Chairman's announcements There were no announcements. 2. Oceanside Septic-local variance request for 216 Gulls way Linda Pinto presented this to the Board. The property is being sold and a Real Estate Transfer inspection identified the leaching area as being 225' from Sheep Pond. She noted that there is 37'from the leaching to groundwater. The groundwater flow is NW. Dr. Scherzo asked what the daily flow of the septic system was and about border vegetation. Ms. Pinto stated that the system is designed for 550 gallons per day and the area has a lot of vegetation around it. Motion: Finding that the system is as far away from Sheep's Pond as possible,depth to groundwater is 37'and the d-box was recently repaired,grant the variance request of allowing the leaching area to remain 225' from the pond. Motion: Dr.Chaffee Second: Annie Dugan Vote: 4-0-0 Action: Motion carried 3. Denis&Cheryl Williams-local variance request for 42 Turning Mill Road The homeowners were not present. The variance request is to allow the leaching area to remain 185' away from the pond. Dr. Chaffee asked what the depth to groundwater was. Mrs. Ice stated that is was greater than 5'. Dr. Scherzo voiced his concerns with the depth to groundwater because of the proximity of this system to the pond. Dr.Chaffee asked if the groundwater flow was northerly. Mrs. Ice stated that it was more northwest,probably in the general direction of the pond. It was noted that the septic was installed in 2002. Motion: Finding that this is a 2002 septic system, it is at least 10 feet above groundwater,the size and position of the property does not permit moving the system further away from the pond,grant the variance request of allowing the leaching area to remain 185' from the pond. Ryder&Wilcox-Title 5 variance request for 320 Run Hill Road Stephanie Sequin presented this to the Board. Owner Peter Spier was also present. The following variances are being requested: 1. To allow a portion of the soil absorption system(SAS)to be 5' below the finished grade. 2. To allow the septic tank to be 6' below the finished grade. The house is being sold and a Real Estate Transfer inspection revealed the system was in failure. There will be H2O components installed. Motion: Finding that this is a failed system and a new system will be installed,grant the variance requests of allowing the SAS to be 5' below finished grade and the septic tank to be 6' below finished grade with H2O components. Motion: Annie Dugan Second: Dr. Chaffee Vote: 4-0-0 Action: Motion carried 5. Discuss and approve Food Service permit application for"Maplewood at Brewster" Ron Pascoe,Director of Food&Beverage and Joslyn Isabel were present. This is the memory care facility that is currently being built in Brewster. The kitchen will serve approximately 90 people daily. They are planning on opening in January of 2016. They did receive a copy of the Assistant Health Director's review with recommendations. Motion:Approve the application for a Food Service permit pending completion of the Assistant Health Director's recommendation and a final inspection. Motion: Dr.Chaffee Second: Annie Dugan Vote:4-0-0 Action: Motion carried 6. Kurt Raber-seeking support of a plumbing variance for 739 Lower Road Kurt Raber,Plumber and Stephen Jones,President of the Historical Society were present. Mr.Raber explained that they are doing renovations at the house so that the Historical Society can take over the space for their offices. Mr.Jones stated that there are usually only a few people in the building at one time. They are seeking a variance from the plumbing code that requires them to have 2 single use toilet rooms. They would like to be able to just use the existing bathroom. The State Plumbing code requires that they come before the Board of Health for support of their application. Dr.Chaffee asked if there were plans for social events of large groups going through. Mr.Jones stated that at this time there were no plans for that and that the single bathroom there is only for employees. It is not open to the public. Motion: Endorse the request for a variance from the State. Motion: Annie Dugan Second: Dr.Chaffee Vote: 3-0-1 (Dr. Scherzo abstained) Action: Motion carried 7. Discuss draft Pond Nutrient regulation Mark Nelson was present and went over the changes that he had made since the last time the Board met. The changes stemmed from comments the Board had. Dr. Scherzo had a prepared statement with his concerns and comments that he read to the Board. There was a lengthy discussion among the Board members and Mr.Nelson. Mr.Nelson will go back and take the new comments from the Board and revamp the draft regulation and it will be brought up again at the October 20th meeting. BOH 10/6/2015 Minutes Page 2 8. Discuss Planning Board application for 2628 Main Street Dr.Chaffee had concerns with the fact that they were going to be offering speech therapy. She questioned who makes sure that the people doing the therapy were properly licensed. Mrs. Ice will note the comments to the Planning Board. 9. Discuss information on meeting minute records Dr. Scherzo brought this up because he had recently attended an Open Meeting Law seminar and had questions about how the minutes were done. There was a brief discussion on this. 10. Discuss and approve minutes from 9/1/2015 A few minor changes were made. Motion: Approve the minutes with the changes. Motion: Dr.Chaffee Second: Dr. Scherzo Vote:4-0-0 Action: Motion carried 11. Discuss and approve minutes from 9/15/2015 Motion: Approve minutes as written. Motion: Dr.Chaffee Second: Annie Dugan Vote: 4-0-0 Action: Motion carried 12. Topics the Chairman did not anticipate None.
