An Agenda Meeting of the Mayor and Council of the Borough of Carteret
preceding the Regular Meeting, March 6,1997, was held on February 27,
1997,7:00 P.M., Municipal Court! Police Facility, 230 Roosevelt Avenue,
Carteret, New Jersey.
The following were noted present:
Mayor Peter J. Sica
Councilmember Bialowarczuk

Noted absent was Councilmember Feingold and Borough Attorney Craig
Coughlin.
Mailed to the Home News Tribune, The Star Ledger and posted on the
bulletin board on February 21,1997.
At approximately 7:08 P.M. Borough Attorney Craig Coughlin was noted
present.

a) Mayor Peter J. Sica - for Borough Engineer- in the Chrome area there
are seven (7) major places where there is an infiltration of water. It is
okay if there is storm water going into sanitary, that is not against the
law. That will cost the Borough one hundred sixty thousand dollars ($
160,000.00) more this year to the MCVA. On six (6) different streets
the Mayor said he can calculate three hundred (300) gallons per
minute when we get a rain. That is eighteen thousand (18,000.00)
gallons an hour. If it rains for a couple of hours we will have major
influx down there. It has to be looked at to see what can be done.
Conrail is still reviewing the permit to put in the line along their tracts.
There are two (2) more quotes from Code Environmental and All-State
power Vac and one from Barco. The Borough Engineer is
recommending Barco. The Mayor said that it is up to the Council as to
who to award it to. The maximum amount for the operation is nine
thousand dollars ($9,000) and we have to get it pumped out before we
can dig it out. We might as well award it to Barco. In the recreation
center there is a drawing that was made by the Borough Engineer. On
the lower windows the Mayor said he wants guards put up to keep the
kids from breaking the windows. There is a quote from the contractor.
The Mayor said to hold off because maybe they could get the guards
for a lower price. The electrical inspector reviewed all the drawings in
that building and it was okay for BX cable. The electrical inspector
wanted to change it after all the work was done. It would cost us
eighty-eight hundred dollars ($88,00.00) to change it. We are not
going to do that. There is nothing wrong with BX cable unless he can
demonstrate to us why (inaudible). We're not going to change it. It
was his mistake.
Councilmember Failace wanted to know if there was a problem with
doing it or not.

DISCUSSION
Mayor Sica said he made the mistake let him eat it. The Mayor asked the
Borough Attorney if he spoke to (inaudible) concerning the property on
Passaic Street. They are going to give us the land for free. On Sabo Street
we have a pump station and we want to eliminate it and make it gravity
fed lines. We have to acquire some land from one of the industries in back
of Steiner Avenue. The name of the company is Gemini. They have agreed
to give us the property for free. It is (inaudible) land so nothing can be
built on it.

DISCUSSION
Councilmember Failace said if we're going to get the feasibility study and
we're talking about using the money in both areas. Why not Roosevelt
Avenue too?
Mayor Sica said it is going to be two (2)- or three (3) years before we can
even do it. We can't do anything until that road is in. No one is going to
give us any money or do anything down there until we get that road out of
there. We have a meeting with Mayor McGreevy, on the 14th. I'm already
scheduled to go down to the UEZ and tell them we want to use our money
to do the engineering, including the Woodbridge part. The money would
be reimbursed from Woodbridge, to us, so we can expedite the thing and
get it going.
Councilmember Failace said maybe they can give us some money back on
the water we sent them.
Councilmember Fazekas asked what street is the town center going to be
on. He asked if he could get Pat Holden to give him more information on
that. At the last UEZ meeting, the Mayor talked about the trucks and he
said that we would look into both Chrome and Pershing Avenue.
Mayor Sica said we are going to look in both areas. We have sketches
made for both areas already. There is no sense in spending money in the
Chrome area right now just to let it sit on the shelf for three (3) years. 2.
Councilmember Fazekas said whatever the cost; it is an additional cost
just to include that because it would be a lot less if it was included now
instead of later.
Mayor Sica said he doesn't see how it is going to be any less. Later on, if
you have an Industrial Road in there then you can plan accordingly. If not,
it is like stabbing in the dark.
Councilmember Fazekas said he knows we tried to do this center of town.
He just thought that Chrome should be considered.
Mayor Sica said nobody wants to do the Chrome area more then he does.
If we can get the trucks out of there then he thinks the important thing to
do is for the city to enter into some kind of project to buy one half of that
whole street. It is approximately 125 feet deep. If you buy one half of that
whole side you can widen that road and make it into a pedestrian mall type
of thing and still have houses on the other side. Weare never going to
have a downtown shopping area. No one shops in downtown areas
anymore.
Councilmember Fazekas said he wanted to talk to Pat Holden about it. He
said maybe he'll push the trucks a little more to get that street done.
Mayor Sica said that is no problem.
7. Approving Policy and Procedure Manual for Rehabilitation Program.
8.Amending Resolution for Dog Warden Services.
9.Award of Bid-Mobile Home Heating Units.
10.Authorizing Bicycle Sale.
11. Professional Services-Robert A. Hedesh, Esq. For legal services, not
to exceed $468.75 - Re: Fonesco vs. Borough of Carteret.
Councilmember Failace said he wants to know what the professional
services for Robert Hedesh are for. He asked if there was some paper
work that had to be done.
The Municipal Clerk said yes, although the paper work hasn't been taken
out yet.
12. Professional Services- Lerch, Vinci & Higgins for review of the
Sewer User Charge system, not to exceed $6,000.00.
13. Directing the Issuance of Various Raffle Licenses.
14. Directing the Issuance of Various Amusement Device Licenses.

l.Professional Service Resolution, Robert Hedesh, Esq. Re: Manella-
Tabled-2/20/97. This will discussed in Closed Session.
2.Recycling Department- Carmela Pogorzelski, Temporary appointment
expires 3/9/97.

Councilmember Failace said what if that was another year?
The Municipal Clerk said that would be making Carmela Pogorzelski
permanent.
Resolution for meeting.
3. Borough Engineer- Need to appoint Land Surveyor for 1997.
Mayor Sica said to tell them to recommend someone and then they will
discuss it.
4. Richard Greenberg- Requesting meeting with Mayor & Council.
Mayor Sica said to the Municipal Clerk to make that meeting one
day next week.
5.Genny Lavan-a) requesting step two on grievance dated 1/20/97.
b) Requesting Mayor & Council hear grievance dated 12131/96.
This will be discussed in Closed Session.
6.Afscme Local #3850-Requesting date to negotiate with committee.
The Borough Clerk said she can set up a date.
7. City of Perth Amboy- Letter asking for recommendations, Re:
Conrail.
Councilmember Failace said we will do it at 6:00 P.M. He also wanted to
know what that letter from Perth Amboy was about.
8.Robert A. Hedesh-a) Suggesting Borough introduce a resolution
requesting legislation granting municipalities immunity from payments of
legal fees if Attorney General or County Prosecutor initiates a complaint
and Grand Jury returns an indictment. b) Letter- personnel matter
regarding a Borough Employee. This will be discussed in Closed
Session.
Mayor Sica said he suggest that the Borough make a resolution. Send it to
every other town, maybe that will stop them from this silliness.

9.NJ Department of Personnel-Certification of Eligible for Appointment,
Deputy Municipal Court Administrator. One name on the list, Anthony
Abello. We have to put a resolution on to certify him.
10. Jessie Bagala-Personnel Matter.
Mayor Sica said that will be discussed in a Closed Session.
II.Coregis- a) Requesting payment for liabilty claim, $25,000.00-Re :
McClendon - the fire up the hill.
b.) Requesting payment of liability Re: Perlman -injury in Carteret Park
Mayor Sica said to the Borough Attorney Craig Coughlin to review them
and see if we have to pay.
12.Patrick DeBlasio- Proposed ordinance for Capital Improvements-
$20,000.00 for cherry picker repair & $20,000.00 for improvements to 20
Cooke Avenue.
Councilmember Failace asked if that was in excess of sixty-two thousand
dollars ($62,000.00) that we had set up for 20 Cooke Avenue?
Mayor Sica said no, that it is all part of it.
Councilmember Fazekas asked if Patrick DeBlasio got a price from the
architect for the firehouse.
Mayor Sica said yes he did.
Councilmember Fazekas asked if we would get anything for the ADA
compliance.
Mayor Sica asked him if he had anything on it.
Councilmember Fazekas said if we are going to let the Borough Engineer
look at it, the wall is separated from the floor and also the roof because it
is leaking.
Mayor Sica said when they built the firehouse he told them that would
happen and the same thing happened in the Municipal Building. He said
he would have the Borough Engineer look at it. The foundation went.
They put one hundred twenty pounds (120) of concrete in that foundation.
Councilmember Fazekas said it is starting to separate now. He doesn't
know if Parmar is going to look at that. Maybe the Borough Engineer can
look at it.
Mayor Sica said they are looking at a major problem. That wall has to be
tied back together to make it structurally safe.
Councilmember Fazekas said he also received a letter yesterday, it
concerns Carteret Park. They are trying to resurface the basketball court
and it also needs additional lighting.

Mayor Sica said he was going to bring that up too. He'll have Willie
Kolibas get some prices on it, get some ballpark figures for the paving
work and we will take it from there. Public Service will put up the lights
for free as long as we buy their electricity.
Councilmember Failace asked if they were going into Closed Session in
reference to the letter they received?

Mayor Sica said yes we are.
RESOLUTION # 97-77 was introduced by the Mayor and referred to the
Council for action.
Upon MMS&C by Councilmembers Failace and Fazekas
RESOLUTION #97-77
"RESOLUTION TO GO INTO CLOSED SESSION"
was adopted. Upon individual roll call vote, Councilmembers
Bialowarczuk, DuPont, Failace, Fazekas, and Gutowski voted in the
affirmative. Councilmember Feingold was noted absent.
At approximately 7:25 P.M. a Closed Session was held.
At approximately 8:56 P.M. upon MMS&C, by Councilmembers
Gutowski and Fazekas and unanimous affirmative vote of the five- (5)
members present, this meeting was opened to the public.
At approximately 8:57 P.M, upon MMS&C by Councilmembers DuPont
and Failace and unanimous affirmative vote of the five- (5) members
present, this meeting was adjourned.
