstruction in or upon any public street, including parkways and sidewalks, unless a special permit for such work or the placing of such obstruction has been obtained from the City Engineer. Section 2, Filing Application. Any person d.esiring to do such work or place such obstruction shall file an application therefor with the City Engineer. Section 3. Contents o£ Application. Such applieation shall state: (a) The name and address of the applicant. (b) Evidence that the applicant has a lawful right to perform the said work or place the obstruction in or upon said. public street. (c) That the applicant ind.emnifies and holds City of Lynwood, and eaeh officer and employee thereof, harmless from any liability or responsibility for any accid.ent, loss or damage to persons or property happening or occurring as the proximate result of any work undertaken under or pursuant to said application. Section 4. Fees. (a) A non-returnable filing fee of $1.00 shall be charged, payable to the City Engineer, upon the filing of each application, to cover clerical costs and investigations. The Piling fee is over and above the costs of other street permits, (b) In addition to tha above, fees established.by resolution -1- . of the City Council shall be charged.for street repairs, establishment of lines and. grades for street improvements and inspection costs for new conetruction or repairs of curbs, sidewalks, gutters, pavement, driveways and sanitary sewers. Such fees shall not apply to city contracts, 1911 Act improvements or work undertaken by the various city departments. Section 5. Data with Application. When required by the City Engineer, a sketch or plan must be submitted with the application, and. shall be approved by him prior to issuance of the permit. Section 6. General Requirements. In all residential and commercial areas, the owner, in taking out a permit for a new building, must repair broken, damaged and worn out sidewalks and curbs abutting his property and where no curbs abut his said property, construct the same, all at his own expense. The Building Inspector is inetructed. to withhold final inspection of the building until such work is completed to the satisfaction of the City Engineer, In all commercial areas the owner is required to construct concrete sid.ewalks in the parking strip or setback areas between the curb and building line prior to final building inspection. If this work is in but in a poor or hazardous condition, in the opinion of the City Engineer, or not constructed to proper grade, such work will be removed and replaced by and. at the expense of the owner prior to such final inspection of the building. Where an existing driveway is no longer required the owner shall remove such driveway and restore the original improvements. Section 7, Specifications, Construction oP curbs, sid.ewalks, gutters, pavement, driveways and sanitary ser~rers, or repair to same, shall be in accordance with the Stand.ard Specifications of the State of California, Division of Highways, January, i96o, together with all amendments and revisions thereto, on £ile in the office of the City Engineer o£ said city, whieh is by reference mad.e a part o£ this ordinance. Driveways shall be constructed. in accord.ance with standard -2- plans £or driveways on file in the office of the City Engineer. Resid.ential drivewaya shall have a minimum thicknese of four (4) inches. Commercial driveways shall have a minimum thickness of six (6) inches. Curbs shall be constructed in aceordance with grades estab- lished by the City Engineer. Sidewalks shall be construeted at a rise of one-fourth (1/4) inch per foot from top of curb to property line. Section 8. Barricades and Lights. Suitable barricadea, satiafactory to the City Engineer, to protect the work from pedestrians or uehicles, shall be kept in place throughout the entire construction period or until such time as the work has been accepted by the City Engineer. No person placing or maintaining ax~y obstruction or making any excavation in any street shall fail or neglect to provide, during the period. between sunset of any day and. sunrise of the succeed.ing d.ay, suitable and. adequate lights to warn ueers of such street~ of any such obstructione or excavations, Section 9. Removal of Trees. Permit, A person shall not plant a tree in or upon any parkway or remove any tree there£rom unless a permit to plant said tree or to remove said existing tree has been obtained from the Park Superintendent. Section 10. Contents of Application. Such application shall state: (a) The name and address of the applicant. (b) Evidence that the applicant: (1) is the owner of the premises involved, or (2) has the permission of the owner to make such application. Section 11. Appeal. (a) Within thirty (30) days after the re~ection o£ an application for a special permit, the applicant may file a written appeal with the City Clerk, stating in detail the reasons why the special permit should be granted, notwithstanding the action of -3- the City Engineer or the Park Superintendent, as the case may be. (b) Within twenty-£our (24) hours of the receipt of the written appeal, provided for by Section 11 (a) hereof, the City Clerk shall advise the City Engineer or the Park Superintendent, as the case may be, of said appeal, and within the same period shall fix a date and time for the hearing of the appeal by the City Council and noti£y the applieant, and the City Engineer or the Park Superintendent, as the case may be, thereof by registered or certified mail, which date must not be more than ten (10) d.ays from the date the appeal is filed. with the City Clerk, (c) Upon receipt of notice that an appeal has been filed., the City Engineer, or the Park Superintendent, as the case may be, must furnish the City Council forthwith a written report of the reasons for the rejection of the application and. the refusal to issue the special permit. (d) The City Council must deny the appeal and afPirm the decision of the City Engineer or the Park Superintendent, as the case may be, i£ it finds the applicant has failed to comply with any of the provisions of this ord.inance, or of the laws of the United States or the State of California. (e) The decision of the City Council shall be £inal. Section 12. Validity. I£ any provisions o£ this ordinance or the application thereof to any person or eircumstance is held. invalid, the remainder of the ordinance, and the application of such provision to other persons or circumstances, shall not be aP£ected thereby. Section 13. Penalties, Any person violating any of the pro- visions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the city ~ail or in the county ~ail for not exceeding six months, or by a£ine of not to exceed Five Hundred Dollars ($500.00), or by both such fine and. imprisonment. Section 14. The City Clerk shall certify to the adoption -4- of this ordinance and. shall cause the same to be published once in the Lynwood Press, a newspaper of general circulation printed and circu- lated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 20th day of September, 1960, and finally adopted and ordered published. at a regular meeting of said Council held on the 4th day of October, 1960, by the following vote: Ayes: Councilmen Duncan, English, Finch, Pender, Noes: Councilmen Absent: Councilmen Rowe.
