DATE: October 25, 2022 TIME: 7:00 p.m.
The regular meeting of the City Council of Riverdale, Iowa, will be conducted according to the following
order and actions will be considered on the items listed. The notice of this meeting is not considered
final until 24 hours prior to the meeting and may be further modified if 24 hours’ notice is impossible or
impractical for good cause.
In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state
laws, all public hearings and meetings held or sponsored by the City of Riverdale, Iowa, will be
accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact
City Hall at (563)355-2511 five days prior to the hearing or meeting to inform of their anticipated
attendance.
The requirement that an Ordinance be read three times before passage may be waived by council upon
an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this
process and be prepared to speak either for or against any ordinance at the time of the first reading.
Per Chapter 21 of the Iowa Code, more specifically described in sections 21.3 and 21.8, a member of the
Council may attend the meeting either in-person or by electronic means, as defined in said sections.

Per Iowa Code 21.7, this governmental body make and enforce reasonable rules for the conduct
of its meetings to assure meetings are orderly, and free from interference or interruption by
spectators.
The public is encouraged to provide and insights on the proposed agenda and other items of
concern. Public comment time is limited to three (3) minutes per speaker. Speakers will
introduce themselves, their topic(s) concern, and provide their address for the record. Public
comments do not need to be in support of proposed actions but are to be constructive and
respectful. A lack of decorum will result in the end of comment period and possible removal
from the meeting. All members of council, the public, and staff are encouraged to find ways to
effect positive change in their comments and their actions for the betterment of our community.

• Met with a Riverdale resident regarding proposed development in the Woods commercial property
area.
• Met with gWorks regarding online bill pay options.
• Talked with gWorks on asset management options.
• Met with Ted Nellesen at the Iowa Department of Management for a walkthrough of their website
regarding budget and annual reports.
• Attended final inspection walkthrough for the Bicentennial Park Emergency Access Route project.
• Met with Ann Lawler and Matt Schmidt from Scott Community College.
• Attended Joint Sewerage Technical Committee meeting.

ANNUAL EVALUATION OF FIELDCREST CREEK
MSA has performed their annual evaluation of Fieldcrest Creek and the potential for meandering or
scour to compromise the adjacent sanitary sewer. MSA is monitoring three areas of concern. For the
fiscal year 2022 – 2023, it is our opinion a Fieldcrest Creek Stabilization Project is not required.
KENSINGTON AT-GRADE CROSSING WITH CANADIAN PACIFIC RAILROAD
MSA determined the crossing does not conform to the guidelines of the American Association of State
Highway and Transportation Officials (AASHTO) or the American Railway Engineering and
Maintenance Association (AREMA). However, before the raising of the rails at this location, this
crossing still did not conform to these guidelines.
This crossing is traversable by the City’s emergency vehicles.

was raised is unusual and the City may have some ability to negotiate with the Canadian Pacifica
Railroad or the Iowa Department of Transportation.

MSA has put their proposed Professional Services Agreement on hold, pending the City’s efforts
to obtain additional land to possibly construct a cul-de-sac for Fenno Drive.

RESOLUTION 2022-76
RESOLUTION APPROVING MSA PROFESSIONAL SERVICES’ AGREEMENT
FOR REVIEW FOR WOODS ESTATES 3RD ADDITION DEDICATION OF
ROADWAYS AND UTILITIES
WHEREAS, the City of Riverdale, Iowa ("City") is a municipal corporation, organized and operating under
the laws of the State of Iowa; and,
WHEREAS, the public infrastructure located in the third phase of the Woods Estates of Riverdale housing
subdivision is complete and construction of homes in the phase is currently underway; and,
WHEREAS, it is in the interest of both Woods Construction (“Developer”) and the City to proceed with
the process of reviewing, inspecting, evaluating, accepting, and adopting the public improvements made
by the Developer in the third phase of its subdivision so that the stormwater, sewer, utility, and roadway
improvements can be managed and maintained by the City as part of its regular ongoing operations;
and,
WHEREAS, prior to accepting these public infrastructure improvements, the City’s engineer, MSA
Professional Services (“Engineer”) must review, evaluate, and actively manage the various component
parts that make up the public improvements so they can be conveyed to the City in good order and with
the required financial and quality guarantee; and,
WHEREAS, Engineer has provide a project proposal to provide the required services in the estimated
cost of up to $9,000; and,
WHEREAS, said Engineering costs of up to $9,000 are qualified costs that can be reimbursed by the tax
increment generated by the project and collected by the City; and,
WHEREAS, the funding source for this action is 125-520-6407 - TIF Engineering.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
THAT:
SECTION 1: The proposed Professional Services Agreement is approved, and the Mayor and Clerk are
authorized to execute the Agreement.
SECTION 2: Expenditures of no more than $9,000 are authorized to provide the professional services
outlined in the Engineer’s Agreement.

SECTION 3: The Clerk is directed to prepare documents for review by the Planning and Zoning
Commission so they can pass their recommendation on to City Council for acceptance of
the public infrastructure to be conveyed by the developer to the City once all the public
improvements are complete and judged to be in good order by both the Engineer and the
Planning and Zoning Commission.

RESOLUTION APPROVING A CREDIT CARD
FOR DEPUTY CLERK SABRYNA TRIPP
WHEREAS, the City of Riverdale, Iowa ("City") is a municipal corporation, organized and operating under
the laws of the State of Iowa; and,
WHEREAS, Sabryna Tripp began employment with the City of Riverdale on Monday, October 17, 2022, in
the role of Deputy Clerk; and,
WHEREAS, in the course of performing her regular duties, Sabryna requires a credit card issued against
the City’s bank; and,
WHEREAS, no actual monetary expenses will be incurred by this action; however, items charged to the
credit card will be allocated to various accounts.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
THAT:
SECTION 1: The Mayor and Clerk are authorized to execute paperwork with the City’s bank to issue a

WHEREAS, pursuant to the authority granted by section 372 of the Code of Iowa, Chapters 16, 17, 18, 19,
20, and 21, of the City Code, the City Council makes various appointments to its boards and commissions
as needed, and;
WHEREAS, the City has open seats on the Board of Adjustment, and;
WHEREAS, Amy Skinner has agreed to serve on the City's Board of Adjustment, and;
WHEREAS, the City wishes to appoint Amy Skinner, and;
WHEREAS, no actual monetary expenses will be incurred by this action.

WHEREAS, the City of Riverdale, Iowa ("City") is a municipal corporation, organized and operating under

WHEREAS, the City has established a Sewer/Utility Review Committee via Ordinance Chapter 96:
Sewer/Utilities Review Committee; and,
WHEREAS, Ordinance 96 stipulates one member of the Committee shall be a representative from Scott
Community College (“College”) for a renewable term of three years; and,
WHEREAS, Ann Lawler, President of the College, has volunteered to serve as the College’s
representative; and,
WHEREAS, the City wishes to appoint Ann Lawler to the Sewer/Utility Review Committee; and,
WHEREAS, no actual monetary expenses will be incurred by this action.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF RIVERDALE, IOWA, BY AMENDING SECTION 135.09 EXCAVATIONS
BE IT ENACTED by the City Council of the City of Riverdale, Iowa:
SECTION 1. Amended Section
Chapter 135 Street Use and Maintenance, Subsection 135.09 Excavations, of the Code of Ordinances of
the City of Riverdale, Iowa, is hereby repealed and replaced as follows:

Street Use and Maintenance
135.09 EXCAVATIONS.
No person shall dig, excavate or in any manner disturb any City-owned property (Property), to include
City parks, streets, parking areas, alleys, multi-use trails, levees, floodwalls, stormwater retention or
detention areas, utilities, or other rights-of-way and appurtenances, except in accordance with the
following:
1.Permit Required. No excavation shall be commenced without first obtaining a permit therefor. A
written application for such permit shall be filed with the City and shall contain the following:
A.An exact description of the Property, by lot and street number, in front of or along which it is
desired to excavate;
B.A statement of the purpose, for whom and by whom the excavation is to be made;
C.The person responsible for the refilling of said excavation and restoration of the Property to
preexisting grade and condition; and
D.Dates of commencement of the work and estimated completion.
2.Public Convenience. Property shall be altered in the manner which will cause the least inconvenience
to the public and allow the uninterrupted passage of water along and through the Property.
3.Barricades, Fencing and Lighting. Adequate barricades, fencing and warning lights meeting standards
specified by the City shall be so placed as to protect the public from hazard. Any costs incurred by
the City in providing or maintaining adequate barricades, fencing or warning lights shall be paid to
the City by the permit holder/property owner.

4.Bond Required. The applicant shall post with the City a penal bond in the minimum sum of one
thousand dollars ($1,000.00) issued by a surety company authorized to issue such bonds in the State.
The bond shall guarantee the permittee’s payment for any damage done to the Property, and
payment of all costs incurred by the City in the course of administration of this section. In lieu of a
surety bond, a cash deposit of one thousand dollars ($1,000.00) may be filed with the City, refundable
upon completion of the project and restoration of the Property to the City’s satisfaction.
5.Insurance Required. For the duration of a contract, the applicant must obtain and maintain
$500,000.00 public liability and property damage/auto insurance in the minimum amount of
$100,000.00 for each occurrence of property damage and $500,000.00 for each occurrence of
personal injury or bodily harm.
6.Restoration of Property. Property disturbed in the course of the work shall be restored to the
condition of the property prior to the commencement of the work, or in a manner satisfactory to the
City, at the expense of the permit holder/property owner.
7.Inspection. All work shall be subject to inspection by the City. Backfill shall not be deemed completed,
nor resurfacing of any Property begun, until such backfill is inspected and approved by the City. The
permit holder/property owner shall provide the City with notice at least twenty-four (24) hours prior
to the time when inspection of backfill is desired.
8.Completion by the City. Should any excavation of any Property be discontinued or left open and
unfinished for a period of twenty-four (24) hours after the approved completion date, or in the event
the work is improperly done, the City has the right to finish or correct the excavation work and charge
any expenses therefor to the permit holder/property owner.
9.Responsibility for Costs. All costs and expenses incident to the excavation shall be borne by the
permit holder and/or property owner. The permit holder and owner shall indemnify the City from any
loss or damage that may directly or indirectly be occasioned by such excavation.
10.Notification. At least forty-eight (48) hours prior to the commencement of the excavation, excluding
Saturdays, Sundays and legal holidays, the person performing the excavation shall contact the
Statewide Notification Center and provide the center with the information required under Section
480.4 of the Code of Iowa.
11.Permit Issued. Upon approval of the application and filing of bond and insurance certificate, a permit
shall be issued. A separate permit shall be required for each excavation.
12.Permit Exemptions. Property owners, in the usual course of maintenance and upkeep of their
properties, are exempt from the permit application requirement of this section. Utility companies are
exempt from the permit application requirement of this section. They shall, however, comply with all
other pertinent provisions, including bonding and insurance, which shall be submitted for approval
before any work commences.

SECTION 2. REPEALER. All ordinances or part of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged
invalid or unconstitutional such adjudication shall not affect the validity of the ordinances as a whole or
any section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage,
approval, and publication as provided by law.
