The Agenda Meeting of the Mayor and Council of the Borough of
Carteret, preceding the Regular Meeting, February 20, 1997, was
held on Thursday, February 13, 1997, 7:00 P.M., Municipal
CourtlPolice Facility, 230 Roosevelt Avenue, Carteret, New
Jersey.
The following were noted present:

Councilmember Bialowarczuk

Councilmember Failace was noted absent.
Also noted present was Borough Attorney Craig Coughlin.
Mailed to the Home News Tribune, The Star Ledger and posted on
the bulletin board on February 17,1997.
a. Patricia Holden - She said we have received $170,000.00 so far
from the Cranbury Contract. It is in our account. The next
$170,000.00 will be coming in June. A third allocation of the four
(4) is due in December and she requested in writing if they will
give to us sooner. When we contracted with the County to the
Home Fund, which is a source of funds that are Federally supplied
to subsidize Affordable Housing, and we used it to replace the
eleven (II) units Up the Hill. We signed an agreement when they
did our original plan saying that we would give them $220,000.00
in matched money after the Cranbury Program, to match the
Home Fund. They need to have it as a zero interest ten (10) year
loan for the Developer. No Grants to the Developer. That would
have to be in the hands of the County by mid September. They said
in reference to giving us the third, one hundred and seventy, sooner
than later, they said they had no objection to it, the money had to
be borrowed so they didn't think it would be a problem. If they
give up that money we could supply, out of each installment, a
resolution and a contract of$75,000.00, that we set aside out of the
$170,000 to equal what ever it comes out to be. It will be set aside
from the additional installments from the $370,000.00 that we have
right now because they will not be able to utilize that all by June,
when the new money will be coming in and we will not be able to
utilize all of that by December. This way we can meet our
obligation to the County of the $220,000.00, so she asked for a

resolution put in place to authorize the Mayor to enter into a
contract with the Developer that we distribute out of this
$170,000.00, in three allocations, that we will give to the contractor
in a ten (10) year zero interest loan payable at the end of ten (10)
years. She said out of the $680,000.00, $220,000.00 would be a
loan to the Developer and the rest should be available to the
homeowners.
Mayor Sica it will be the same way with the Readington money.
Pat Holden said the Readington funding is in very good stages of
approval . We already have the approval of the Middlesex County
Planning Board from last year and it should be going to C.O.A.H.
for final approval within the next sixty (60) days. We have a year
from that approval date for them to give us our first installment
which should be about $485,000.00, 20% of the money which we
will get in five (5) years. She said they have allocated out of that
and should it go through, the Council approved by resolution,
towards the end of last year, twenty-eight (28) units for the
Cardinal China Building. She said the total should be about
$700,000.00 which comes out of the two point three two million
which subsidizes those units and the rest at this particular moment
is open for homeowners. She said she is putting together a policies
and Procedures Manual for the Mayor and Council to review it
and give her an opinion on it and she will amend it accordingly,
meanwhile she needs to get this resolution in place so that she can
get a contract ready to show that we are going to payout of the
Cranbury allocation.
Councilmember Feingold asked what if aything would be the
consequences if the Council did not adopt such a resolution.
Pat Holden said it would be a problem because the Federal money
would be guaranteed by us, upon the approval if there is a need in
the Project Plan.
Mayor Sica said when we accept money from Cranbury,
Readington or Alexandria you have to show them that you are
doing something with this money. He then spoke about some of the
plans they had for the money.
Attorney Coughlin asked if we had already had the contract in
place before we asked the Mayor to sign it.
Pat Holden said you at least come up with the terms of the
contract. She explained some of the contract and said that
$220,000.00 is looking to be the number, $20,000.00 per unit for
eleven units.
Councilmember DuPont mentioned Mr. Raia and how he also did
Cardinal China.
Pat Holden told Councilmember DuPont that Carteret is
subsidizing Affordable Housing for needy Housing. It is free
money, not coming out of our pocket.
Councilmember DuPont said he didn't think it would be free, but it
had already been hashed out.
Councilmember Gutowski said after the $220,000.00 it leaves
$460,00.00 and then asked Pat Holden if anyone had approached
her about the new Senior Building.
Pat Holden said yes and that this would come out of the
Readington money or the next batch of money.
Mayor Sica said there is a certain criteria that we have established
that only so much money goes for Developers. We have a hundred
and ten applications right now for the four hundred and some
thousand dollars from the Cranbury money alone and along with
the Readington money they could probably give all those people
some kind of money. Ifwe do the other Senior Project that money
will have to come out of the next batch that they are negotiating
with two (2) other towns.
Pat Holden said she needs a resolution or a contract that will match
the resolution and then she told Attorney Coughlin he can review
the agreement. She then went on to discuss a Business Directory
that would show all of the town's business. There would be no
cost to the town at all. A man in Rahway would be printing it. up
for the town.
Councilmember Fazekas asked Pat Holden to look into a Chamber
of Commerce.
Pat said she had looked into it about two (2) years ago. She spoke
with the County. She said we mostly have Corporate not Retail,
but she will look into it again. She again asked for their approval
on the Business Directory. She said they could write up the
language.
Mayor Sica said okay.
Councilmember Fazekas asked Pat Holden if she goes through
with the Business Directory to make sure the Internet is specified
in there.
b) Borough Engineer - Parmar then spoke about the Chrome Area
for leakages and lor improper connections, that we are waiting for
Conrail's response for the Second Phase of the Hill Section Storm
System, and that the Applications for registering and Closure
Permits, required for underground tanks at new Sport & Recreation
Center, are ready and that a licensed company named Barco
Systems Inc. was contacted to empty these tanks for $7500.00. An
EPA J.D. is required before emptying the tanks. He also
commented for complete removal we may have to go to public

bidding as it will be more than the allowable amount without
bidding. He said the Electrical Code Inspector has submitted his
reports for the Pump Stations at Bergen and Hayward Ave. and
these are sent to the contractors for a price. They are making full
efforts to get more specific requirements on these since they are
still not very specific and they will be submitted as soon as
received. He went on to say the acquisition of the land is still
awaited for the Sabo Pump Station, but the DEP Permit for this is
expired, so after acquiring the land application they will be made
to reissue the permit and the same situation is for the elimination of
the Etheridge Pump Station.
Mayor Sica told the Council to make a motion to go into a Closed
Session to discuss Litigation.
Upon MMS&C by Councilmembers Fazekas and DuPont

was adopted. Upon individual roll call vote, Councilmembers
Bialowarczuk, DuPont, Fazekas, Feingold and Gutowski voted in
the affirmative. Councilmember Failace was noted absent.
At approximately 7:35 p.m., a Closed Session was held.
Upon MMS&C by Councilmembers Fazekas and DuPont this
meeting was reopened. Upon individual roll call vote
Councilmembers Bialowarczuk, DuPont, Fazekas, Feingold and
Gutowski voted in the affirmative. Councilmember Failace was
noted absent.
At approximately 8:05 p.m., this meeting was re-opened. Mayor
Sica was also noted absent.

MATTERS FOR DISCUSSION:
COUNCILMAN GUTOWSKI - Change to Notice of Bidders, Re:
Receipt of Bids. - Councilmember Gutowski said he would like
all the bids to be presented at the Council Meeting' at 7:00 or 7:30
p.m., accepted by the Borough Clerk, so we could get all the bids
here and straightened out and they won't be all over Borough Hall.
He said sometimes the bids go to Gloria in Purchasing.
After all present discussed this, Councilmember Fazekas said only
the Clerk will receive bids.
BARRY ALBIN ESQ. - Requesting additional appropriation,
$2077 .36 - Re: State vs. Connolly.
BUSINESS TO BE ADDED:
Councilmember Feingold complimented our Borough Attorney
saying he does a good job and works well with the Mayor and
Council.

Councilmember DuPont said we got a violation notice for the
Sports Facility. It was for sedimentation and they threatened to fine
us. There are a couple of minor things and we have to speak to Mr.
Parmar, our Engineer.
Councilmember Fazekas said in reference to 20 Cooke Avenue, he
thought that the Architect was going to do the layout for the
computer system. He has found a lot of purchases being made,
totaled up to about $20,000.00 and that is not including the ADA
Compliance. He said he wants to get a total amount of how much
they are going to spend and he thinks we all need to sit down and
discuss this. He set up a meeting for Wednesday with
Councilmember Bialowarczuk and the rest of the committee.
Councilmember Gutowski said we have a lot of contracts to be
negotiated and we need a negotiating committee. He would like it
to be the Mayor, Councilmember Failace and himself.
Upon MMS&C by Councilmembers Gutowski and Fazekas and
unanimous affirmative vote of the five (5) Council members
present, this meeting was adjourned at approximately 8:25 p.m.
