HomeMy Public PortalAboutOrd. 07032 ~3 ~" _ ~ ~~ ~ ~~, ORDINANCE N0. 703 AN ORDINANCE PROHIBITING THE POSSESSION OF PIN BALL MACHINES AS HEREINAFTER DEFINED, 7`he people of the City of Lynwood do ordain as follows: Section 1. For the purpose of this ordinance the phrase '~Pin Ball Machine" shall mean any punch board or any table game or device commonly known as a'~pin game," or "marble game," or any claw, scoop, or grab machine, or any "horse racing" machine or game, or any device similar thereto, the operation, use, or play of which is oontrolled by placing therein any coin, plate, disk, plug, key, or other device, or by the payment of any fee, or upon payment or delivery of anything of value, or upon the making of any purchase. Section 2, Every person, association of persons, firm, or corporation who keeps, maintains, possesses or has und.er his control, either as owner, lessee, agent, employee, mortgagee or otherwise, in any place except a building designed for and exclusively used for residence purposes or a part of a building where such part waa designed for and is exclusively used for residence purposes and any yards or courts used exclusively appurtenant thereto, any pin ball machine, is guilty of a misdemeanor, Section 3. The Chief of Police shall destroy any pin ball machine which is used, kept, placed, or maintained in violation o£ any statute, or of this or any other ordinance after any person, firm, or corporation owning, possessing, or having control of such machine has pleaded guilty to, or has been convicted of such violation and such ~v~e'~a~~~~iphas become final. Section 4. The Chief of Police shall deposit 3n the city treasury to the credit of the general fund all money contained in any machine, which machine he destroys pursuant to the provisions of Section 3 of this ordinanee. He shall destroy all other contents of any such machine. Section 5, The Chief of Police shall apply to the ,judge of any court which has custody of any machine sub~ect to destruction under the terms of Section 3 of this ordinance for an order releasing -1- such machines to him for the purpose of complying with this ordinance, Section 6. City Ordinance No, 318 is hereby repealed except such repeal shall not constitute a bar to either the prosecution or punishment of any acts committed prior to the effective date of such repeal in violation of any provisions of said ordinance, Section 7. Any person, firm, or corporation or aseociation of persons violating any of the provisions of this ordinance is $uilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed Five Hundred Dollars ($500.00) or by imprison- ment in the City or County ~ail for not to exceed six (6) months, or by both such fine and imprisonment. Each such person, firm, or corporation, or association of persons, shall be deemed guilty of a separate offense for each day during any portion of which any violation of any provision of this ordinance is committed, continued, or permitted by such person, firm, or corporation, or association of persons, and is punishable there£or as provid.ed by this ordinance. -2- STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES: ss. CITY OF LYNWOOD ) I hereby certify that the above and foregoing ordinance was submitted to a vote of the qualified electors of the City o£ Lynwood, California, pursuant to law, at a General Municipal Election held in said city upon the 12th day of April, 1960, and that said ordinance was adopted by more than a ma,jority of the qualified eleetors voting on said ordinance at said election, as determined by the City Council of said city in canvassing the votes of said election at its regular meeting held on April 19, i96o.
