HomeMy Public PortalAbout20141117 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 17 November 2014 Page 1 of 3 17 November 2014 Called to Order: 7:30 PM Town Hall, Room 216 Adjourned: 9:10 PM Present: Jeffrey Barnes, Jim Ciriello, Ed Harrow, Craig Nation, Melissa Recos, Kerry Reed, Marcus Waldron, Don MacAdam: Conservation Administrator, Bob Ingram: Conservation Scientist, Anna Rogers: Inspections Administrative Assistant Absent: none 7:30 PM Commission Business • The Commission signed the following documents: - Thurloe Kensington Co., 85 West Main St – Order of Conditions (188-1563) - Lenity Architecture & Legacy Farms LLC, 132 East Main St, 0 Legacy Farms South, 0 Clinton St – Amended Order of Conditions (188-1534) • Mr. Waldron made a motion to approve the Minutes of 10 March 2014. The motion was seconded by Mr. Ciriello and it passed unanimously. • The Commission held a brief discussion regarding the Chapter 61A Notice of Intent to Sell the Property, 203 Pond Street. Mr. Dave Goldman, President of HALT, submitted a letter entitled “An Open Letter To Be Read Into The Public Record” and a Power Point Presentation entitled “203 Pond Street Proposal” by the Whitehall Woods Alliance. The Commission determined to forward a letter to the Director of Land Use, Planning and Permitting in support of the Town purchasing the property at 203 Pond Street. 7:40 PM Thompson, 5 Briarcliff Drive DEP File No. 188-1565 Notice of Intent David Marquedant, JD Marquedant & Associates, Inc.; Michael & Melissa Thompson, owners/applicants Mr. Marquedant provided an overview of the Notice of Intent application and site plans dated 26 September 2014 revised through 6 November 2014. He noted all the proposed work will be within existing lawn area and the existing permanent immovable barrier will remain in place. Mr. Ciriello made a motion to close the hearing and issue an Order of Conditions with the standard and noted conditions. The motion was seconded by Mr. Waldron and it passed unanimously. 7:50 PM Minglewood Development, 166 Saddle Hill Road DEP File No. 188-1541 Amended Notice of Intent David Marquedant, JD Marquedant & Associates, Inc.; Skip Kelleher, Minglewood Development Conservation Commission Meeting 17 November 2014 Page 2 of 3 Mr. Marquedant provided an overview of the Amended Notice of Intent application and site plans dated 20 January 2014, revised through 14 October 2014. Mr. Marquedant noted the total square footage of impervious area proposed to be removed, which includes the existing single family home (SFH), area of the previously approved SFH addition, outbuildings, driveway and compared it to the proposed SFH and driveway. He noted the applicant is in discussions with the Board of Health regarding potentially not abandoning the existing well structure at the rear of the property and making it safe. A discussion was held regarding the installation of a new SFH foundation given the existing ledge on the site. Steven & Martha Jo Greystone, 114 Saddle Hill Road, expressed concerns regarding the size of the proposed SFH compared to the size of the lot. Mr. Greystone stated he assumed that the applicant owned the collapsing well structure which is located on the lot across from 166 Saddle Hill Road and would like it either removed or restored. Mrs. Greystone asked questions regarding the buffer zone and total amount of proposed disturbance. She stated she wants to make sure her privacy is being preserved. Mr. Marquedant addressed her questions on the proposed site work. Mr. Waldron made a motion to close the hearing and issue an Amended Order of Conditions with the standard and noted conditions. The motion was seconded by Mr. Nation and it passed unanimously. 8:20 PM DeWolfe, 26 Lake Shore Drive RDA 2014-11 Request for Determination of Applicability David Marquedant, JD Marquedant & Associates, Inc.; Doug & Karen DeWolfe, applicants/owners Mr. Marquedant provided an overview of the Request for Determination of Applicability application and site plans dated 20 October 2014. He stated they are proposing to raze the existing single family home (SFH) and not raze the existing foundation. He stated they are proposing to construct a new 2-story SFH on the existing foundation with a front and back deck. He noted there are two trees they would like to remove within the buffer zone, one which is leaning over the existing house. A discussion was held regarding the installation of a temporary retention area during construction. The applicants noted they were amenable to installing a temporary retention area. Mr. Nation made a motion to close the hearing and issue a Negative Determination of Applicability, subject to the submittal of a revised plan, with the standard and noted conditions. The motion was seconded by Mr. Ciriello and it passed unanimously. 8:27 PM Connearney, Lot 6, 0 Hayden Rowe Street DEP File No. 188-1561 Notice of Intent - continued Dan Wells, Goddard Consulting, LLC; Bob Poxon, Guerriere & Halnon; Michael Connearney, applicant Mr. Ingram stated the bordering vegetated wetland on the subject parcel is tributary to Echo Lake which is a public water supply for the Town of Milford and filling wetlands is not allowed under the DEP Water Quality Certification Program. Mr. Poxon stated they have filed a 401 Water Quality Certification application with DEP-CERO but have not received a response to date. A discussion was held regarding the proposal meeting performance standards under the Wetlands Protection Act and Hopkinton Wetlands Protection Bylaw. The Commission determined they would like the opportunity to review comments from DEP-CERO regarding the 401 Water Quality Certification application prior to closing the Notice of Intent hearing. The hearing was continued to 01 December 2014. Conservation Commission Meeting 17 November 2014 Page 3 of 3 8:45 PM Hopkinton Mews, 0 Lumber Street DEP File No. 188-1558 Notice of Intent - continued Scott Goddard & Dan Wells, Goddard Consulting, LLC; Mark Allen, Allen Engineering A brief discussion was held regarding whether site plans dated 11 April 2014 with a final revision date of 12 November 2014 and drainage analysis report dated 18 August 2014 with a final revision date of 12 November 2014 were being submitted to the Commission for review under the Notice of Intent (NOI). Mr. Allen confirmed that the information was being submitted under the NOI for review. The Commission reviewed BETA’s e-mail dated 17 November 2014. The Commission reviewed Mr. Ingram’s memo dated 17 November 2014. Mr. Allen stated they will provide responses to Mr. Ingram’s memo. The Commission determined to have Mr. Ingram review the submitted site plans and drainage analysis report. The hearing was continued to 01 December 2014. 9:00 PM Commission Business – continued • The Commission reviewed a notice of project change for Metrowest Holdings LLC, 44 South Mill Street (188-1526) regarding the construction of a 10’ x 20’ deck within the approved limit of work. Mr. Waldron made a motion to determine the proposed deck to be an insignificant project change. The motion was seconded by Mr. Nation and it passed unanimously. • A discussion was held regarding any potential funding requests for FY’16. Minutes Approved: 01 December 2014
