HomeMy Public PortalAboutOrdinances-1969-62 ORDINANCE NUMBER 62 AN,ORDINANCE establishing rates, charges and rules for the use and service of the municipal water system of the Town of Tiffin, in Johnson County, Iowa. WHEREAS pursuant town election held in said Town on May 9, 1967, the Town of Tiffin, in Johnson County, Iowa, has been authorized to erect a municipal waterworks plant and system in and for said Town, and concurrent proceedings are being taken to authorize and, issue $10$,600 Waterworks Revenue Bonds of said Town to pay the cost of said waterworks; and WHEREAS 'in order to carry out this financing it is necessary that the rates and charges for the services and facilities to be furnished by and through said municipal waterworks be established as hereinafter provided; NOW, THEREFORE, Be It and It Is Hereby Ordained by the pit Town Council of the Town of Tiffin, Iowa, as follows : !' Section 1. That there shall be and there are hereby established rates and charges for the use of and for the service supplied by the municipal water system of the Town of Tiffin, based ' upon the meter readings of the amount of water consumed, as follows : 1! First 3,000 gal. or $6.00 per month ;q lesser amount per month (minimum monthly bill) Next 2,000 gal. $1.00 per 1,000 gal. Next 5,000 gal . $ .75 per 1,000 gal. Next 90,000 gal. $ .50 per 1,000 gal. All over v100,000 gal. $ . 4O per 1,000 gal. month } Section 2 . Bills for the rates and charges as herein established by the Town shall be sent monthly. All bills shall be payable on the first day of the month following the reading of, the meters and shall be paid at the office of the Town Clerk of the Town. If any charge for the services of the system shall not be paid by el 1 the 10th day of the month in which it shall become due and payable, a delayed payment charge of ten percent (10%) of the amount of the bill shall be added thereto and collected therewith. If any bills for the service of the water system shall remain unpaid after 10 days following the rendition of the bill therefor, the water supply for the lot, parcel of land, or premise affected shall be cut off and shall not be turned on again except on payment in full of the delinquent charges therefor, in addition to the payment of a charge of $10.00. Section Applications for water service shall be filed with the Town Clerk upon a form to be supplied by the Town. The application shall state the name of the applicant and the premises to be served. All applications filed after the commencement of the . 1 operation of the water system shall be accompanied by a fee of ;` , $100.00 4400u0a, payable to the Town Clerk of the Town, for the connection charge . Section 4+ . The rates and charges hereinbefore prescribed shall be assessed against each premises, tenement or other place served and shall be paid by the occupant of such premises, tenement or other place, but any such rates and charges which are not paid by the occupant shall continue to be an assessment against such premises, tenement or other place and shall be paid by the owner it of such premises-, tenement or other place . Said rates and charges shall be paid by all persons, corporations and other consumers, f;. 1 including said Town, and no free service shall be -supplied to any 4'1 premises, tenement or other place . A deposit of $12.00 shall' 'be tenants 'I required from all ammxpantx . Such deposit shall be applied to any bill for water service delinquent more than 30 days . Upon the dis- connection of the water service, any balance of such deposit shall be returned to the applicant without interest . (; 3 Section 5. It is hereby made the duty of the Town Clerk to render bills for water service and all other charges in connection therewith and to collect all moneys due therefrom. Section 6. All revenues and moneys derived from the operation of the water system shall be deposited in a separate and special account of said Town designated the "Waterworks Fund Account, ' created by the resolution adopted by the Town Council of said Town on Pe(',6-/V66e ) , 1969, authorizing the issuance of the Water- ,. works Revenue Bonds referred to in the preamble hereof, and credited and administered_ as therein provided. Section 7. The Town shall establish a proper system• of accounts and shall keep proper records, books and accounts in which { complete and correct entries shall be made of all transactions 1 relative to the water system and at regular annual intervals the a Town Council shall cause to be made an audit by an independent audit t , concern of the books to show. the receipts' and disbursements of the water system. Section any section 8. That if y , paragraph, clause or provision of this ordinance shall be to be invalid or ineffective for any reason, the remainder thereof shall remain in full force and effect, it being-expressly hereby found and declared that the remainder of this ordinance would have been adopted despite the invalidity of such section, paragraph, clause or provision. Section 2. That all ordinances, resolutions and orders or parts- thereof in conflict herewith are to the extent of such conflict hereby repealed, and that this ordinance shall take effect from and after its adoption and posting as provided by law. The meeting was called to order and there were present C. E. "Bill" Bream, , Mayor, in the chair and the following named Councilmen: T. Spivey, Fred Mode , Ned Allen, Dale Flansburg • Absent : lizame . Glenn Potter The Council took up for consideration and caused to be read in full Ordinance Number' 62 , entitled "An Ordinance establishing rates, charges and rules for the use and service of the municipal water system of the Town of Tiffin, in Johnson County, Iowa. " It was moved by Councilman Allen that the rules requiring ordinances to be read, in full for three separate days be -suspended and that said ordinance be now placed in its final adoption. The motion was seconded by Councilman Spivey , whereupon the Mayor put the question on the motion and; the roll being called, the following voted: Aye: Allen, Flansburq, Spivey, Moore _ - i Nay: None . Whereupon the Mayor declared the motion duly carried and said ordinance was placed on its final adoption. • Councilman Allen moved that said ordinance be adopted; seconded by Councilman Spivey and after due consideration thereof by the Council, the Mayor put the question on the motion for the passage and adoption of said ordinance; the roll being called, the following voted: Aye: Spivey, Allen, Moore, Flansburg Nay: None .
