In future correspondence, please refer to this public records request by the above referenced numbers. Your request for "all documents which attorney Robert Sweetapple said that he had" fails to identify the public records that you seek with specificity such that the Town can adequately frame a response. As a courtesy, the Town has construed your request to seek all public records that attorney Robert Sweetapple possesses regarding Martin O'Boyle and his conduct at depositions. As you are well aware, the Town is involved in numerous lawsuits with Martin O'Boyle including state court public records suits, federal court actions brought by Mr. O'Byole and and a putative class action brought by the Town against Martin O'Boyle and various of his corporate entities. Your request thereby potentially encompasses internal communications and memoranda shared with the Town's attorneys in the course of ongoing litigation that would be exempt under Florida Statute 119.0171(1)(d)l until the conclusion of the litigation. To search for responsive documents, assess whether they constitute public records and determine if any exemption applies will require significant time and expense. The Town estimates 4 hours of administrative support at $36.39 per hour, 4 hours of administrative support at $50 per hour, and at least 2 hours of attorney support to search for responsive documents and review for exemptions related to ongoing litigation at $350.00 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (4 hours @ 36.39 = 145.56) — (.25 hours @36.39 = 9.10) + (4 hours @ 50.00 = 200.00) + (2 hours @ 350.00 = 700.00) = Deposit Due: $1,036.46 in cash or check. The Town of Gulf Stream is currently working on a large number of incoming public records requests.
