Absent: Jason Klump,William Hoag Other attendees:Sue Leven, Kari Hoffmann, Peter Johnson, Steve Backus, Matt Farrell--J.M. O'Reilly&Associates, Inc. The Chair read the Recording or Taping Notification: "As required by the Open Meeting Law we are informing you that the Town will be audio and videotaping this public meeting, In addition,if anyone else intends to audio or video tape this meeting he or she is required to inform the chair." 6:30 pm Planning Discussion • ANR#2015-10, Applicant: Vernal Pool Realty Owner: La Dolce Vita Nomine Trust, 2342 Main Street, Map 78, Lot 121, (formerly Map 16, Lot 83). The intention is to divide the parcel into three parcels. Representative: John O'Reilly, J.M. O'Reilly&Associates, Inc. Matt Farrell from J.M. O'Reilly&Associates, Inc. was present for the applicant. Steve Backus was present The Chair read the description. Farrell summarized the ANR. • 3 parcels will be created Board Comments Taylor asked about lots B and C. Farrell—C may be transferred to Brewster Conservation Trust (BCT), B—not sure Backus— Donating lot C to BCT, Selling Lot B to BCT at a discounted price Taylor asked about Lot A—as is? Backus -Yes, as-is. No action at this time. deRuyter asked about why they are dividing B and C. Backus explained the accountant recommended it. He has an agreement with the BCT. An appraisal is being done on Lot C and will be reviewed further. Collum asked about a condition for B and C. If subdivided could it be buildable in the future. No conditions can apply to an ANR. The Board discussed frontage and specifics further. The Board is not endorsing zoning conformity. Collum expressed support for the ANR. Leaning shared Collum's concerns. Leven explained they could request a note on the plan that B and C are not buildable lots. Leaning does not want to require a note on the plan. Backus--Those lots are unbuildable and they do not have frontage and blocked by wetlands for access. Taylor asked why it was subdivided this way. Why so much on Lot A?She was surprised that the whole wetland was not included. Backus—He wanted to donate land behind the spa. He met Mark Robinson during a land donation in Harwich. Collum expressed concern about dividing lands and adjoining properties. He asked the Board if they are willing to accept this plan. Judd and Collum discussed further comparing a subdivision to an ANR. The applicant could do an 81-x plan. Farrell asked if someone could develop lot B, what would be the concern. The Town would end up benefitting from it. It does not seem possible because of the wetlands. deRuyter made a Motion to endorse ANR#2015-10 Collum Second, All Aye, Vote 5-0-0 The Board signed the Mylar plan and two copies for the file. Approval of Minutes 2111/15 Leaning made a Motion to approve minutes from 2/11115 as written, Taylor Second, All Aye, Vote 5-0-0 2125115 deRuyter made a Motion to approve minutes from 2125/15 as written, Taylor Second, All Aye, Vote 5-0-0 Topics the Chair did not reasonably anticipate -None Leaning made a Motion to adjourn, Collum Second,All Aye,Vote 5-0-0. The meeting ended at 7:00 pm.
