Ar7 .7" TRAFFIC ORDINANCE : AN ORDINANCE REGULATING THE USE OF THE STREETS , ALLEYS, HIGHWAYS BY VEHICLES OF ALL KINDS AND DESCRIBING PENALTIES FOR ,VIOLATIONS : BE IT ENACTED BY THE COUNCIL OF THE CITY OF TIFFIN, IOWA: SECTION 1. PURPOSE. The purpose of this ordinance is to regulate traffic and use of the streets of the City of Tiffin, Iowa, and to, provide for they enforcement of these regulations. SECTION 2. WORDS AND PHRASES. Where words and phrases used in this Ordinance are defined by the laws of Iowa, such definitions shall apply to this ordinance. • SECTION 3. POLICE ADMINISTRATION. The City Marshall and/or special police are hereby authorized to direct all traffic by voice and/or signalLin conformance with traffic laws. In the event of a fire :jor •-other emergency, the . marshal' or special police may direct traffic as conditions require notwithstanding provision of- traffic laws . SECTION 4. ACCIDENT INVESTIGATIONS. The City Marshall or special police shall investigate all traffic accidents and report his findings to the Mayor. If sufficient evidence of violation is found, proper action shall be taken against the violator. , w I SECTION 5. SPEED RESTRICTIONS . It shall be unlawful for any person to operate a` motor vehicle in excess of the following maximum allowable speeds : 25 miles per hour . throughout the city limits of the City of Tiffin, except for Highway #6 where the speed limit shall be 25 miles per hour, 45 miles per hour or 55 miles per hour, as posted. SECTION 6 . TRAFFIC CONTROL DEVICES . 1. Stop Sign: No driver of` a motor vehicle shall proceed through an- intersection marked by a stop sign before bringing the motor vehicle- to a complete stop before entering the intersection. 2. Other devices : The Mayor shall cause to be installed stop signs and other traffic control devices at those locations as determined by the Council. No driver of a motor vehicle shall disobey the instructions of any police officer directing traffic or any official traffic control device placed in • accordance of the direction of the Council. Traffic Control Devices : It shall be unlawful to willfully .remove, throw down, destrby or 'carry away, from any street, alley, avenue or bridge, any lamp, obstruction guard, traffic signal or other articles or things , or extinguish any lamp or other light, erected or placed thereon for the purpose of guarding or closing unsafe or dangerous places in said street, alley or bridge without the consent of the person in control thereof. SECTION 7. STOPPPING, STANDING, PARKING UPON TRAVELED PORTION OF CITY STREETS. It shall be unlawful for any person to stop, park or leave standing, any vehicle, whether attended or unattended on the traveled portion of a city street, unless in accordance with a traffic control device. rt SECTION 8. RECKLESS DRIVING. Any person who operates any vehicle in such, a manner as to indicate either- a 'willful or wanton disregard for safety of persons or property is guiltytof reckless driving. - SECTION 9. PENALTY. Anyone violating any -of the ( provisions of this ordinance shall upon conviction be subject to imprisonment not exceeding thirty days or a fine not exceeding $100. 00. SECTION 10. ARREST AND NOTICE TO APPEAR. Whenever a peace officer has reasonable cause to believe a person has violated any provisions of this ordinance, such officer may without arresting the person, prepare in duplicate a written summons to appear in court containing the name and address of such person, the operator or chauffeur's license number, if any, the registration number of his vehicle, the offense charged', the time, when and place where such person shall appear and if the offense charged be speeding; said summons shall also specify the speed at which said person is alleged to have° driven and the speed limit applicable within the district or location. The original copy of the summons shall be delivered to the violator and the duplicate shall be filed with the magistrate's court. SECTION 11. REPEALER. Any ordinances in conflict with .the ,provisions of this ordinance are hereby repealed. (: C P ' Traffic Ordinance (_ Page Three SECTION 12. SAVING CLAUSE. If any section, provision ' . or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, prbvision or part thereof not adjudged invalid or unconstitutional. SECTION 13 . WHEN EFFECTIVE. This ordinance shall be in effect after its final passage, approval and posting as provided by law.
