HomeMy Public PortalAboutOrd. 0683ORDINANCE No. 683 AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDERING THE ACQUISI- TION FOR VEHICLE PARKING DISTRICT N0. 2 OF SAID CITY AND ESTABLISHING THE BOUNDARIES OF SAID DISTRICT. Wf~REAS, proceeding8 have been duly taken and a hearing duly held pursuant to notice duly given under the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, and no written protest was filed by the owners of one-hal£ of the area to be assessed for the proposed acquisition, and this City Council by resolution duly ad.opted., determined that the public convenience, interest, and necessity require the acquisition substantially as set forth in the report on file in the of£ice of the City Clerk, and that said project is feasible, and WHEREAS, on August 5, 7958, pursuant to the provisions of the Vehicle Parking District Act of 1943, as amended, this Council d.uly adopted Ordinance No. 679 of said city declaring the intention of this Council to form said d.istrict and to acquire the land.s pro- posed in petition on file in the office of the City Clerk, and fixing September 16, 1958 at 8 p.m, in the Council Chambers of this Council as the time and place for the hearing of protests and objections, and WHEREAS, said. ordinance No. 679 was d.uly published., posted., and. mailed as provided by said Act, and said hearing was duly held at the time and place so £ixed, and all interested. persons were given a full opportunity to be heard, and. WHEREAS, at said hearing there were no protests or objections, either written or oral, to any of the things proposed to be d.one, and said hearing has been d.uly concluded, and WHEREAS, this City Council has determined that written objections or protests to the thing set forth in said Ord.inance No. 679 of more than one-hal£ of the number of the area of the land included wi ject to assessment, and. has further -1- or things proposed to be d.one as have not been made by the owners oP parcels or of more than one-hal£ ~hin the proposed d.istrict and. sub- determined. that there has been no majority protest within the meaning of Section 2930 of the Streets and Highways Code of the State of California. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lynwood as follows: Section 1. That said. City Council fixes and d.etermines that the public interest and necessity require the acquisition d.es- cribed in said Ordinance No. 679 and. described below, and accord.ingly this City Council hereby orders the acquisition d.escribed in said Ordinanee No. 679, namely, the acquisition in fee simple for parking places of the following d.escribed property in the City of Lynwood., to wit: Lot 366, Tract 2551, as shown on map record.ed in Book 24, Pages 78, 79 & 80 of Maps, Records of Los Angeles County, California. Section 2. That the boundary of Vehicle Parking District No. 2 of the City of Lynwood. is hereby fixed and determined as follows: Beginning at the northwesterly corner of Lot 308 of Tract No. 2551 as shown on map recorded. in Book 24, Pages 78, 79 and 80 0£ Maps, Records of Los Angeles County, California, said point of beginning being on the easterly line of Long Beach Boulevard, 80 feet wid.e; thence southerly along said last described line to the southwesterly corner of Lot 380 of eaid. Tract No. 2551; thence easterly to the southeasterly corner of said Lot 380, said point being on the westerly line of the £irst alley easterly of Long Beach Boule- vard; thence northerly along said. last described line to the northeasterly corner of aforementioned Lot 308; thence westerly in a direct line to the point of beginning. Providing, however, that no lands within the parking d.istrict owned. by the United States, and. no streets, alleys, or highways therein, and. no property to be acquired for parking places in this proceed3ngs shall be assessed. to pay the cost and expenses of the action herein ord.ered, and any road or parcel of land. in any other public use -2- belonging to the State or to any county, city, district or to a public corporation, in use for the performance of a public function and lying within the exterior boundary of the parking district as above described, is not included in said district. Section 3. That this City Council hereby d.eclares that a Vehicle Parking District as above described and designated and numbered as Vehicle Parking District No. 2 of the City of Lynwood. has been duly formed. under the provisions of the Vehicle Parking District Act of 1g43, as amend.ed. Section 4. That the City Attorney of the City of Lynwood. is hereby directed to bring an action in the Superior Court of the State o£ California in and.for the County of Los Angeles, in the name of the City of Lynwood for the condemnation of the property necessary and proposed to be acquired as described. in said Ord3nance No. 679 and. hereinabove described; provid.ed, that this County may contract for the purchase of any of the said. land.s and. any part o£ said. land acquired by purchase or by gift need not be included in the condemnation action or if included therein, need not be cond.emned. except as otherwise pro- vided in said Vehicle Parking District Act of 1943, as amended. The condemnation action shall be filed.and. the condemnation action shall be filed.•and the condemnation proceedings taken substantially as pro- vid.ed. in the Street Opening Act of 1903 and particularly Chapters 7, 8, 9, and 10 thereof. Section 5. That the City Clerk shall certi£y to the adoption of this ordinance and shall cause this ordinance to be published once in the Lynwood Press, a newspaper published in the City of Lynwood.. Section 6. This ord.inance shall take effect upon the lapse of thirty days from the time of its final passage. First read at a regular meeting of the City Council o£ said.
