Other attendees:Sue Leven,Attorney Stephen Jones, Philip Scholomiti, Ryder&Wilcox, Keith Fernandez,J.M.O'Reilly&Associates, Chris Miller, Natural Resource Director and Ann Kitchell&Grace Camberari, Horsley Witten Group. The Chair read the Recording Notification: "As required by the Open Meeting Law we are informing you that the Town will be videotaping this public meeting. In addition,if anyone else intends to audio or video tape this meeting he or she is required to inform the chair." 6:30 pm Planning Discussion • Site Plan Review Special Permit: Applicant: Brewster Historical Society,for property located at 739 Lower Road,Assessor's Map 57, Lot 4(formerly Map 17, Lot 1-16)in the RL zoning district. Discuss updated site plan. Leaning recused himself from this discussion. Attorney Jones stated that the plan that went before the Conservation Commission is the plan that this Board is looking at tonight. They will be going with propane gas because natural gas is no longer an option. Letters from the Lutheran Church and Brewster Baptist Church were received that offered the use of their parking lots when there is not enough parking at the house. Hoag asked about the size of the parking spaces. Attorney Jones stated that they would be 10X20. Judd asked about the traffic situation and signs. Attorney Jones stated that they would have small signs put up and will adhere to Fire Department regulations concerning parking. Leven went over the conditions that had been placed on the decision,which included: the rock situated near the entrance should be re-located to an appropriate place, Fire Department regulations regarding the entrance parking and the front walkway should be adhered to,the driveway width should not exceed ten feet, receipt of a revised site pian after the Conservation Commission met, lighting should be faced downward and the letter from the Lutheran Church regarding over flow parking. Klump made a Motion that the Board agrees that the conditions have been met and granted approval. Taylor second, all Aye, Vote 6-0-0. • ANR#2015-06: Jenkins Jr, Paul E., Map 143 Lot 144, RM Zoning District, represented by Philip Scholomiti of Ryder&Wilcox, Inc. Property located south of Cross Road, north of Freeman's Way. Requesting a land swap between Map 143-19 and Map 144-01 to allow a conforming addition to the existing dwelling on 144-01 Mr.Scholomiti stated that this would be an equal area exchange for lots 9B and 1B. 9B is not a buildable lot and will be combined with lot 1A, lot 1B is not a buildable lot and will be combined with lot 9A. The lot line from the SE is greater than the required 25 feet. deRuyter made a Motion the endorse the AN R#2015-06,Taylor second,all aye,Vote:7-0-0. 7:00 pm Public Hearin • Road Betterment Proiect#2015-06 For consideration of the Town to undertake a road repair under the Town's Betterment and Assessment Program in accordance with the Article VIII,temporary Road Repair,Section 157-20 of Brewster's Code,for the following roads;Tower Hill Circle(Map 66) Keith Fernandez explained to the Board that the road is in very rough shape. They will be pulverizing and repaving the entire road,adding drainage and improving what drainage is currently there. They will be adding a few leach pits and using solid structures. No comments from the public. Klump made a Motion to close the public hearing, Collum second,all Aye,Vote:7-0-0. Collum made a Motion to approve the Road Betterment Project#2015-06 for Tower Hill Circle, Klump second,all Aye, Vote: 7-0-0 • Site Plan Review Special Permit:#2015-03—Applicant and Owner:Town of Brewster,for property located at 0 Breakwater Road(Breakwater Landing),Assessor's Map 58 Lot 37(formerly Map 4, Lot 55) in the RM Zoning District. The applicant is proposing the retreat of the existing parking lot via pavement removal and restoration of area to natural dune system;providing storm water management for remaining parking lot using green infrastructure;and replacing lost parking by constructing a spillover parking lot. Continued from 2-4-15 Judd let the audience know that Mr.deRuyter has viewed the videos of the prior meeting on this and is up to date on everything and will be participating in the discussion. Kitchell stated that after the last meeting,they have some proposed changes to the plan. They still have the proposed replacement parking lot on the plan.They have reduced the amount of retreat to about 120-130 feet to allow for a bigger turn around which required a shortening of the propose dune area.They added another handicap spot;additional grading work by the pathway was taken out of the plan;in the proposed new lot,the parking spaces have shifted in the top row(this allowed them to get a little further away from the property line);they added another trash receptacle and made the picnic table handicapped accessible. It was also noted that more vegetation was added between the primary dune and the bio-retention facility. The closest corner of the parking lot is 46-47 feet. This revised plan is the one going before the Conservation Commission. Hoag asked if the entrance to Breakwater is being cut down in width and voiced concern about the line of sight. Leaning asked if they were still planning on doing away with the 26 parking spaces in the current parking lot. Kitchell stated that they did not change that on this new plan. Leaning asked if they had looked at the plan that Bob Perry proposed. Kitchell stated that they did look at it early on in the process and they have submitted something to the Conservation Commission in regards to it. Sue Leven has a copy of that. Judd asked about staff comments. Leven stated that there was a letter from the Building Commissioner and correspondence from Town Counsel. Henry Hayes-resident on Breakwater Road asked what the Planning Board was voting on tonight. Leven stated the Board is waiting to hear if the Conservation Commission has any requested changes to the plan before any vote is taken. Hayes-the residents of Brewster have made it clear to the Board that they are not in favor of this. Attorney Duane Landreth, representing the homeowners at The Tides Court spoke about the letter that the Building Commissioner at written stating that the ZBA does not need to approve anything with regards to this. His clients disagree with this decision. He spoke about Mr. Perry's alternative plan,spoke about the Town Counsel review and comments and spoke about the fact that this property was given as a gift to the Town and the Town is disrespecting that gift. The abutters he represents feel that changing the park to a parking lot is unacceptable and would change the entire road. Kiump asked if they planned on appealing the Building Commissioner's decision. Attorney Landreth-they have not made a decision yet. Judd asked if Chris Miller could explain to the public if there is a committee that has looked at this proposal. Miller stated that the Coastal Committee reviewed the plan and this project and is in support of it. He also noted that the proposal has the full support of the Selectmen. Beverly Biondi, abutter,thinks the Board and the Selectmen need to look at the alternative plan. Leven stated that it is unusual that someone from the public would bring in a plan for the Board to look at and isn't even sure the Board can look at another plan when the HW plan was sent to this Board by the Selectmen for approval. Leaning stated that this Board has not seen nor explored any alternatives to this proposed HW plan. Leven—the Conservation Commission looks at alternatives,this Board does not. Leaning-if this Board is not the appropriate Board to look at alternatives then another Board should have that authority and should make it clear that alternatives were looked at. Bob Perry, Engineer,stated that he was contacted to look at the proposal and then did submit an alternative plan. Leaning asked if he discussed his concept with any Town official or board. Perry-no. John Lamb, resident of Crosby Lane,stated that even though it is legal to do this,it doesn't mean it should be done. He is very concerned with whether or not this plan will even work and believes that other alternatives needs to be looked at. Miller-This plan will be going back before the Conservation Commission again. He stated that Mr. Perry had talked to them and that they did look at the alternative plan and rejected it. Hoag-the proposal before us tonight is what we have to act on. We can't redesign the plan but we can condition it. Leaning believes that the letters from people should be dealt when the Board is getting ready to vote. Judd-the public can come in at any time and look at the letters. Collum feels the same way as Mr. Hoag. Taylor will attend the next Conservation Commission hearing. Klump made a Motion that a letter be sent to the Selectmen asking them to give this proposal re-consideration because of all the comments the Board had. Leaning second. deRuyter asked if the Board said no to this project would it have to go back to the drawing board? Leven-the Board cannot deny this,they can put conditions on it but not deny it. Vote: 2 yes,4 no 1 abstention. deRuyter made a Motion to continue this hearing until March 11, 2015, Leaning second,all Aye,Vote: 7-0-0 • Topics the chair did not reasonably anticipate. Leven acknowledged Kelly Moore and stated that she would be back soon. Leaning made a Motion to adjourn,Collum second, all Aye,Vote 7-0-0.The meeting ended at 8:45 pm. The next meeting date is 3/11/15.
