RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIDPENINSULA
REGIONAL OPEN SPACE DISTRICT COMMENDING FORMER ASSEMBLY-
MAN RICHARD HAYDEN FOR HIS ASSISTANCE TO THE MIDPENINSULA
REGIONAL OPEN SPACE DISTRICT AND THE ENVIRONMENT OF THE
STATE OF CALIFORNIA.
WHEREAS, former Assemblyman Richard Hayden has long
been a friend of the environment through his efforts to preserve
the open space lands of this District and the environmental quality
of the State of California, and
WHEREAS, Richard Hayden gave his strong public support
and assistance to the formation of the Midpeninsula Regional Open
Space District, and
WHEREAS, his continuing assistance included the intro-
duction of legislation (AB 2392) to provide initial funding for
the District, and the support of District--sponsored legislation
and programs, and
WHEREAS, Assemblyman Richard Hayden voted consistently
in favor of legislation benefitting the environment as a whole,
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE MIDPENINSULA
REGIONAL OPEN SPACE DISTRICT DOES RESOLVE TO commend and express
its appreciation to former Assemblyman Richard Hayden for his past and

SUBJECT: Backpack Camp at Monte Bello Open Space Preserve
Introduction: At your regular meeting of February 11, 1981 you
discussed the proposed Monte Bello Open Space Preserve backpack
camp as part of the discussion with the Hidden Villa representatives.
You directed staff to return at an early date with a recommendation
on the use of campstoves at the backpack camp.
Discussion: The Monte Bello Open Space Preserve Development Plan
contains a backpack camp area adjacent to the old Morrell cabin near
Black Mountain. As part of that camp concept, it had been intended
by staff that campstoves would be permitted.
The backpack camp element of the plan was presented to the City of
Palo Alto as part of the required project site and design review
process , and subsequently Palo Alto staff recommended that the
camp be conditioned by permit. Backpack camping and use of camp-
stoves in such an area is not specifically spelled out in Palo Alto' s
zoning ordinances, but is conceptually permitted under the recre-
ational uses allowed in the O/S zone.
Palo Alto staff has now indicated that to issue the camp use permit
will require a review by the Palo Alto Architectural Review Board.
We were led to believe that this step would not be needed, but
that the use permit was a staff administrative matter.
Recommendation: It is recommended that you concur with staff' s
recommendation to permit the use of campstoves within the designated
backpack camping area located near Black Mountain on the Monte Bello
Open Space Preserve.

SUBJECT: Land and Water Conservation Fund Grant Award -
Monte Bello Open Space Preserve
Introduction : The District has been awarded a $35,420 matching
Land and Water Conservation Fund grant for the development of the
Monte Bello Open Space Preserve. The project proposes development
of a parking area on the Monte Bello Preserve, construction of trails,
demolition of the cabin and cisterns, and development of a backpack
camp. Included in the project are provisions for associated signing,
fencing, water systems, and restroom facilities at both the back-
pack camp and the parking area.
Discussion: You have not yet given final approval of the Monte
Bello Open Space Preserve development plan. However, staff was
authorized to proceed with the engineering/design of the parking
area, demolition of the structures, and development of the back-
pack camp area. When the necessary engineering/design is completed,
staff will present the project to you with a request for approval
of the plan and authorization to proceed with development.
Meanwhile, the grant contracts must be signed and forwarded to the
State by March 13 , 1981. The District can execute the contract
agreements now and, at a future date, modify or even cancel the
project and not accept the grant. Cancellation of the project,
however, would put the District in a bad light with the State since
the grant was requested on the basis of needed funds for a vital
project, and the grant was awarded in a competitive process (not
all agencies ' requests were approved) .
In order to meet the grant schedule requirements and proceed with
currently authorized work, i.e. the demolition and backpack camp
elements of the plan , the District must execute the agreements.
Recommendation: It is recommended that the Board authorize the
General Manager to execute the necessary Monte Bello Open Space
Preserve development project agreements and authorize staff to
proceed with the approved elements of the plan, returning to the
Board with the total project when the designs have been completed.

SUBJECT: Acceptance of Existing Financing as a Condition of
Title - Long Ridge Open Space Preserve - (Smith Property)
Background: On January 28, 1981, you passed Resolution No. 81-5
accepting and approving a purchase contract for the subject
property (report R-81-6, dated January 28 , 1981) . After your
approval, staff attempted to close escrow in accordance with
the ratified purchase agreement. However, an existing First
Deed of Trust presented some difficulties as one of the
beneficiaries had died, and the estate has not been closed.
The notes secured by the Deed of Trust has a principle balance
of $7 ,000, payable at 7% interest per annum. The interest only
payment is due annually on each November 30th. The entire note
is due and payable on November 30, 1982 . In order to proceed
in a timely fashion, and with the advice of Legal Counsel, staff
authorized closing of escrow on March 4 , 1981 by taking subject
to this existing note and Deed of Trust.
Recommendation: It is recommended that you support the action
of staff in this matter by ratifying and confirming the accep-
tance of the existing note and Deed of Trust in the amount of
$7,000 at 7% interest per annum as a condition of title for the
subject Smith Property.

SUBJECT: Acceptance of Existing Financing as a Condition of Title -
Russian Ridge Open Space Preserve (Coplon Property)
Background: on February 11, 1981, you adopted Resolution No. 81-17
approving and accepting a purchase agreement for the subject property
(report R-81-8 , dated February 5 , 1981) . You also authorized staff
to attempt to renegotiate or assume the existing note and Deed of
Trust for the property. The beneficiary of the note has been un-
willing to renegotiate any of the terms; however, it is possible
for the District to take title subject to this financial obligation.
The remaining principle balance of the note is approximately $375,000
(the original amount was $490,000) . However, the exact balance will
not be known until just before the close of escrow. This indebted-
ness accrues interest at the rate of 9. 5% , and, although higher
than previous District notes, it is still within acceptable limits
given the current money market climate. This note would be fully
amortized over the next seven years or could be retired earlier
if appropriate, and would be in addition to the $400 ,000 in District
notes previously authorized by the Board as part of the purchase terms.
Recommendation: It is recommended that the Board authorize staff
to close escrow for this property subject to the existing note and
First Deed of Trust in the amount of approximately $375 ,000 at 9. 50
per annum.
Since the exact amount of the remaining principle is not known as
of the writing of this memorandum, a claim in the amount of $250 ,000,
the maximum amount required to close escrow, has been included as
item 1948 on the claims list. If the exact amount is known by
March 11, the amount of the claim will be changed for your approval.
However, if the amount is not known, staff is requesting that you
authorize an expenditure of no more than $250 ,000 with the pro-
vision that you will be notified of the final amount paid.

SUBJECT: Proposed Coastal Conservancy Grant Application
Introduction: The District has been invited to submit a grant
application for funds to construct a hiking/bicycle path along
levees in the 54 acre Stevens Creek Shoreline Nature Study Area.
This project would be part of the path system north of Moffett
Field, linking the District' s property to Mountain View' s Shore-
line Park, the Palo Alto flood basin area, and to the Dumbarton
Bridge (see attached map) . With work that is being done by
Sunnyvale and Santa Clara County, the development of this path
would leave only a section through Moffett Field still needed to
complete the South Bay Trail System identified by the County Path-
ways Planning Committee.
The City Council of Mountain View has recently approved a staff
request to submit a $150 ,000 grant application to the Coastal
Conservancy for a two-mile pathway through Shoreline Park. Since
this path would connect with the District' s path, Mountain View
and the District would make joint applications for an integrated
path project. mountain view has accepted the District' s offer to
assist in the preparation of an application for grant funds to be
used for the construction of paths in Shoreline Park.
Accordingly, District staff proposes to prepare two Coastal Con-
servancy grant applications : one for the District and one for the
City of Mountain View. Each application would reference the
other' s part of the project.
Coastal Conservancy staff has indicated the proposed integrated
project would have a very good chance for funding. Santa Clara
County is also applying for grant funds to construct a path on
City of Palo Alto property west of Shoreline Park which would
connect Shoreline Park with Palo Alto flood basin lands.

Project Description
We would propose to construct a pedestrian-bicycle path along
the top of existing levees through the Stevens Creek Shoreline
Nature Study Area (see attached map and site description) . We
also would propose the construction of a pedestrian-bicycle-patrol
bridge across Stevens Creek, to directly connect the District' s
path with the path through Shoreline Park. Users would otherwise
have to make a large detour to, the west to cross Stevens Creek
on the existing Crittenden Lane bridge. It appears that the
District' s portion (all covered by the grant) of the joint project
would be approximately $46 ,450. Of this amount, $32,000 would
be needed for the bridge, $10 ,000 for trail construction, and
$4 ,200 for first year operations and maintenance, and $250 for
design costs.
Recommendation: It is recommended that you adopt the attached
resolution approving the application for California Coastal Con-
servancy grant funds and authorize the General Manager to enter
into necessary grant contracts for the construction of a path
and bridge through Stevens Creek Shoreline Nature Study Area.

Descri2tion of the Site
1. Location and T ndaries
The property is bounded on the south and east by Moffett
Field Naval Air Stallion. Stevens Creek is adjacent to the
parcel on the west, and NounLain View Shoreline Regicnal
Park, a large regional park planned to facilitate boating,
golfing, picnicking, and hiking, bicycling and equestrian
trails, is westerly of Stevens Creek.
2. Description of the Environment
This parcel representspart of a once vast biotic community
that was associated with the original Bay margin. The
fresh water marsh area, which covers much of the property,
supports a large bird population and provides a rich habitat
for many small rodents, reptiles, amphibians, and insects.
A large variety of invertebrate species may also be found
in the water and mud.
The higher, drier, southern portion of this property supports
a small grassland area that is intolerant of salt. Distur-
bances of this vegetational community often lead to intrusion
by pickleweed.
Along the levee, which serves as the property' s western
boundary, a weedy, roadside vegetation that is typical of
disturbed areas is found.
3. Natural Resources.
A detailed biotic reconnaissance was not performed. However,
based on previous studies of the surrounding baylands, this
area serves as a vital refuge for a variety of wildlife
which may include endangered species, such as the clapper rail
and the salt marsh harvest mouse.
No historical/archeological assessment was made, although
several sites have been identified in the area.
As previously mentioned, this property had been part of I
)-arger holding from which salt bad been extracted by means
of solar evaporation. It is no longer part of the series of
ponds used for this evaporation process.
4. Existing Development and Restrictions
The property is tidal land., and there are no improvements
on the property. The property is separated from Stevens
Creek channel by a levee, and Leslie Salt Company levees
separate this property from existing salt ponds. The
property is partially separated by levees from the United
States Government ovmerships to the east and south. No
public utilities such as water, sewer, electricity, gas
and telephone are on the property at the present time. An
easement access to the property extends. from Stierlin Road,
down Crittenden Lane, across Stevens Creek channel and
then on top of the east Stevens Creek levee to the subject
property. Further, an avigation easement for the benefit
of the Moffett Field Naval Air Station is in existence
across the northeasterly corner of the property. Based on
the formula in the restriction, no building improvements
exceeding 10 feet in height at the southerly line nor 20
feet in height at the northerly line can be constructed
on the subject property.

RESOLUTION OF THE BOARD OF DIRECTORS OF THE
MIDPENINSULA REGIONAL OPEN SPACE DISTRICT
APPROVING THE APPLICATION FOR CALIFORNIA
COASTAL CONSERVANCY FUNDS - STEVENS CREEK
SHORELINE NATURE STUDY AREA PROJECT
WHEREAS, the California Coastal Conservancy is responsible
for the administration of the program within the State, setting
up necessary rules and procedures governing application by local
agencies under the program; and
WHEREAS, said adopted procedures established by the Coastal
Conservancy require the applicant to certify the approval of
applications prior to submission of said application to the
Department; and
WHEREAS, said application contains assurances that the
applicant must comply with;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors
of the Midpeninsula Regional Open Space District hereby:
1. Approves the filing of a Coastal Conservancy grant
application with the California Coastal Conservancy, and
2 . Certifies that said agency has the ability to implement
the project effectively and is able to provide continuing
operation and maintenance for the project, and
3. Appoints the General Manager as agent of the District
to conduct all negotiations, execute and submit all
documents including but not limited to applications,
agreements, amendments, billing statements , and so on
which may be necessary for the completion of the afore-
mentioned project.

Background: On November 4, 1980, California voters approved the
California Parklands Act of 1980 (Proposition 1) , authorizing
$285, 000, 000 in State bonds for the acquisition and development
of State and local park and recreation facilities. The District
Board of Directors supported passage of Proposition 1 by adoption
of Resolution No. 80-43 on October 22, 1980 (M-80-75, dated
October 6, 1980) . On December 12, 1980, the Board adopted Resolu-
tion No. 80-52 approving the priority plan for distribution of
Proposition 1 funds within the County of Santa Clara (M-80-102 , dated
December 12, 1980) . The District' s share of the Santa Clara County
allocation is expected to be $718 , 313.
On February 24, 1981, the San Mateo County Board of Supervisors
adopted Resolution No. 041932, approving a spending priority plan
for distribution of said funds within San Mateo County. This plan
included an allocation of only $62, 704 (3%) for the District. You
considered this matter on February 11, 1981 (R-81-9, dated February
6, 1981) and in accordance with your instructions, District staff
has solicited and received assurances from San Mateo County staff
that they will support a cooperative project with the District
to help compensate for the low distribution of Proposition 1 funds.
Now that the District allocation has been finalized for both counties,
it is timely to submit an application for these funds to assure a
place for a District project in the upcoming 1981/82 State Budget.
Description of the Project: The project proposes the purchase of
approximately 500 acres for open space within the Skyline Scenic/
Recreation Corridor in the vicinity of Skyline Blvd. in San Mateo
and Santa Clara Counties and approximately 293 acres for open space
near the junction of Edgewood Road and Highway 280 in San Mateo
County (Hassler Property) . These acquisitions will preserve the
existing natural conditions and viewshed, and provide opportunities
for hiking and equestrian trails and nature study areas to be
operated by the District and other local city, county and State
agencies . The lands will be preserved in perpetuity as open space.

Skyline Boulevard, State Highway 35, is a State Scenic Highway.
Also, both San Mateo and Santa Clara Counties have designated a
scenic/reacreation corridor along Skyline Boulevard. These two
counties, at least three cities, and the District are all affected
by this land acquisition project. The project is consistent with both
the open space conservation element and the trails element of the
General Plans of these agencies . The project is also consistent
with the Skyline Scenic/Recreation route included in the State
Plan.
Recommendation: It is recommended that the Board adopt the
attached resolution approving the application for 1980 State
grant moneys (Skyline Recreation/Open Space Corridor - Hassler
Project) and appointing the General Manager as agent of the
District to complete the project.

RESOLUTION OF THE BOARD OF DIRECTORS OF THE
MIDPENINSULA REGIONAL OPEN SPACE DISTRICT
APPROVING THE APPLICATION FOR 1980 STATE
GRANT MONEYS (SKYLINE RECREATION/OPEN SPACE
CORRIDOR - HASSLER PROJECT)
WHEREAS, the people of the State of California have
enacted the California Parklands Act of 1980 which provides
funds to the State of California and its political subdivisions
for acquiring lands and for developing facilities for public
recreation and historical purposes; and
WHEREAS, the State Department of Parks and Recreation
has been delegated the responsibility for the administration
of the program within the State, setting up necessary pro-
cedures governing application by local agencies under the
program; and
WHEREAS, said procedures established by the State
Department of Parks and Recreation require the applicant to
certify by resolution the approval of applications prior to
submission of said applications to the State; and
WHEREAS, said applications contain assurances that the
applicant must comply with, and
WHEREAS, the applicant agency will enter into an agree-
ment with the State of California for the acquisition and/or
development of the project;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors
of the Midpeninsula Regional Open Space District hereby:
1. Approves the filing of an application for 1980
State grant assistance for the Skyline Recreation/Open Space
Corridor - Hassler Project; and
2. Certifies that said agency understands the assurances
and certification in the application; and
3. Certifies that said agency has or will have sufficient
funds to operate and maintain the project; and
4. Certifies that said agency has reviewed and under-
stands the General Provisions contained in the sample State/
local agreement; and
5. Appoints the General Manager as agent of the District
to conduct all negotiations, execute and submit all documents
including but not limited to applications , agreements, amendments,
payment requests, and so on which may be necessary for the comple-
tion of the aforementioned project.

aims. In addition to scheduling a Special Meeting for April 11,
you requested that representatives from the Golden Gate Council
make a formal presentation to the Board in March.
Mr. Bert Schwarzchild, Executive Director of American Youth
Hostels, Inc. - Golden Gate Council, and two members of the
Council ' s Board of Directors will present an informational report
and distribute materials at your March 11 meeting on the purposes
and functions of their organization. This presentation should
provide necessary background information for your Special Meeting
of Saturday, April 11, 1981.

Dear Board ,Members:
I am attaching legislation proposed by the Mid-Peninsula Regional Open Space
District for which they have requested our support. You will note from the
attached material that since their first contact with us on December 31 , 1981 ,
they have made certain changes described in the second attachment.
In general the proposals are housekeeping items affecting various sections of
the State enabling legislation under which our Districts operate. The changes
would affect such things as: 5531-32, phases of the directors' elections ;
5540, some phases of conveyance of real property; 5544. 1 , promisory notes and
indebtedness of districts ; 5544.2, districts powers to employ assessment
district procedures.
None of the changes would affect our district in a direct way at this time,
and none of them appear to ever create problems for us. We have also checked
this legislation through County Counsel and we both recommend that your Board
indicate your support of this legislation.
RECOMMENDATION
It is, therefore, recommended that your Board support this legislation as
outlined in the attachments.

On behalf of the Board of Directors of the Mid-
peninsula Regional Open Space District, I want to urge
the Board of Supervisors of Santa Clara County to express
their support for the acquisition of the 48 , 000 acre Gill
Mustang Ranch by the State 's Department of Parks and
Recreation. This acquisition, which would become an ad-
dition to Henry Coe State Park , would provide an additional
recreation resource for the citizens of Santa Clara County,
as well as the entire Bay Area.
As gasoline costs continue to rise, the need to
provide more "close-to-home" recreational areas becomes
essential. The addition of Gill Mustang Ranch to Henry
Coe State Park will allow more citizens to enjoy the wilder-
ness camping experience without having to travel hundreds
of expensive gas miles to reach their destination.
