Chairman's announcements There were no announcements 2. George Reilly-Local variance request for 73 Hamilton Cartway Mr. Reilly stated that he is requesting a 166' variance from the SAS to the pond. Mr.Reilly told the Board that this is an upgrade from cesspools. The entire dwelling is within 300 feet of the pond. The property is high on a hill and there is a 34' separation from groundwater to bottom of SAS. Conservation Commission gave approval but they do need a revised plan showing hay bales and the work limit on it. Motion:Finding that the depth to groundwater is well over the required amount,there is no other place on the lot to place the septic system and it is an improvement over what is currently there,approve the variance request. Motion:Annie Dugan Second: Dr. Scherzo Vote: 4-0-0 Action: Motion carried 3. Discuss report from King's Landing Mr. Skidmore told the Board that they had previously looked at a report from King's Landing and there were a few issues that the company was trying to fix. The Board had asked that they come back with an interim report. They are still having a few issues but believe they will be resolved quickly. This will be placed on the regular schedule for February. 4. Discussion on banning smoking from beaches Mr. Skidmore stated that about a month ago he went before the Board of Selectmen to see what their opinion was on this issue and whether they would support a BOH regulation or a Town Meeting vote. The BOS thought it best to bring it to a Town Meeting and stated that they were in favor of banning smoking from the beaches. Dr. Chaffee believes that this is a public health issue and should be a BOH regulation. Ms. Dugan also believes that this should be a BOH regulation. Dr. Scherzo believes that this should be voted on at a Town Meeting. Mr. Skidmore stated that the Board needs to be careful with how they word this. Smoking is a public health issue,he's not sure smoking on the beaches in Brewster is a public health issue. He doesn't believe that there is a huge issue with this problem in Brewster and thinks it should be voted on a Town Meeting. WWW.TOWN.BREWSTER.MA.US Dr. Chaffee does believe it is a public health issue and is looking at the cigarette butts left on the beach with all the chemicals leaching into the water. She stated that the Board's meetings are open to the public and anyone can voice their opinion on a proposed regulation. If the Board waits until Town Meeting in May,the Town would have to make signs and inform the public in such a short period of time. Mrs. Ice told the Board that of the towns that have this regulation, only 1 of those towns had the regulation made by the Board of Health. The Board agreed to bring it back at their next work meeting so that the whole Board could be present. 5. Discuss the Small Wastewater Treatment Facilities regulation Mrs. Ice told the Board that she had heard from George Heufelder who stated that its good that we had the regulations when the State didn't but now that they do,the Board's regulations really are not necessary. Dr. Scherzo would like to retain certain aspects of the regulations like the 10mg per liter requirement. Mrs. Ice also thought that the annual report was something that should be retained. Mr. Skidmore thought the definition of what a Small Wastewater Treatment Facility is should be worked on. The Board agreed that Mrs.Ice should make a draft with the items that were talked about included and bring back to the Board for discussion. 6. Discuss Planning Board application for 42 Warrens Road Noted. 7. Discuss the draft Pond Nutrient Regulation Mr. Skidmore stated that there has been nothing new presented yet. Dr. Scherzo stated that he has quite a few comments that he would like to send to Mark Nelson. Mr. Skidmore stated that is would be best to wait until they get a revised draft in case Mr.Nelson has already addressed Dr. Scherzo's additional comments. Mrs. Ice reminded Mr. Skidmore that he was going to speak to the Conservation Agent. 8. Discuss and approve minutes from 8/4/2015 Dr. Scherzo stated that he went to an open meeting law meeting last week and was told that documents that were used at the meeting should be referenced in the minutes. Motion: Approve the minutes with the correction. Motion: Dr.Chaffee Second: Annie Dugan Vote: 4-0-0 Action: Motion carried 9.
