HomeMy Public PortalAbout2022 1011 Council Packet RIVERDALE CITY COUNCIL AGENDA PLACE: Riverdale City Hall, 110 Manor Drive, Riverdale, Iowa DATE: October 11, 2022 TIME: 7:00 p.m. The regular meeting of the City Council of Riverdale, Iowa, will be conducted according to the following order and actions will be considered on the items listed. The notice of this meeting is not considered final until 24 hours prior to the meeting and may be further modified if 24 hours’ notice is impossible or impractical for good cause. In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state laws, all public hearings and meetings held or sponsored by the City of Riverdale, Iowa, will be accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact City Hall at (563)355-2511 five days prior to the hearing or meeting to inform of their anticipated attendance. The requirement that an Ordinance be read three times before passage may be waived by council upon an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this process and be prepared to speak either for or against any ordinance at the time of the first reading. Per Chapter 21 of the Iowa Code, more specifically described in sections 21.3 and 21.8, a member of the Council may attend the meeting either in-person or by electronic means, as defined in said sections. 1. PUBLIC COMMENT Per Iowa Code 21.7, this governmental body make and enforce reasonable rules for the conduct of its meetings to assure meetings are orderly, and free from interference or interruption by spectators. The public is encouraged to provide and insights on the proposed agenda and other items of concern. Public comment time is limited to three (3) minutes per speaker. Speakers will introduce themselves, their topic(s) concern, and provide their address for the record. Public comments do not need to be in support of proposed actions but are to be constructive and respectful. A lack of decorum will result in the end of comment period and possible removal from the meeting. All members of council, the public, and staff are encouraged to find ways to effect positive change in their comments and their actions for the betterment of our community. 3. Page 19 of 55 Local Limit Analysis and Pretreatment Streamlining August 10th, 2022 Facility Name: Davenport City of STP Introduction: The City of Davenport received a new permit in July 2021 for the Davenport Water Pollution Control Plant (DWPCP). A local limit analysis was required by the issuance of this permit. History: Local limits for the DWPCP have been in place since 2003. DWPCP staff, with the assistance of Paul Marshall, Region VII EPA, and his spreadsheet, developed local limits for the treatment plant. The analysis was modified and approved by Steve Williams, Iowa Department of Natural Resources (IDNR). The DWPCP developed a two-tiered approach to local limits. This method better distributed the pollutant allocations to all industries. The three high flow food processors (PB Leiner, (formerly Leiner Davis Gelatin), Kraft Oscar Mayer, and Nestle Purina Pet Care) have historically been in tier one. Based on historical discharge data, a multiplier of domestic strength pollutant level was used with their monthly average permitted flow to determine monthly average poundage of pollutant allowed from each of them. These industries have been regulated purely on monthly average poundage since they are measuring actual daily sewage flow and have a flow proportional sampler. However, Kraft Oscar Mayer’s facility was decommissioned in 2019. The new facility, Kraft Heinz, has been placed in Tier 1 (High flow, low metals). In this revision of the Sewer Use Ordinance, Kraft Oscar Mayer will be removed, Kraft Heinz added, and local limits recalculated using the same formula in order to account for this change. All other industrial contributors are in tier two and have a uniform concentration limit applied. This uniform concentration limit is calculated by subtracting the total of tier one poundage from maximum allowable industrial poundage and dividing by tier two monthly average permitted flow. An industry can be permitted on poundage basis only using the UCL if they install a flowmeter and flow paced sampler. A five percent growth factor was set aside from the maximum allowable industrial poundage. The established local limits are listed in Table 1 and Table 2. At the last Audit of our Pretreatment program, it was noted that there was an inconsistency in our Sewer Use Ordinance. During the 2018 modification of the SUO, the City adopted a new definition of Significant Noncompliance (SNC) at 13.16.260 (f) that reads “Failure to provide within 45 days after the due date, any required reports, including baseline monitoring reports, reports on compliance with categorical Pretreatment Standard deadlines, periodic self-monitoring reports, and reports on compliance with compliance schedules”. However, the City did not update its Enforcement Response Plan (ERP), which still indicates “Failure to provide within 30 days.” We propose changing the language in the ERP to reflect this change. (See Appendix A). IDNR did not propose any limits be placed in the permit at this time, for these parameters. Page 22 of 55 A chloride sample was taken and submitted for evaluation against the chloride water quality standard (WQS). The chloride result of 152 mg/L is only 5.8% of the WQS and therefore monitoring and limits were not included in the new permit. I see no potential to violate the chloride WQS and no need to include chloride in the local limit parameters. A sample was also submitted and analyzed for Sulfate (same sample). The resulting sulfate value of 72.2 mg/L is only ~1% of the WQS for sulfate and therefore monitoring and limits were not included in the new permit. I see no potential to violate the sulfate WQS and no need to include sulfate in the local limit parameters. Currently, there are no WQS for total nitrogen, total kjeldahl nitrogen, total phosphorus or nitrate; and there are no limits for these parameters in the 503 regulations for land application of the biosolids. The highest Secondary Effluent ammonia nitrogen result, during a 12-month period from May 2020 through May 2021, was 24.64 mg/L and the average ammonia nitrogen result was 19.49 mg/L. I see no reasonable potential to exceed the WLA for ammonia nitrogen and therefore no need to include ammonia in the local limit parameters. When Local Limits were re-evaluated last in 2008, there was initial concern for the potential to exceed the new WQBEL of 0.01428 mg/L for thallium. Further testing was conducted from July 24, 2008 through September 30, 2008. Nine samples were analyzed and all samples, except for one, were reported at <0.01 mg/L. The exception sample was reported at 0.01 mg/L. See table 3. In 2021, the new permit established a new WLA for Aluminum. Previously, no local limit was designated for Aluminum. The new allocation (3.249E+00 mg/L) was much lower than the previous value (27.4 mg/L), and there was originally concern for exceedance. However, during the testing period from 5/4/2020-5/31/2021 (N=56), the average, max, and min Aluminum values in both influent and effluent were well below the limit. At this time, I do not believe it is necessary to establish a local limit for Aluminum. Also listed is sampling of some recommended models from each category that we currently have in our used equipment inventory. Elgin is North America’s largest sweeper manufacturer made in nearby Elgin, IL (Chicago). They may many types of sweepers, there’s no wrong answer, but you want to find something that suits your needs best, most of the time. Most likely the answer for a small town is the Elgin Pelican as it’s the easiest to work on sweeps the widest variety of the material, doesn’t require a CDL to operate, and is usually the cheapest to purchase. Mechanical Sweepers: Utilize a large center pickup broom in combination with a gutter broom(s) to lift debris onto a conveyor and into a hopper. Work on a similar principle as a broom and a dust pan. Can be equipped with a water system for dust control or a waterless dust control system for year round usage with dust control. Strengths: They are the most versatile and maneuverable sweeper (especially the 3-Wheel Rear Steer Pelican). Better at sweeping heavy material and can pickup most any large debris such as sticks, large litter hubcabs, etc. They can sweep with or without the use of water for use in months when the temperature is below freezing, and can high-dump into a dump truck. Represent the majority of sweepers in Iowa. Weaknesses: Some models (Pelican) are limited to 20 mph transport speed, smaller debris hopper. Effective January 1, 2023, or after the last meter reading for the fourth quarter of 2022, whichever occurs first, applicable each subsequent fiscal year, the comprehensive sewer service charge, as provided in this section, to be paid by Users of the wastewater treatment facilities of the city and billed beginning January 1, 2023, or after the last meter reading for the fourth quarter of 2022, whichever occurs first, applicable each subsequent fiscal year, is hereby established per the tables above. The rate charged is subject to review by the City Council and may be adjusted by Ordinance. For fiscal year 2030 and following, the rates will remain at 2029 levels until modified by the City Council. 3. Surcharge for Wastes of Strength Greater than Domestic Water. The surcharge for the operation and maintenance (O & M) cost of the wastewater treatment works shall be collected from those Users who contribute wastes of strengths greater than domestic wastewater. These Users shall be sampled, and the sample analyzed at least once per quarter. A moving average of excess biological oxygen demand (BOD) and suspended solids (SS), expressed in pounds, shall be used to compute the quarterly charge. A. Quarterly Excess BOD. The quarterly excess BOD, expressed in milligrams per liter, shall be calculated by subtracting the BOD of domestic wastewater (two hundred fifty milligrams per liter) from the monthly average BOD of a User. If the value is less than zero, zero shall be used to compute the average of excess BOD. B. Moving Average Excess BOD Value. The moving average of excess BOD, expressed in pounds, shall be computed by adding the latest quarterly excess BOD, expressed in pounds, to the previous three quarters' excess BOD, expressed in pounds, and divided by four. C. BOD Surcharge Amount. The surcharge for BOD shall be calculated by multiplying the moving average excess BOD value by the unit BOD cost per pound. The unit BOD cost per pound shall be determined by multiplying the anticipated budget by thirty-five percent (35%) and dividing by the previous year’s total BOD load at the wastewater treatment works measured in pounds. The unit BOD cost per one hundred (100) cubic feet of domestic wastewater is obtained by multiplying the unit BOD cost per pound by 1.564. D. Quarterly Excess SS. The quarterly excess SS, expressed in milligrams per liter, shall be calculated by subtracting the SS of domestic wastewater (three hundred milligrams per liter) from the quarterly average SS of a User. If the value is less than zero, zero shall be used to compute the moving average of excess SS. E. Moving Average Excess SS Value. The moving average excess SS, expressed in pounds, shall be computed by adding the latest quarterly excess SS, expressed in pounds, to the previous three quarters’ excess SS, expressed in pounds, and divided by four. Page 44 of 55 Ordinance No. 05-2022 - Page 3 of 4 F. SS Surcharge Amount. The surcharge for SS shall be calculated by multiplying the moving average excess SS value by the unit SS cost per pound. The unit SS cost per pound shall be determined by multiplying the said anticipated budget by forty percent (40%) and dividing by the previous year’s total SS load at the wastewater treatment works measured in pounds. The unit SS cost per one hundred (100) cubic feet of domestic wastewater is obtained by multiplying the unit SS cost per pound by 1.877 pounds. The total surcharge shall then be a summation of the surcharge for BOD and the surcharge for SS. 4. Measurement by Meters. Such rates or charges shall be based upon the amount of water supplied by the Water Company by the water meter readings of that company. By virtue of agreement between the City of Riverdale and the Water Company, the comprehensive sewer service charges will be billed, accounted for, and collected by the City of Riverdale. All persons required to pay the comprehensive sewer service charge established in this chapter shall receive billing for such charge separately stated on the sewer bill and shall pay such charges to the City of Riverdale as billed. Those Users who are billed by the City of Riverdale quarterly shall pay their comprehensive sewer user charges quarterly. 5. Date Due; Penalty. All comprehensive sewer user charges are due and payable thirty (30) days after the date of billing. The penalty of ten dollars ($10.00) shall be added each quarter to the comprehensive sewer service charge billed quarterly to any User when the charge is not paid within thirty (30) days. 6. Special Rates: Grounds; Approval; Private Water Supply Users. Where, in the judgment of the Riverdale City Council, special conditions surround the use of water to the extent that the application of the comprehensive sewer service charge or method of measurement would be inequitable or unfair to either the City of Riverdale or the User, a special rate or method of measurement shall be established by the City of Riverdale. Such rates or methods of measurement shall be subject to approval by resolution of the Riverdale City Council. In such cases, the Riverdale City Council may require that water consumed on the premises concerned shall be separately metered at the expense of the User, who shall also pay the cost of reading such meters and any increased billing or collecting charges resulting. In such cases, the Riverdale City Council may require that water consumed on the premises concerned shall be separately metered at the expense of the User, who shall also pay the cost of reading such meters and any increased billing or collecting charges resulting. In such cases where a major portion of the water consumed is not discharged into or does not reach the sanitary sewer system, the following shall apply: A. Said water so consumed shall be metered by a separate water meter with a remote-read register and generator at the expense of the owner. Said remote-read register shall be readable from outside a dwelling unit or building. Water metering systems existing prior to May 18, 1976, that conflict with this section may be retained. Replacement systems for those existing prior to May 18, 1976, shall be in compliance with these provisions. Any system installed after May 18, 1976, shall be in compliance with this section. B. A fee of five dollars ($5.00) per water meter with remote-read register and generator will be charged for annually reading and computing comprehensive sewer service refunds. An additional fee of five dollars ($5.00) annually will be charged for reading and computing comprehensive sewer service refunds for water metering systems without remote-read registers. Page 45 of 55 Ordinance No. 05-2022 - Page 4 of 4 Where private or quasi-public water well systems are used and discharged directly or indirectly into a sanitary sewer system, the comprehensive sewer service charges shall be on an equal basis as nearly as may be with the charges which would apply to an equal quantity and character of wastewaters originating through the use of the public water supply. Amended Section Chapter 135 Street Use and Maintenance, Subsection 135.09 Excavations, of the Code of Ordinances of the City of Riverdale, Iowa, is hereby repealed and replaced as follows: Chapter 135 Street Use and Maintenance 135.09 EXCAVATIONS. No person shall dig, excavate or in any manner disturb any City-owned property (Property), to include City parks, streets, parking areas, alleys, multi-use trails, levees, floodwalls, stormwater retention or detention areas, utilities, or other rights-of-way and appurtenances, except in accordance with the following: 1. Permit Required. No excavation shall be commenced without first obtaining a permit therefor. A written application for such permit shall be filed with the City and shall contain the following: A. An exact description of the Property, by lot and street number, in front of or along which it is desired to excavate; B. A statement of the purpose, for whom and by whom the excavation is to be made; C. The person responsible for the refilling of said excavation and restoration of the Property to preexisting grade and condition; and D. Dates of commencement of the work and estimated completion. 2. Public Convenience. Property shall be altered in the manner which will cause the least inconvenience to the public and allow the uninterrupted passage of water along and through the Property. 3. Barricades, Fencing and Lighting. Adequate barricades, fencing and warning lights meeting standards specified by the City shall be so placed as to protect the public from hazard. Any costs incurred by the City in providing or maintaining adequate barricades, fencing or warning lights shall be paid to the City by the permit holder/property owner. 4. Bond Required. The applicant shall post with the City a penal bond in the minimum sum of one thousand dollars ($1,000.00) issued by a surety company authorized to issue such bonds in the State. The bond shall guarantee the permittee’s payment for any damage done to the Property, and payment of all costs incurred by the City in the course of administration of this section. In lieu of a Page 49 of 55 Ordinance No. 07-2022 - Page 2 of 3 surety bond, a cash deposit of one thousand dollars ($1,000.00) may be filed with the City, refundable upon completion of the project and restoration of the Property to the City’s satisfaction. 5. Insurance Required. For the duration of a contract, the applicant must obtain and maintain $500,000.00 public liability and property damage/auto insurance in the minimum amount of $100,000.00 for each occurrence of property damage and $500,000.00 for each occurrence of personal injury or bodily harm. 6. Restoration of Property. Property disturbed in the course of the work shall be restored to the condition of the property prior to the commencement of the work, or in a manner satisfactory to the City, at the expense of the permit holder/property owner. 7. Inspection. All work shall be subject to inspection by the City. Backfill shall not be deemed completed, nor resurfacing of any Property begun, until such backfill is inspected and approved by the City. The permit holder/property owner shall provide the City with notice at least twenty-four (24) hours prior to the time when inspection of backfill is desired. 8. Completion by the City. Should any excavation of any Property be discontinued or left open and unfinished for a period of twenty-four (24) hours after the approved completion date, or in the event the work is improperly done, the City has the right to finish or correct the excavation work and charge any expenses therefor to the permit holder/property owner. 9. Responsibility for Costs. All costs and expenses incident to the excavation shall be borne by the permit holder and/or property owner. The permit holder and owner shall indemnify the City from any loss or damage that may directly or indirectly be occasioned by such excavation. 10. Notification. At least forty-eight (48) hours prior to the commencement of the excavation, excluding Saturdays, Sundays and legal holidays, the person performing the excavation shall contact the Statewide Notification Center and provide the center with the information required under Section 480.4 of the Code of Iowa. 11. Permit Issued. Upon approval of the application and filing of bond and insurance certificate, a permit shall be issued. A separate permit shall be required for each excavation. 12. Permit Exemptions. Property owners, in the usual course of maintenance and upkeep of their properties, are exempt from the permit application requirement of this section. Utility companies are exempt from the permit application requirement of this section. They shall, however, comply with all other pertinent provisions, including bonding and insurance, which shall be submitted for approval before any work commences. SECTION 2. REPEALER.
