HomeMy Public PortalAboutOrd. 0702ORDINANCE N0. 702 AN ORDINANCE OF THE CITY OF LYNWOOD PROHIBITING THE DISCHARGE OF A FIREARM, OR AIR GUN OR SPRING GUN IN SAID CITY AND FIXING A PENALTY THEREFOR. The City Council of the City of Lynwood does hereby ordain as follows: Section l. Discharge of Firearms and Slingshot Prohibited. A. It shall be unlawful for any person to disch~rge a firearm, air gun, or spring gun within the City except at an inanimate target or trap shooting device while under the supevision of either the Chief of Pclice or the Recreational Director at a time and place designated by either, and as a part of a regularly constituted pro- gram of target practice or hunting safety. B. It shall be unlawful for any person to use, operate or discharge a slingshot within the City. Section 2. Exceptions. Nothing contained in this ordinance shall be deemed to prohibit or curtail the exercises, maneuvers or other activities o£ the United States Armed Forces, or the militia of the State of California as defined by Section 120 of the Military and VeteranTS Code, nor to prohibit a public d3splay of fireworks as regulated by the provisions of Sections 12600 to 12609 of the Health and Sa£ety Code, within the limits of a public park in the City. Section 3. Penalties. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the city jail or in the county jail for not exceeding six (6) months or by a £ine not to exceed $500.00 or by both such fine and imprisonment. Section 4. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitu- tional, such decision shall not affect the validity of the remaining portions of this ordinance. The legislative body hereby declares that it would have passed this ordinance and. each section, subsection, sentence, clause and phrase thereof, irrespective o£ the fact that -1- any one or more sections, subsections, sentences, clauses, or phrases be declared unconstitutional. Section 5. Repeal. Ordinance No. 155 and Section 8 of Ord3nance No. 464 of the City of Lynwood are hereby repealed, and all ordinances or parts of ordinances in conflict or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment o£ any person for any act done or committed in violation o£ any ordinance hereby repealed prior to the taking effect of this ordinance. Section 6. The City Clerk shall certify to the adoption oP this ordinance and shall cause the same to be published once in the Lynwood Press, a newspaper of general circulation printed and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 15th day of March, 1960, and £inally adopted. and ordered. published at a regular meeting of said Council held on the 5th day of April, 1960, by the following vote: Ayes: Councilmen English, Pender, Rowe, Summers.
