HomeMy Public PortalAboutOrd. 0679ORDINANCE N0. 679 AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, DECLARING THE INTENTION OF THE CITY COUNCIL OF SAID CITY TO FORM VEHICLE PARKING DISTRICT N0.2 OF THE CITY OF LYNWOOD, ~ID TO ACQUIRE L4~NDS FOR PARKING PLACES AS PROPOSED IN THE PETITION THERE- FOR, AND FIXING TIME i~ND PLACE FOR HEARING AND GIVING NOTICE THEREOF, WHEREAS, on or about April 25, Z958, petitions for the formation of a Vehicle Parking District entirely within the City of Lynwood under the provisions of the Vehicle Parking Act of 1943, as amend.ed, were filed in the office o£ the City Clerk, and said petitions were duly signed by the requisite number of qualified signers and. contained all the matters and things required by law and were in every respect sufficient, and WHEREAS, said. petitions were checked. by said City Clerk and he has made his certification to the effect that said petitions were signed. by the requisite number of quali£ied. signers and pre- sented said petitions to said. City Council, and. WHEREAS, proceedings have been duly taken and a hearing duly held pursuant to notices d.uly given under the Special Assessment Investigation, Limitation and. Majority Protest Act of 1931, as amendai, and no written protest has been filed by the owners of one-half of the area to be assessed for the proposed acquisition, and this City Council by resolution duly adopted, has determined that the public interest and. necessity require the acquisition substantially as set forth in the report on file in the office of the City Clerk and. that the said project is feasible, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lynwood as follows: Section l. That this City Council hereby find.s and declares that the public interest and necessity require the acquisition des- cribed in said petitions and that the property to be acquired as des- cribed. in said petitions and hereinafter d.escribed in this ordinance is necessary there£or, and this City Council hereby declares its -1- intention to form the Vehicle Parking District proposed in said petitions and. to acquire the lands proposed in said petitions. Section 2. That said. parking district shall be designated. as "Vehicle Parking District No. 2 of the City of Lynwood.," Section 3. That a general description of the exterior bound.ary of the proposed Vehicle Parking District and. the lands pro- posed to be assessed to pay the costs and. expenses of said acquisition is as follows: Beginning at the northwesterly corner of Lot 308 of Tract No. 2551 as shown on map recorded. in Book 24, Pages 78, 79 and 80 of Maps, Records o£ Los Angeles County, California, said point of beginning being on the easterly line of Long Beach Boulevard, 80 feet wide; thence southerly along said. last described line to the southwesterly corner of Lot 380 of said. Tract No. 2551; thence easterly to the southeasterly corner of said Lot 380, said point being on the westerly line of the first alley easterly of Long Beach Boule- vard.; thence northerly along said last d.escribed line to the northeasterly corner of aforementioned Lot 308; thence westerly in a direct line to the point of beginning. Section 4, That a general description of the land.s in the City of Lynwood to be acquired for parking places, which lands are to be acquired in fee simple, is as follows: Lot 366 of Tract No. 2551, as shown on map recorded in Book 24, pages 78, 79, and. 80 of Maps, Record.s of Los Angeles County, California, Section 5, That the total estimated cost and. expense of the proposed acquisition is the sum of $13,500,00. Section 6. That an assessment will be levied. as provided. in said Vehicle Parking Act, as amend.ed., upon all properties in the proposed. Vehicle Parking District, subject to assessment under said -2- Act, to pay the cost and expense of the said acquisition. The City of Lynwood. hereby agrees to pay the costs and expenses of paving said- parking places after completion of the acquisition, at no expense to the property owners. The estimated. cost of said paving is $2,000.00. Section 7. That serial bonds bearing interest at a rate not to exceed six per cent (6~) per annum shall be issued pursuant to the provisions o£ said Vehicle Parking District Act to represent assessments not paid. within thirty (30) days after d.ate o£ the recorda- tion of the assessment, the bonds shall extend. over a period. of nine (9) years from the second day of January next succeeding the next October 15th following their d.ate. Section 8. Notice 3s hereby given that the 16th day of September, 1958, at the hour of 8 p.m, is the d.ay and. hour, and the Council Chambers of the City of Lynwood and the City Hall in said city is the place for the hearing of protests or ob~ections by said City Council; that the report filed under the Special Assessment Investigation, Limitation and. Majority Protest Act of 1931, as amend.ed., on the acquisition above described. is on file in the office of the City Clerk at the City Hall in the City of Lynwood. and may be examined at his office. Section 9. That the City Clerk shall cause this ordinance to be published. once each week for two (2) successive weeks in the Lynwood Press, a newspaper published in the City of Lynwood, the first publication to be not less than thirty (30) days prior to the date fixed for the hearing of protests. The City Clerk shall also cause copies to be posted on all open streets within the proposed d.istrict in the time, form, and manner required by law. Section 10. That said City Clerk shall mail a copy of this ord.inance, postage prepaid, to each person to whom land in the pro- posed. assessment district is assessed as shown on the last equalized. assessment roll of the County of Los Angeles, at his address as shown upon said roll, and. to any person having a legal or equitable interest in any land. within said district whose name, address, and the description -3- of the land in which he is interested is on file in the office of the City Clerk. Section 11. That said Vehicle Parking District No. 2 of the City o£ Lynwood. is formed. under and pursuant to the provisions of the Vehicle Parking Act of 1943, as amended, and the acquisition of the land herein described. shall be und.er the provisions of said. Act. Section 12. This ord.inance shall take effect upon completion of the publication thereof. First read at a regular meeting of the City Council of said City held on the lst day of July, 1958, and finally adopted at a regular meeting of said Council held on the 5th d.ay of August, 1958 by the following vote: Ayes: Councilmen Compton, English, Finch, Pender, Summe rs .
