HomeMy Public PortalAbout1997/04/10 An Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting of April 17, 1997, was held on April 10, 1997, 7:00 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: Mayor Peter J. Sica Councilmember Deborah Bialowarczuk " John DuPont " James Failace " Jack Fazekas " William Feingold " Stanley Gutowski Also noted present was Borough Attorney Craig Coughlin. Statement of meeting notice was mailed to The Homes News Tribune, The Star Ledger and posted on the bulletin board on April 4, 1997. To Address the Governing Body: Borough Engineer, Pratap Parmar Engineering- Recreation Center The contents of all the ftont underground tanks have been pumped out and the contents have been disposed of per EP A regulations. The contents had to be lab-tested on an emergency basis at a cost of $650.00. Grills over the windows have been installed and other progress on electrical, tiles, HV AC is well on the way. The contractor has been given credit for a change in the roof design which causes a credit change order to Abbott Construction in the amount of $28,750.00. Tax Maps There is a need for a licensed surveyor for yearly updates on the tax maps. A request for Borrie McDonald Watson in the amount of not to exceed $5000.00 is needed. Industrial Highway There is a need for survey work for Industrial Highway, which is required on a DOT funded job in the amount not to exceed $3000.00 to APRIL 10, 1997 AGENDA MEETING PRESENT STATEMENT OF MEETING NOTICE TO ADDRESS GOVERNING BODY- BOROUGH ENGINEER RIL 10, 1997 )ROUGH ENGINEER ~ontinued) John Cilo. Mr. Cilo's company has done the work economically and satisfactory. West Carteret The manhole study was done as reported a recommendation to reduce the contract for this work in the amount of $237,780.00. The cost of repairs to the pipes is being negotiated with Marvec. The increase would be within reason. Underground Tanks The closure permit for removing the underground tanks at the Recreation Center is needed ftom the DEP. Mayor Sica asked Mr. Parmar to check the walls at the Firehouse before fixing the roof since it has separated three inches. He said he would show him. RESOLUTION: RESOLUTIONS 1. Cancellation & Refund of Taxes. 2. Authorizing Mayor to Execute Amendment to Sr. Citizen Home Safely Inspection Program Agreement. 3. Authorizing Mayor to Execute Office on Aging Agreement for 1997. 4. Approving ABC Renewal- Sail Inn. 5. Approving ABC Transfer- F. Melnizek to Giordano. 6. Approving Settlement- United Bulk Carriers vs. Borough of Carteret. 7. Approving ABC Transfer- B & B Lounge. 2 COMMUNICATIONS: 1. Township of Piscataway, Borough of South River & Twp. of Middletown-Resolutions opposing proposed dredge disposal site. 2. Borough of South River- Resolution urging legislation supporting reimbursement for totally disabled veterans' property tax exemptions. 3. Township of Piscataway-a) Resolution against state & other agencies diverting monies previously allocated to Rte. #18. expansion & other MC projects to a casino-related project in Atlantic City. b) Resolution authorizing application to DCA for funding of feasibility study for shared services with Boroughs of Middlesex and Dunellen. 4. Borough of Jamesburg-Resolution supporting use of property taxes for school funding in 1996-1997 & to impose a deadline for legislature to provide new method of financing education and the distribution of school aid. REPORTS: 1. Inspection of Buildings- March 1997. MATTERS FOR DISCUSSION: 1. State Board of Professional Engineers-asking for name of Borough's licensed land surveyor. Borough Clerk Barney said Borough Engineer Parmar spoke about this in his report. This is on hold. Mayor Sica spoke about the $5,000.00 being too much money since they did not have to change that much on the maps. He didn't want to tie up that much money. 2. Planning Board- Vacancy, Term to expire 12/31/00. Borough Clerk Barney said that is Richard Long's spot. 3. J. Lombardi-Volunteer Fireman. Payment of bill. Borough Clerk Barney said that was the bill they spoke about before. She said it was not a liability or a comp and spoke to Borough Attorney Coughlin about this. She said he was the only one who got sick at the picnic. Mayor Sica said if the insurance company would not pay it the Borough wouldn't pay either. 3 APRIL 10, 1997 COMMUNICATIONS REPORTS MATTERS FOR DISCUSSION RIL 10, 1997 .TTERS FOR :SCUSSION :ontinued) 4. NJ DOP-Notice of Promotional Examination-Omnibus Operator. The Council does not want a test. 5. AJV Engineering- a) Requesting authorization for additional professional services not to exceed $15,000.00- Re: Waterftont Project. Mayor Sica said put it on, he would try to negotiate this down. b) Requesting professional services resolution for tank removal at Sports Facility, $4400.00. Borough Attorney Coughlin said there is no conflict in the Mayor doing the job, but if something happens, there could be a lawsuit. Mayor Sica said he would check to see if a licensed person has to do this work and if not he would dig the tanks out and it would not take him forty hours. 6. Ralph DeFrancesco- a) Requesting amendment to ordinance, Re: Construction Permit Fee Schedule. Mayor Sica said Mr. DeFrancesco wants to modify this and said he had no problem with that. b) Rejection of fee waiver by Code Enforcing Agency. Mayor Sica said the contractor bid the job and no he wants the Borough to waive the fee. He said other contractors would say we waived the fee for that company, they should waive it for all. Borough Attorney Coughlin said if the town was going to pay the fee it should be reflected in the bid specs. Mayor Sica said he did not know if this was in the bid specs. Borough Attorney Coughlin said if it was not in the bid specs the Borough would not pay the fee directly and the contractor is not exempt. Mayor Sica said on this job they can not do it but felt in the future the Borough could do it providing it is stated in the specifications that all fees would be waived. He said we would still pay for it whether it was directly or indirectly. 7. Beverly Hedesh-Requesting the removal & replacement of2 members ofthe Recreation Commission. Borough Attorney Coughlin said this would be for Closed Session. 4 8. Purchasing Agent-Asking if Governing Body wants to re-bid Monumental Staircase Renovation. Mayor Sica said he felt they should not re-bid this and felt they should change the design. He spoke about different ideas. 9. Captain Barany- Asking for amendment to code, Re: Detention Facilities. Borough Clerk Barney said we need an Ordinance on this. 10. Association for Retarded Citizens- Request for bus. Mayor Sica said this would be okay. 11. Carteret Board of Health- Requesting Borough Engineer look into possibility of procuring funds for sewer replacements. Mayor Failace said take it off. 12. Pat Holden- Requesting direction on Industrial Road expansion project. Councilmember Fazekas asked if Woodbridge turned us down on this agam. Mayor Sica said she is saying what the engineering costs would be to Carteret. He explained what UEZ funds would cover and what the town would be responsible for. Councilmember Fazekas asked if Carteret was lending Woodbridge money to do this. Borough Attorney Coughlin said we are not lending anyone anything Carteret is paying for the engineering costs and Woodbridge would reimburse Carteret for their portion. He said we need an agreement to do that. Mayor Sica said we have to get this done, the next move would be to make sure this was okay with Trenton and then go to the County to see how much they would be putting in towards this. 13. John Spoganetz, Esq.- Request ftom resident to purchase Borough-owned property on Essex Street. Auto Parts of Woodbridge- Complaint of excessive Zoning Board fees. Mayor Sica spoke about the difference in fees for a homeowner and a business. He suggested Borough Attorney Coughlin send them a letter. 15. Job Posting- Assistant Violations Clerk position must be posted for 30 days. Vacancy will occur June 1, 1997. Borough Clerk Barney said she would post it. 16. Mary Bell-Denied handicapped parking space because of driveway. Asking to be reconsidered. Mayor Sica said under the law, if someone has a driveway they could not have a handicapped space. 17. Donald Nelson-Former volunteer fireman asking for reimbursement oflegal fees. Borough Clerk Barney said they said no to this before and suggested Borough Attorney Coughlin send him a letter. 18. Joseph P. Schiappa, Esq.- a) Request for refund of fees paid by Zoning Board applicant. Mayor Sica said it appears the Building Department made a mistake, they should not have been charged. He said we have to put this on and give it back to Mr. Schiappa. b) Need Notice of motion to get 1988 Council Meeting tapes released, Re: Abazia case. Borough Clerk Barney said the judge has them since 1988 and she can not get them back. Mayor Sica spoke about why he felt they still had the tapes and the mistakes the Mayor and Council did at the time concerning the bids. He said the Borough sued the two insurance companies and won but the tapes were still there since this became a big deal. He said make a Resolution to get the tapes back. 19. Teamsters Local #97-Asking for shop steward to attend seminar without loss of pay. Mayor Sica said this is denied, it can not be done. 6 20. Ptl. Mickley- Request for Robert Goodman, Esq. for legal defense. Mayor Sica suggested Borough Attorney Coughlin call Mr. Goodman to find out the information on this. 21. County Engineer-Intersection of Washington Avenue and Holmes St. improvement cost payment request. Mayor Sica said this project was proposed years ago and if something has changed we should not have to suffer because they did not get the job done. He suggested we send them a letter. Borough Attorney Coughlin said we could make an argument since there is a clause in the contract that reads if they fail to complete the job in a reasonable amount of time. He said the contract was since September of 1990. Mayor Sica suggested Borough Attorney Coughlin send a strong letter stating we are not going to go on forever. He spoke about the problems with this job, complexion of the town changing since then and spoke about Phase I and the money. BUSINESS TO BE ADDED: Councilmember Fazekas said he had something for Closed Session. Borough Engineer Parmar said he wanted the Change Order credit to be $25,700.00. Mayor Sica told Borough Clerk Barney to change it. RESOLUTION #97-129 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Failace and Fazekas RESOLUTION #97-129 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas and Gutowski voted in the affirmative. Councilmember Feingold was noted absent.
