HomeMy Public PortalAbout1997/05/08 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting May 15, 1997 was held on May 8, 1997, 7:00 P.M., Municipal Court, Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: Mayor PeterJ. Sica Councilmember Bialowarczuk " DuPont " Failace " Feingold " Gutowski Noted absent was Councilmember Fazekas. Also noted present was Borough Attorney Craig Coughlin. Mailed to the Home News Tribune, The Star Ledger and posted on the bulletin board on May 2, 1997. Dr. Chenkin from the Board of Health addressed the Governing Body. He said the Board of Health.. .(inaudible).. .what the Borough does but they have heard rumors about the Board of Health being put into several different buildings around town. He said he has also heard the present Board of Health Building is going to be demolished. He said he does not know neither does the Board of Health know what building they are going to be put in. He said originally .. . (inaudible). . .our best bet was to expand the Health Department out towards the Municipal Building. He said the expansion would contain all the things needed to run the clinics. He said the present clinics, which takes place in the Community Center, are totally inadequate. He said the Pediatrician who comes to examine the children said there is so much background noise from some of the seniors there that she can not properly hear the lung and heart sounds through the stethoscope. He said the Board also finds the facilities they wanted were put in the expansion and they have asked the architect for his plans for that. He said in addition to that when he was on the old .. . (inaudible). .. he wrote up grant for a private foundation and they were hoping they would get money trom that source. Mayor Sica said the Borough brought the Carteret Bank Building and the Tax Office, Purchasing Department, Tax Collection, Treasurers Office and everything out of the ground floor of the City Hall. He said it is already barrier freed and everything. He said what they are looking at, and nothing is in stone yet, is if all those departments are moved into the new building what the cost would be to fix that area up and use it for the Board of Health. He said it is probably twice as much square footage as the Board of Health has now. He said it would probably be almost twice as much as could be put at the current building. He said without going through the whole expense of trying MAY 8, 1997 AGENDA MEET! NG PRESENT STATEMENT OF MEETING NOTICE BOARD OF HEALTH MAY 8, 1997 BOARD OF HEALTH CONTI NUED to barrier free the old Board of Health without trying to put a new roof on it and the whole nine yards. He said nothing is in stone. He said once they get the Tax Office and everybody else out of the ground floor of the City Hall then they are going to ask the Board of Health to look at the area but nothing is in stone yet. He said, as it is right now the Board of Health is staying where it is. He said what they have asked the Board of Health to do is not to expend any money on the building and the Mayor and Council will not expend any money. He said he would like this to be done until such time as the building at the new bank is finished and see what it is going to cost to do either project. He said if the Board of Health's idea is less costly and more efficient then that project is the one that will be used. He said if the project at the ground floor at the City Hall is less costly and efficient then the Board of Health would be moved into that area. Dr. Chenkin asked if the ground floor at the City Hall handicapped accessible? Mayor Sica said yes it is. He said the only thing that would be required to be put down in the basement are handicapped accessible bathrooms. He said a ramp has been built and automatic doors have been put on the entrance to the basement area. He said the reason this was done is because of the new laws stating everything has to be handicapped accessible. He said but as for right now he still has not looked at what it will cost so the Mayor and Council does not know if the Board of Health will be moved. Dr. Chenkin said he has been told it is damp and there is an odor in the basement area. Mayor Sica said the Borough has spent a lot of money water proofing the basement. He said it is not damp in the basement. He said the only part that is damp is in the front storage room under the old steps that are not even used. He said, as it is right now he is contemplating drawing up some preliminary drawings on eliminating those steps and making a different design up to the tront of the building. He said the front steps are all cracked up and water does leak into the old storage building down there. He said the Purchasing Department, Welfare Department, Tax Collection Department, Sewer Collection Department, Payroll Department are down there. He said there is a lot of activity down there. He said there are no problems with water except for the one area. He said if it leaks or if it is damp then it will of course be addressed in the cost of fixing everything. Dr. Chenkin said he has the plans of the addition and the roof. Mayor Sica said he has a copy of them he has seen them. Dr. Chenkin said he was just wondering if the Council would like to see a copy. Mayor Sica said he could leave them and the Council could look at them. Dr. Chenkin said he could send them over. 2 Mayor Sica said Dr. Chenkin could send over a copy to the City Hall and whoever wishes to see the plans can look at them in City Hall. Borough Engineer Pratap Parmar addressed the Governing Body. No correspondence available unable to transcribe. Borough Attorney Coughlin stated this deal with the confusion that may have resulted from the envelope that was required for the bid to be submitted in and having a different address then the meeting location site. He said his initial sense was that there is a reasonable argument that could be made seeing as how there was confusion with regard to this. He said while the notice to the bidder is clear and there .. . (inaudible). .. bids returned here. He said there is the envelope the Borough requires that the bids be returned in which indicates it should be returned to the Borough Hall. He said this would be a basis for .. . (inaudible). ., Mayor Sica said he thinks the reason why the address is on the envelope is if you mail it in like the other guy did he did not deliver it he mailed it in he would have had to deliver it to the Purchasing Department there. He said if the specs are clearly read it said the bids would be opened and received at also here at that meeting. Borough Attorney Coughlin said clearly the notice to bidders, there is no question about the notice to bidder indicating the bids should be returned here. Mayor Sica said he does not think there is a choice. He said either it is given out or the Borough will loose $18,000.00. Borough Attorney Coughlin said he does not think there has been any objections from the unsuccessful bidder. Mayor Sica said as long as the State is notified that it is going to be awarded then they will not take the money. Borough Engineer Parmar said there is no .. .(inaudible)... for the .. .(inaudible)... Center. He said communication.. .(inaudible).. .was contacted and he has submitted his price of $14,999.00 for five telephones, one ... (inaudible). .. and one pager including wiring and installation. He said he recommends approving this. He said seeing as how they are a State approved contractor the job can be awarded to them without bid.. . (inaudible).. . Mayor Sica said telephones are needed. Councilmember Gutowski asked was the Borough paying for this. Mayor Sica said the Borough would have to pay to bring the service in but each individual would have to pay for their own telephones. He said someone has to pay to bring the service in. Councilmember Gutowski said he understands that but it says the Borough will be purchasing five telephones.. . (inaudible).. . MAY 8, 1997 BOARD OF HEALTH CONTI NUED BOROUGH ENGINEER 3 MAY 8, 1997 BOROUGH ENGINEER CONTI NUED Mayor Sica said each one would be asked to contribute. He said it has to be put in. Borough Engineer Parmar stated the Fire Department Building was inspected. The remainder of the conversation is inaudible. Mayor Sica asked where the $1500.00 price come from. Borough Engineer Parmar said from the main contractor. Mayor Sica said the price should not come from the main contractor. He told the engineer to call a fence company and let them come in and give a price. He said why should the Borough pay the main contractor to tack on a profit. Borough Engineer Parmar stated.. .(inaudible)... is asking for $13, 500.00 for designing and comparing the contract document for the.. . (inaudible). .. phase two of the Hill Section. He said a meeting with Conrail is being sought as a last result before given up the .. . (inaudible).. . assignment and the results will be presented to the Council. He said he is seeking a meeting with Conrail and maybe he can explain it to them and they will give permission. He said then the Borough could go with the previous policy.. .(inaudible)... designing. Mayor Sica stated to bring Conrail in. Councilmember Failace said he was just going to ask if the Mayor had tried to contact Conrail. Mayor Sica said he would give the engineer a name from Conrail that he would be able to reach out to and have them come to his office for a meeting. Borough Engineer Parmar said ...(inaudible)... He said if contamination is detected the cost of addressing will depends on the extent of the contamination.. . (inaudible).. . He said he is requesting that funds be allotted for this work so if required they can advertise for the bid say $13,000.00. He said another quote of $38,000.00 is from . ..(inaudible) for.. . (inaudible).. . removal operations at a lump sum for uncontaminated conditions only. Mayor Sica said for the Borough Engineer to hold off on all of this until Monday. He said the guy is willing to do this but wants to come down and look at the site. He said he has to do all the work the guy will not send his equipment in. He said he does not have any problems with it if the guy does not have any problems. Borough Engineer Parmar made a statement but the entire conversation is inaudible. He mentioned something about being held up. Borough Attorney Coughlin said he called the attorney for the company and he did not respond so he wrote them a letter. He said he faxed it off to them today. He said he would follow up with this tomorrow. 4 Councilmember Failace said he had asked, .. . (inaudible). .. if he had given a letter on the conditions on the streets. He said the man said he had given this information to Parmar. Borough Engineer Parmar said in his last report he stated the list had been received but that it was incomplete. He said the name of the street was given but they did not state from which crossing to which crossmg. Mayor Sica said all the man gave Parmar was a list of streets no descriptions. Borough Engineer Parmar said when the Council says which two or three they want done then he will put more effort into them but until then he will just keep on working on them. Councilmember Failace said Pannar has to let the Council know what will work. He said he would like to see the list Parmar has put together and then the Council can look at it and make a decision. Mayor Sica said he and the Council should go down physically and look at the streets. He said he knows Sabo Street is one of them but it is only that bottom corner. He said so all of Sabo Street would not be painted only the bottom corner. He said unless someone goes down and physically look at it and give the measurements on what needs to be done then maybe twenty or thirty can be done. He said but if they just go and try to reconstruct streets that are not necessary because there is a hole some where on the street that is insanity. Borough Engineer said last time when they had a few streets to fix they only fixed the areas on the streets that needed to be fixed this gave them the ability to do many streets. MAY 8, 1997 BOROUGH ENGINEER CONTINUED ORDINANCES PUBLIC HEARING RESOLUTIONS APPLICATIONS 5 MAY 8, 1997 COW1UNICATIONS City of Perth Amboy - Resolution supporting legislation for reimbursement to Municipalities for totally disabled Verterans' property tax exemptions. REPORTS Air Pollution - February 1997. Fire - March 1997. Inspection of Buildings - April 1997. Treasurer - April 1997. Welfare - March & April 1997. MATTERS FOR DI SCUSS ION RCA AGREEMENTS RCA Agreements. Mayor Sica said he was going to make a suggestion in order to get this thing resolved. He said two members of the Council should be appointed himself and the attorney to sit down with Mr. Raia and see what it is going to take to resolve this thing before the Borough starts losing money. He said this will in able them to come back with a precis proposal and see how that flies. He asked Borough Attorney Craig Coughlin what he thinks. Borough Attorney Craig Coughlin said he feels this is certainly on way to attempt to resolve the problem. He said he has not had a chance to speak with everybody. He said he had a conversation with Shirley Bishop who is the Executive Director of Affordable Housing. He said he had been calling her in connection with having a meeting, which was requested last time. He said he feels if pressed they would probably come to a meeting but her opinion was she would prefer not to because they viewed any dispute between the Borough and Mr. Raia as just that a dispute between the Borough and the contractor should have been resolved. He said Shirley Bishop stated any issues that result as to the nature of the funding should have been addressed prior to the construction of the building. He said they do not now want to be placed in the position as being a mediator or in some way being the adjudicating entity for a dispute between the Borough and Mr. Raia. He said Shirley Bishop indicated she would prefer if the Borough would sit down and attempt to negotiate a resolution with the developer and to essentially keep COAH out of the mix. He said he thinks it is possible to resolve things the way the Mayor stated assuming there could be some negotiated resolution ofthe issue. Councilmember Fazekas asked Borough Attorney Coughlin if he was correct in understanding this does not affect the money from Readington at this point. Borough Attorney Craig Coughlin stated not practically speaking. He said the article in the paper about the action that COAH took and what his understanding about what they have done is they are preventing the Borough from receiving funding until the issue is resolved with Mr. Raia. 6 Mayor Sica said COAH knows the Borough IS not gomg to get Readington for at least a year. Councilmember Failace said he thought they were talking about Cranberry. Borough Attorney Craig Coughlin said the next payment for Cranberry is not due until June. He said as a practical matter it has no impact on the Borough. Mayor Sica said it has not impact on the Borough right now. Borough Attorney Craig Coughlin said yes right now. Mayor Sica said if the Borough does not resolve this there is going to be a practical impact on the Borough and the Borough is going to loose a bunch of money that could be given out. Councilmember DuPont said he read it was approved yesterday. Borough Attorney Coughlin said the agreement was certified. Mayor Sica said the agreement was certified but the Borough is not going to get the funds for a year rather the first payment of $480,000.00 with five equal payments. Councilmember DuPont said when he got a letter from Pat he was nervous about what was going on. Mayor Sica said what could be held out the Borough is not getting anything this week. Councilmember Gutowski asked if they were gomg to certify the Borough's project plan. Borough Attorney said a recommendation is needed from FMHA before the agreement for the project plan can be certified. Mayor Sica said it has been certified that they are going to work with the Borough but now FMHA has the final say. Borough Attorney said the project plan should have gone to the FMHA first and then they make a recommendation to COAH who in turn approves the agreement. Councilmember Gutowski said he spoke with Kathy ...(inaudible)... The same lady Pat Holden spoke with and she said the entire project plan for Readington was for scattered site rehab. There is nothing included for.. .(inaudible).. .or anything. He said he asked her for her definition of scattered site rehab. Mayor Sica said it means the Borough can give it out any way it chooses to. Councilmember Gutowski said as per Kathy.. . (inaudible).. . said it was for existing occupied structures. MAY 8, 1997 RCA AGREEMENTS CONTINUED 7 MAY 8, 1997 MATTERS FOR DISCUSSION RCA AGREEMENTS CONTINUED COMCAST REMINGTON &VERNICK ENGINEERS JOHN SCHANTEZ, ESQ. Borough Attorney said right for occupied structures throughout the community, or neighborhood, or for some geographic areas. Mayor Sica said the Borough could give it out as either grants or loans. Councilmember Gutowski said he did not ask her about that and she did not want to get into answering to many questions. He said the only thing he asked her was what was the project.. . (inaudible).. . this time. He said she told him there was no indication of a project plan .. .(inaudible)... anywhere about any developers and or anything else it is just scattered rehab. He said what he hears Pat Holden telling him and what he reads in the papers he does not know what is true. Mayor Sica said that is why he thinks it is imperative that a committee is put together and sit down and see if this whole thing can be ironed out instead of beating a dead horse an in turn jeopardizing that funding. Councilmember Gutowski said he would certainly like to volunteer for that committee. Mayor Sica said no problem and asked who else would like to serve on that committee. Councilmember DuPont said he would like to be on it. Mayor Sica said there could only be two on the committee along with himself because then there would be a quorum. Comcast - Asking Governing Body for support of re-examination of Direct Broadcast Satellite's exemption from local taxes and fees Councilmember Failace asked what exactly that meant. Mayor Sica said Comcast does not want to pay taxes and fees on anything they put up. Councilmember Failace said when Comcast asks for a re-examination is there something the Borough is doing now. Mayor Sica said the Borough is not going to endorse Comcast request. He said he thinks the request should be noted as received and placed on file. He said what Comcast is saying is because they supply local services they do not want to pay taxes if they put up a unit here. He said he feels the Borough would rather have the taxes. Remington & Vernick Engineers, Inc. - Asking for endorsement of proposed legislation and requesting that grants be made available to municipalities to remove and clean up underground storage tanks. Mayor Sica said the Borough is all for that. John Schantz, Esq. - Requesting Additional appropriation, $390.00, RE: Sgt. Wurst. 8 Borough Clerk Kathleen Barney said the Borough gave them $1000.00 and it came out to be $390.00 more. She asked if a Resolution had to be put on. Mayor Sica said no. He said he would like to see the breakdown of what was done. Borough Clerk Kathleen Barney said she had a copy ofthe breakdown. Mayor Sica asked Borough Attorney Coughlin to find out what the disposition was. He said there are 100 telephone calls and the case never went to court. He said to hold this one. Division of Local Government Services - Appointment of Public Works Manger. Mayor Sica said this should be discussed in Closed Session. Health Department - Repairs. Chief Sica- a) Commendations b) Sergeant's Promotional List Mayor Sica said this should be discussed in Closed. Councilmember Failace asked why does the Sergeant's Promotional List have to be discussed in Closed Session. Mayor Sica said because it is personnel. He said there may be some changes necessary. He then asked Borough Attorney Craig Coughlin what he felt. Borough Attorney Craig Coughlin stated his understanding of the issue is the matter has already been or is about to be the subject of a newspaper article. He said the newspaper contacted him today. He said as a practical matter there are issues with regard to the validity of the current list which he is not sure if they are in and of themselves personnel issues. He said but what action taken may be personnel matters, it may in fact require the Borough to notify the people involved. He said in terms of the general outline of what is involved it he does not know if that is a matter of Closed Session. He said they would have to be very careful as they go along in discussing that to be sure not to touch on any personnel matter involving and employee without them being notified to be there. Mayor Sica said this is why he said it should be discussed in Closed Session. Borough Attorney Craig Coughlin said what he is saying is depending on what it is that will be discussed with regard to this. He said it is either not a subject for Closed or if the employees involved are going to be talked about directly then he feels they are entitled to be there. Councilmember DuPont said all he wants to know about is the certification of the list Mayor Sica said the Council has not even gotten anything official. He said the copy they have is just a courtesy copy. He said if the Council MAY 8, 1997 JOHN SCHANTZ, ESQ. WELFARE DEPARTMENT SENATOR LESNIAK ASSYMBLYMEN COHEN & SULlGA ORDI NANCE BID MUNICIPAL WELFARE ASSOCIATION OF NEW JERSEY BUSINESS TO BE ADDED ZONING BOARD WORKERS starts talking about this, it would be a problem. He said if it were discussed in Closed Session, the Council would end up discussing the people involved even if the names of the individual are not mentioned. Construction Official- Waiver of Fees, M.S.!. Barry Albin, Esq. - Resolution #96-315, legal service - Sgt. Zubenko Borough Clerk Kathleen Barney said the attorney called and wanted to bill her. She said there is a 92 resolution that says $100.00 an hour and this one that says $125.00 per hour. Welfare Department - Asking for resolution to petition State for funds to administer welfare at local level. Councilmember Failace stated he had a copy of this petition. He said he would give Borough Attorney a copy. He said what the state is doing is trying to consolidate. Mayor Sica said the Borough does not want that. The Mayor said he would like to keep it the way it is. He said the Borough would take care of its own. He said to draw up a resolution. Senator Lesniak, Assemblymen Cohen & Suliga - Asking municipalities to write to Governor Whitman to urge her to veto minutes of Turnpike Authority meeting, April 29, 1997 - Re: Proposed Hazardous Waste Facility in Linden. Ordinance - Reduction of Sewer User Fee. Councilmember Failace stated this was the $50.00, which was set up at the beginning of the year. He said the Council is just taking off the flat fee. Bid - Leffert Street Improvements Municipal Welfare Association of New Jersey - Asking for resolution to retain local Municipal General Assistance Programs. Mayor Sica asked Councilmember Gutowski if he had any business to be added. Councilmember Gutowski said he asked Borough Attorney Coughlin a few weeks ago about the Zoning Board thing with the workers. He said he has spoken to a number of people and before he states what he was told he asked Borough Attorney ifhe found out anything. Borough Attorney Coughlin stated he wrote a letter indicating he felt the law was unclear. He said someone had asked him to call DCA. He said DCA indicated to him they believe the law is unclear as well and they do not have a rule on per-say on it. He said they said the Borough should rely on whatever opinion he gave essentially or whatever rule the Council wanted to impose. He said it does not mean there could not be litigation around it. He said they did say they did not know what the consequences would be around that action but there 10 is nothing that they know that would prevent the Borough from prohibiting municipal employees from serving on the Zoning Board. Councilmember Gutowski said he spoke with Woodbridge, Edison, Sayreville, East Brunswick, and he got laughed at. He said they were shocked the Borough would allow municipal employees on the Zoning Board. He said he also spoke with the Attorney Generals Office, DCA, Local Finance Board, and Division of Planning in the State and they all basically said the same thing the Borough Attorney stated. He said they informed him the law is unclear and to rely on your local attorney. Mayor Sica stated there is nothing that precludes it and there is nothing to include it either. Councilmember Gutowski said what he is being told is it is a local call. Mayor Sica said he has been appointed for five years and when his appointment is up then the Council will make the call. He said if the Council tries to remove him, it would just cause litigation. Councilmember Gutowski stated that is a chance the Council can take. He said what if someone comes before the Zoning Board and their opinion is they do not feel this person technically should be there because of a violation of state law. Mayor Sica said a state law is not be violated. Councilmember Gutowski said some people say the Borough is violating a state law and some say the Borough is not violating a state law. Borough Attorney Coughlin said if there is not a dully-constituted board then certainly the actions could be called into question. He said at this point the step the Council would have to go through is to remove someone. He said the position would be that the person was inappropriately appointed or that they were not qualified to serve. Mayor Sica said then the Borough would have to go to court. Borough Attorney Coughlin he the Borough would not have to go to court in the first instance unless someone contested the action then he suspects that it where it would end up. He said he thinks the better rule is not to have a municipal employee on the board. He said he thinks this is generally accepted. He said the language in the statute to him seems to be clear on its face that there should not be a municipal employee on the Zoning Board. He said as he pointed out before there is a case that could question this. He said in his opinion the language of that statute is very clear. Mayor Sica said when the appointment expires Councilmember Gutowski can do whatever he wants to do but in the meantime, it would get the Borough in litigation. He said Councilmember Gutowski would have to provide a reason from doing it and if there is no valid law saying it can or cannot be done then there is going to be a problem. MAY 8, 1997 ZONING BOARD WORKERS CONTI NUED 11 MAY 8, 1997 ZONING BOARD WORKERS CONTI NUED ANTHONY ABELLO REVIVAL CENTER CHURCH FIRE DEPARTMENT RESOLUTI ON #97-161 RESOLUTI ON TO GO INTÓ CLOSED SESSION ADOPTED MEETI NG CLOSED Borough Attorney said he does not feel the Council should go after someone specifically. He said he thinks generally and conceptually in his opinion on the face, the statute says it can not do it. Mayor Sica said Anthony Abello, the guy who has been working part- time to help Ray clean, as of Friday May 16th he is going to give up the job. He said Mr. Abello stated his brother would like to take the part- time job so it is up to the Council. Councilmember FaîLace stated it must be his brother Jason Abello. Mayor Sica stated he received a request trom the Revival Center Church. He said they want to start a Daycare Center and they are looking for perhaps a building the Borough may have or a piece of property or something like that. He said he would ask Patrick to look at any of the foreclosures coming up that are down in that area. He said they want to start a Daycare Center to help working mothers. He said it comes from Pastor Andrews. He said Pastor Andrews gives a complete breakdown of what he wants to do. He said they are not asking the Borough for money they are asking the Borough for a place. He said he told Pastor Andrews he would turn it over to Patrick tomorrow morning. He said he did not think the Council would have any problems with something like that. Council said no they do not have a problem with that. Mayor Sica said the other thing he wanted to discuss is about the Fire Department and this needs to be discussed in Closed Session because it is rather serious. Mayor Sica asked for a motion to go into Closed Session to discuss Personnel Matters and Possible Litigation. Resolution #97-161 was introduced by the Mayor and referred to the Council for action Upon MMS&C by Councilmembers DuPont and Bialowarczuk RESOLUTION #97-161 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Feingold, and Gutowski voted in the affirmative. At approximately 7:40 p.rn. a Closed Session was held. 12 Upon MMS&C by Councilmembers Failace and Bialowarczuk and unanimous affirmative vote of the five Councilmembers present the Agenda Meeting was re-opened at approximately 8:30 p.m. Councilmember Failace said he had something to go over quickly. He said Chico Basilici told him a corner of his property last year in the snowstorm, the Payloader, while moving the snow broke the curb on the corner of his property. He said Chico is asking if there is anything the Council could due because he got a bill for $500.00.
