Mr. Romer left town and Judge Choate appointed Trustees to handle the operation of the hotel, however after May 1, 1962 the Trustees made no attempt to pay the water bills and when Mr. Webb threatened to have the water turned off, he was ad— vised by Judge Choate that he would be in contempt of court. Judge Choate closed the hotel on May 29, 1962 as it was operating in the red. Mr. Webb and Mr. Nadeau appeared at a hearing in Judge Choate's office as the Trustees were attempting to have the court rule that the $1,800.00 deposit be returned to them. Judge Choate ruled that the $1,800.00 deposit be retained by Bal Harbour 'Village and applied to the water account. However, it is the opinion of Mr. Anderson that the Trustees be held responsible for the $770.01 water charges incurred at the hotel during their tenure and accordingly, petitioned Judge Choate to force the Trustees to pay the $770.01 over and above the reduction of the entire $1,800.00. A hearing on this petition was held two weeks ago and Judge Choate said he would not rule then but defer ruling until he returns from vacation. Motion made by Mr. Faulkner to instruct the Village Attorney to pursue the matter to collect the money from the Trustees on the balance due the water department of $770.01. Motion seconded by Mr. Hart and unanimously approved. Mr. Faulkner made a motion that the meeting be adjourned, seconded by Mr. Hart and unanimously approved. ATTEST: Mayor ' Village Clerk COUNCIL MINUTES October 27, 1962 The Council of Bel Harbour Village met at 9:30 A.M. Saturday, October 27, 1962 at the Village Hall. Present: Messrs. Beatty, Hart, Kirkeby and White Absent: Mr. Faulkner Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. Upon motion of Mr. Hart, seconded by Mr. Beatty, the minutes of the previous meeting of September 29, 1962 were approved as submitted. In the absence of Mr. Fred Faulkner and Mrs. Beulah Butler, Trustees of Tri City Library, Mr. Webb advised the Council that it was their intention to recommend the appointment of Mary Wetterer as Alternate Trustee. Mr. Hart moved to appoint Miss Wetterer as Alternate Trustee to represent Bal Harbour Village. The motion was seconded by Mr. Kirkeby and unanimously voted. 138 Mr. Webb further reported that Bal Harbour Village has agreed to pay $1,000.00 as its share of operating expenses for the library with Surfside and Bay Harbor Islands each contributing $2,000,00 as their share. Mr. Beatty moved to allocate $1,000.00 for this purpose, seconded by Mr. Kirkeby and unanimously carried. Mrs. Sanella Cauchois and her attorney, Mr. Fred Ward, appeared before the Council with the request that due to the death of her husband, Mr. Jean Cauchois, the Certificate of Public Convenience and Necessity of the Bal Harbour Limousine Company issued to Mr. Jean Cauchois be transferred to Mrs. Sanella Cauchois, his widow. After discussion Mr. Beatty moved that on the advice of the Village Attorney and upon the recommendation of the Village Manager a temporary certificate be granted to Mrs. Cauchois until next March at which time a formal application for a Certificate of public Convenience and Necessity be made. The motion was seconded by Mr. Hart and unanimously approved. Mr. Kirkeby seconded the motion and it was unanimously approved. The following applications for Limousine Permits were then approved by the Council on motion of Mr. Hart, seconded by Mr. Beatty and unanimously carried. Bal Harbour Limousine Company, 3; William J. Prout, 2. Mr. J. Nudleman appeared before the Council regarding a limousine permit for the Red Top Sedan Service. Mr. Anderson informed the Council that although under state law the Red Top Sedan Service does not have to have a Certificate of Public Convenience and Necessity, Red Top had made application in 1962 and paid the $50.00 permit fee and desired to do the same for 1963. After discussion Mr. Hart moved to grant the application for the limousine permit by Red Top Sedan Service. The motion was seconded by Mr. Kirkeby and unanimously ap— proved. U Drive It applications by Checker Rent A Car for 5 cars and Morse Auto Rentals for 15 cars were considered by the Council. Mr. Beatty moved to accept the applications as presented. Mr. Hart seconded the motion and it was unanimously adopted. The Village Clerk then presented the application for a liquor license filed by Harbour Inn, pointing out that it was complete with the exception of Mr. E. Mori's fingerprints. Mr. Hart moved that the application of Harbour Inn for a liquor license be accepted subject to the receipt of Mr. Mori's fingerprints. Mr. Kirkeby seconded the motion and it was unanimously voted. Mr. Marion Butler appeared before the Council with the request that he be allowed to display a "For Sale" sign on Lot 13 O.F. Section for a 90 day period starting November 1, 1962. Mr. Kirkeby moved to permit the 90 day extension of time starting November 1, 1962. Mr. Hart seconded the motion and it was approved. October 27, 1962 139 A Resolution formulated by the Tri County League of Municipalities objecting to the Reapportionment Plan was presented to the Council. Mr. Anderson explained that the Reapportionment Plan would go before the Federal Courts if not approved by the voters on November 6th. He asked the Council to consider this fact before acting on the Resolution. After discussion Mr. Beatty moved to adopt RESOLUTION NO. 100 RESOLUTION OF BAI HARBOUR VILLAGE, FLORIDA URGING DEFEAT OF THE APPORTIONMENT MEASURE AT THE NOVEMBER 6, 1962, GENERAL ELECTION. Mr. Hart seconded the motion and it was unanimously approved. Mrs. Martin Pulcher, Mr. and Mrs. William Logan and Mr. Lockard Row appeared before the Council to request the Village to take some legal action regarding the effects of the dredging at the Interama site. Mr. Anderson explained that the Village could not become a party in a suit even though a taxpayer's property was being discolored and the odor most offensive. After discussion it was moved by Mr. Hart, seconded by Mr. Beatty and unanimously voted that the Village pass Resolution ##101, to be prepared by Mr. Anderson, expressing concern over the damage and annoyance being caused the Village tax— payers, a copy of which is to be sentto the Interama authorities. Mrs. Pulcher also requested the Village to notify the owner of the lot behind her property of the debris thereon and also requested him to remove the coconuts from the trees next to her pool enclosure. Mr. Webb said he would be happy to write Mr. Hawley a letter on this matter. Mr. Hart made a motion that the meeting be adjourned, seconded by Mr. Beatty and unanimously carried.
