HomeMy Public PortalAboutOrd. 0694/ ~-! ORDINANCE No. 694 AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA PROVIDING ~OR THE LICENSING, VACCINATION, AND REGULATION OF DOGS. The City Council of the City o£ Lynwood does ordain as follows: Section 1. The City License Collector is hereby declared to be the dog license collector, and whenever the words ~'License Collector" are hereinaPter used., they shall refer to the dog license collector. Section 2. The word "dog" as used in this ordinance shall include male and female and neuter, Section 3. It shall be unlawful for any person to own or harbor or have the care, custody or control of a dog or dogs within the corporate limits of Lynwood over the age of four (4) months with- out first obtaining from the License Collector an annual license for each of said dogs so to do upon the payment of the fee hereafter specifi~d. Section 4. (a) The license fee for keeping, harboring, or maintaining a dog or dogs within said city is as follows; For every dog the sum of Three Dollars ($3.00) per year, puppies under the age of four (4) months excep~ed. (b) Each such license shall be paid annually in advance, on or before the first day of January. Section 5. It shall be the duty of the License Collector to publish in a newspaper in the said City of Lynwood in the month of December for three (3) weeks prior to January l, notice stating that d.og license fee will be delinquent ten (10) daya after January l. Section 6. Whenever any person or persons owning, harboring, or having control, care, charge, custody, or possession of any dog or dogs within the City of Lynwood, and who, after ten (10) d.ays following January 1 of any year, shall fail to pay the license fee provid.ed and specified. in this ordinance, such person or persons shall be deemed -1- guilty of a violation of Sections 1 and 3 of this ord.inance. Section 7. The License Collector shall each year, at the expense of the City, procure sufficient number of inetallic tags for dogs to meet the requirements of the City, such tags to be numbered from "1" upward consecutively and on which shall be stamped the year of issue and '~Lynwood Dog License." He shall issue the same to the applicants for d.og licenses in consecutive order, as may be required, keeping an account thereof, or he may give such number of said license tags to the contracting pound service as, in his discretion, he deems fitting and proper, and the duly authorized agents and employees of said contracting pound service shall have the same authority as the License Collector to issue said license tags and to collect the fee therefore; provided, however, that all receipts for said fees shall be written on receipt forms furnished said contracting pound service by the License Collector, and said contracting pound service shall account to the License Collector for all license tags issued and fees collected, and the License Collector shall have the same duty to account for license tags issued and fees collected by said person or association that he has for licenses furnished to and.fees collected d.irectly £rom the licensees as hereinabove set forth. Section 8. The License Collector shall, on the payment of the dog license fee by the owner, caretaker, or custodian of such dog, d.eliver to such person an appropriate tag to indicate such license has been paid; provided, however, that the License Collector may delegate his duties to a person, the County of Los Angeles, or association with whom the City may have a contract to perform the duties of poundmaster, in the manner provided in Section 7 hereof. Whenever the word ~'pound- master" is hereinafter used, 2t ahall refer to the one with which the City may have a contract to perform the duties of poundmaster, Section 9, ~he owner, caretaker, or cuetodian of any dog d.escribed. in this ordinance and for which license fee is paid and. a numbered license tag issued, shall securely fasten such tag to a sub- stantial collar or body harness which the dog shall wear at all times, -2- Section 10. It shall be the concurrent duty of the Chief of Police and the poundmaster to enforce the provisions of this ordinance. Section 11. It shall be unlawful within the city limits of the City of Lynwood for any person owning, hsrboring, or having care, custody, charge, or possession of any dog or dogs, to allow or permit such dog or dogs to go free or to run at large or upon any public street, alley, public road., highway, public park, school yard, or any other public place or in or upon any unenclosed lot or premise. Section 12. Every person owning or harboring or having eharge, care, custody, control, or possession of any dog or dogs not kept within an enclosure sufficient to restrain such do~ or dogs from running at large, shall be required to restrain said dog or dogs by a substantial chain or leash not exceeding six (6) feet in length and in charge, care, custody, or control of a competent person. Section 13. No person owning or having charge, care, custody, or control of any d.og or dogs shall cause, permit, or allow the same to go into, nor shall it or they be taken into any place where food is hand.led, prepared, served, or sold., nor into any public or private school building or school grounds within the corporate limits of said City of Lynwood. Section 14. Svery person keeping, harboring or having a dog over the age of four (4) months in the City of Lynwood, California, shall cause such dog to be vaccinated with rabies vaccine within a period of thirty (30) days from the date of harboring, keeping, or having said dog within said city, or from the d.ate the said dog attains the age o£ four (4) months; provided, however, that the aforesaid pro- vision shall not apply so as to require the vaccination of any dog which has been vaccinated with a chick embryo vaccine by a person licensed by the State of California, or of any other state or nation, to praetice veterinary medicine where such vaccination has been com- pleted within the period of time as hereinafter prescribed in this Section 14. If chick embryo vaccine was used in such vaccination, it -3- must have been completed within two (2) years prior to the date such dog was kept, harbored, or brought into the City of Lynwood.. If tissue phenolized vaccine was used, such vaecination must have been completed within one (1) year prior to the date such dog was kept, harbored or brought into the City of Lynwood. Section 15. (a) Every pereon keeping, harboring or having a dog in the City of Lynwood, California, which has been vaccinated with chick embryo vaccine shall cause such dog to be revaccinated with- in a period o£ not more than two years after such prior vaccination. (b) Every person keeping, harboring or having a dog in said City of Lynwood which has been vaccinated with tissue phenolized vaccine shall cause such dog to be revaccinated with rabies vaccine within a period of not more than one year after such prior vaccination. Section 16. Every person applying for a dog license whether to the poundmaster of the city or to the License Collector o£ the city must exhibit a certi£icate issued by a person licensed by the State of California, or any other state or nation, to practice veterinary medicine which certificate shall show that the dog for which the license shall be issued. has been vaccinated in accordance with the proviaions of Sections 14 and 15 of this ord.inance. Section 18. (a) The poundmaster shall capture and impound any dog found within the city limits of the city which is not wearing a license tag issued by the City of Lynwood, or by any other munici- pality in the County of Los Angeles or by the County of Los Angeles, or which is in violation of Sections 11 and 12 0£ this ordinance. (b) The poundmaster, or any officer or employee thereof, or any police of£icer of the City of Lynwood, or of any city in Los -4- Angeles County, shall have the right to enter upon any private or public property in the City of Lynwood in order to examine or capture any dog thereon or therein; provided, however, that neither the pound- master, nor any officer or employee thereof, nor any police officer shall have the right to enter a yard or private property which is com- pletely enclosed by a wall or fence, provided that all gates, doors, and other means of entrance to said yard are securely closed, or a house which is in use as a residence, without first having secured a search warrant therefor, (c) No dog so impounded shall be released to any person except where there has been a performance of the following conditions: (1) There has been presented to the poundmaster a current license for such dog issued by the License Collector, or if the person keeping, harboring, or having such dog is not a resident of the. City of Lynwood, such non-resident person has presented to the poundmaster a current license conforming to this ordinance for such dog issued by any other municipality in the County of Los Angeles or by the County of Los Angeles. (2) Where the person keeping, harboring, or having such dog is a resident of the City of Lynwood, there has been paid to the poundmaster the license fee for a City of Lynwood dog license as provided by law. (3) There has been paid to the poundmaster the impounding collection and other fees as provided by law. (4) There has been deposited with the poundmaster a reasonable amount as determined by the poundmaster; provided, however, that such fee shall not exceed $5.00, which shall be held by the poundmaster as security for the cost of the vaccination of said dog; that the diPference, if any, between the cost of the vaccination of said dog and the amount of the deposit shall be refunded to the owner of said dog within a reasonable time after said dog has been vaccinated, or -5- there has been ehown to the satisfaction of the poundmaster that such dog has been vaccinated with rabies vaccine within the time periods and according to the other requirements as prescribed by the State Department of Health; or that such dog should not be vaccinated with rabies vaccine by reason of age, infirmity, or other disability. (5) The poundmaster has determined that such dog does not have and is not reasonably suspected of having rabies. (d) Within seventy-two j72) hours after the receipt of the aforeaaid vaccination fee, or as soon thereafter as possible, and except as provided in paragraph(4)of this Section 18, the poundmaster shall cause the dog for whom the fee has been paid to be vaccinated according to the requirements as prescribed by the State Department by a person licensed by the State of California to practice veterinary medicine, or secure from such veterinarian a certificate of disability for such dog. After the dog has been vaccinated or a certi£icate of disability issued and if all conditions of paragraph (c) of this Section 18 have been satisfied, the poundmaster shall release such dog to the person keeping, harboring, or having such dog or to the person making application for the release of such dog. (e) If the poundmaster suspects that any dog 9o impounded has rabies, he shall hold euch dog for inspection by a health officer of Los Angeles County. In the event that such health officer shall determine that such dog is afflicted with rabies, it shall be disposed. of or confined for such time as the health officer shall direct. In the event that such health officer suspects that such dog may develop rabies, it ahall be confined for such time as the health officer shall direct. Whenever such health officer shall determine that such dog does not have rabies, it shall be released in accordance with the pro- visions of paragraphs (e) and (d) of this Section 18. If such dog shall not be redeemed within twenty-four (24) houzs after notice of said dog being free of rabies, such dog may be sold or disposed of as herein otherwise provided in this ord.inance. Section 19. The poundmaster, any of his employees or agents - 6- and any police officer of the city shall, at the time o£ pursuit, capture, or removal of any dog or dogs from a premise, if possible sign and deliver to the owner, caretaker, or custodian thereof a notice stating the cause for impounding such dog or dogs, the location at which such d.og or dogs must be redeemed, the business hours of the poundmaster, and the redemption fee and the rate of expense. Section 20. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine oP not more than Five Hundred Dollars ($500.00) or by imprisonment in the City Jail of the City of Lynwood, California, or in the County Jail of the County of Los Angeles, California, as the committing magistrate may d3rect, for a period of not more than six (6) monthe or by both such fine and imprisonment, in the discret3on of the Court. Section 21. Sections 1 through 20 of Ordinance No. 668 entitled "AN ORDINANCE PROVIDING FOR THE LICENSING, VACCINATION, AND REGITLATION OF DOGS," adopted December 3, 1957, are hereby repealed. Such repeal shall not release any person, firm, or corporation from liability for any license fee due, nor shall it constitute a bar to either the prosecution or punishment of any acts committed prior to the effective date of such repeal in violation of any provis3on of this ordinance. Section 22. That the City Clerk shall certify to the passage and adoption of this ordinance, and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the Lynwood Press, a weekly newspaper of general circulation, published and circulated within said City of Lynwood, and which ia hereby designated for that purpose.
