The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting, April 17, 1997, was held
on April 10, 1997, 7:00 P.M., Council Office, Borough Hall, 61
Cooke Avenue, Carteret, New Jersey.
The following were noted present:
Mayor Peter J. Sica
Councilmember Bialowarczuk

Also noted present was Borough Attorney Craig Coughlin.
Mailed to The Home News & Tribune, The Star Ledger and posted
on the bulletin board on April 4, 1997.
a) Borough Engineer.
Parmar then spoke:
I. He gave a report on the tanks at the Recreation Center that they
have been pumped out and the contents have been disposed of as
per EPA regulations.
2. He said the grills over the windows at the Recreation Center
have been installed.
3. A credit change order for Abbott Contractors approval IS
requested for $28,750.00 for change of roof.
4. There is a need for a licensed surveyor for the year! y updating of
the Tax Maps for a not to exceed amount of $5000.00 for Barrie,
McDonald Watson.
5. Survey work for the Industrial Highway for the D.O.T. funded
job is required for a not to exceed amount of $3000.00 for John
Cilo.

Beverly Hedesh - Requesting the removal & replacement of two
(2) members of the Recreation Commission. Attorney Coughlin
said to discuss this in Closed Session.
Purchasing Agent - Asking if Governing Body wants to re-bid
Monumental Staircase Renovation. Mayor Sica said he didn't think
we should re-bid it, we should just change the design.
Captain Barany - Asking for amendment to code, Re: Detention
Facilities. Mayor Sica said they have to do it. The Clerk said we
have to do an ordinance on this.
Association for Retarded Citizens - Request for bus. The Clerk
said only one (I) bus is needed for local use. The Governing Body
okayed this.
Carteret Board of Health - Requesting Borough Engineer look into
possibility of procuring funds for sewer replacements. This was
taken off.
Pat Holden - Requesting direction on Industrial Road Expansion
Project. Mayor Sica said Pat Holden is explaining what the cost of
this would be. He said we would be paying the Engineering costs
and then Woodbridge would reimburse us for their portion of it.
Attorney Coughlin said we would need to have an agreement for
that.
Mayor Sica said we do. He said Pat Holden said the UEZ would
allow us 48% of the money and we still have to put in the rest.
John Spoganetz, Esq. - Request from resident to purchase Borough
owned property on Essex Street. Mayor Sica said he wanted to see
what it is for first.
Auto Parts of Woodbridge - Complaint of excessive Zoning Board
Fees. Mayor Sica said they set up a business, they are not just a
homeowner, so that makes a big difference. Attorney Coughlin
said he will send him a letter.
Job Posting _ Asst. Violations Clerk position must be posted for 30
days. Vacancy will occur June I, 1997.
Mary Bell _ Denied Handicapped Parking Space because of
driveway. Asking to be reconsidered. Mayor Sica said under the
law she has a driveway so she can't get a Handicapped Space.
Donald Nelson _ Former Volunteer Fireman asking for
reimbursement of legal fees. The Clerk said this had been
discussed a few times already and Mayor Sica said it had been
denied every time and it still would be denied. The Clerk suggested
she would get Attorney Coughlin to write him a nice letter.

Joseph P. Schiappa Esq. - Request for refund of fees paid by
Zoning Board Applicant. Mayor Sica said it appears that the
Building Department made some kind of mistake. They didn't
have to file for this and they did so it has to be given back. b) Need
Notice of motion to get 1988 Council Meeting tapes released, Re:
Abazia Case. Mayor Sica spoke about the case shortly and said
they made a motion to get them back.
Teamsters Local #97 - Asking for Shop Stewart to attend seminar
without loss of pay. Mayor Sica said we cannot do that, it is
denied.
Ptl. Mickley - Request for Robert Goodman, Esq. for legal
defense. Mayor Sica said to Attorney Coughlin to call Robert
Goodman and make sure he is doing it for the numbers in the
ordinance or no way.
County Engineer - Intersection of Washington Ave. & Holmes
Street improvement cost payment request. Mayor Sica said the
County is saying that we are not going to do that job, we are going
to pay for the engineering.
Council member Failace asked if there is a statute of limitations.
Mayor Sica said that was his argument and he argued with the
County over it. He said this project was proposed years ago and
they didn't do diligence and get the job done. In the interim it
changed. He questioned why we should suffer the circumstances
when they didn't do their job.
Attorney Coughlin said he looked at the contract and he thinks it
would be interesting to take the position that we could make an
argument that there was a sufficient amount of time. In that event
we are entitled to our costs if we have any.
Mayor Sica told Attorney CoughEn to write a strong letter because
they didn't do diEgence and we can't go on forever. He
commented when they proposed this back in the eighties it was a
good proposal.
BUSINESS TO BE ADDED:
At approximately 7:44 p.m. Councilmember Feingold was noted
absent.
RESOLUTION #97-129 was introduced by the Mayor and referred
to the Council for action.

Upon MMS&C by Councilmembers Failace and Fazekas
RESOLUTION #97-129
"RESOLUTION TO GO INTO CLOSED SESSION"
was adopted. Upon individual roll call vote Councilmernbers
Bialowarczuk, DuPont, Failace, Fazekas and Gutowski voted in
the affirmative. Councilmember Feingold was noted absent.
At approxirnately 7:45 p.m. this meeting was closed.
Upon MMS&C by Councilmembers Failace and Fazekas and
unanimous affirmative vote of the five (5) Councilmembers
present, this meeting was opened at approximately 8:05 p.m.
Upon MMS&C by Councilmembers Fazekas and Failace and
unanimous affirmative vote of the five (5) Councilmembers
present this meeting, after no further discussion, was adjourned at
approximately 8:06 p.m.

6. He recommends to reduce the contract for the work for the
study of M.Ms in West Carteret for $237,780.00. The cost of the
repairs to the pipes are being negotiated with Marvec.
7. He said the Closure Permit for the removing of the U.G. Tanks
at the Recreation Center is awaited from the D.E.P.

said they got the paperwork in that they needed and everything is
okay with the State and the Division of Taxation.
Approving Settlement _ United Bulk Carriers vs. Borough of
Carteret.
Approving ABC Transfer - B&B Lounge.
Twp. Of piscataway, Borough of South River & Twp. Of
Middletown _ Resolutions opposing proposed dredge disposal site.
Borough of South River - Resolution urging legislation supporting
reimbursement for totally disabled veterans property tax
exemptions.
Twp. Of Piscataway - a) Resolution against state and other
agencies diverting monies previously allocated to Rte. #18
expansion & other MC projects to a casino related project in
Atlantic City.
b) Resolution authorizing application To DCA for funding of
feasibility study for shared services with Boroughs of
Middlesex and Dunellen.
