HomeMy Public PortalAboutORD15928BILL NO. 2019-018 SPONSORED BY Councilman Hussey ORDINANCE NO. 15')„.-S AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A SANITARY SEWER EASEMENT OVER AND BETWEEN PROPERTIES ADDRESSED AS 1720 AND 1736 VIETH DRIVE, IN THE CITY OF JEFFERSON, MISSOURI. WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owners of 1720 and 1736 and the interlaying property on Vieth Drive in the City, have petitioned the City Council to vacate a sanitary sewer easement; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue the sanitary sewer easement for public use as described in Section 1 of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a sanitary sewer easement the area described as a portion of property addressed as 1720 and 1736 and the interlaying property on Vieth Drive in the City of Jefferson, Missouri and forever vacate the following described sanitary sewer easement in said City: An easement described in Book 235, Page 794 of the Cole County Recorder's Office, being part of the Southwest Quarter of the Southeast Quarter of Section 14, Township 44, Range 12, County of Cole, City of Jefferson, Missouri, more particularly described as a strip of land 10 feet wide, being 5 feet either side of and parallel to a centerline described as follows: From the southwest corner of the Southwest Quarter of the Southeast Quarter of said Section 14; thence North 4°29' West, along the quarter section line, 400.53 feet to the point of beginning for said centerline; thence North 76°58' East, 236.63 feet: thence North 14°28' East, 336.39 feet. Bearings are magnetic. Section 2. The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this ordinance, in the right-of-way vacated. Section 3. This Ordinance shall take effect and be in full force from and after its passage.
