HomeMy Public PortalAboutResolution 81-20041 1 RESOLUTION NO. 81 -2004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING THE PERFORMANCE OF STREET MAINTENANCE WORK, UPON REQUEST, PURSUANT TO THE GENERAL SERVICES AGREEMENT WHEREAS, the County of Los Angeles is willing to provide street maintenance work for the City of Temple City pursuant to the General Services Agreement between the City and the County; and WHEREAS, under the terms of said Agreement the City of Temple City wishes the County of Los Angeles to perform street maintenance.; upon request, within the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. This City Council does hereby request that the County of Los Angeles perform street maintenance work in the City of Temple City as may be specifically authorized by the City Manager or his designee. SECTION 2. Under the provisions of the Assumption of Liability Agreement between the City and the County of Los Angeles, this City shall indemnify, defend and hold harmless the County of Los Angeles, and its officers, agents and employees from any liability imposed for injury (as defined by Government Code Section 310.8) occurring by reason of any injury to persons or property caused by or due to the street maintenance work specified by the City and performed by the County of Los Angeles at the request of the City pursuant to this Resolution unless caused.by the negligent or wrongful act or omission of the County. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. ADOPTED and APPROVED this 7th day of July, 1981, ATTEST: ie Deputy City C I HEREBY CERTIFY that the foregoing.
