Vote: 6-0-0 REGULAR MEETING MINUTES Wednesday, September 9, 2015 at 6:30 pm Brewster Town Office Building Chairman Richard Judd convened the Planning Board meeting at 6:30 pm in the Brewster Town Office Building with members: William Hoag, Scott Collum, and Kari Hoffmann present. The Chair read the Recording or Taping Notification: "As required by the Open Meeting Law we are informing you that the Town will be audio and video taping this public meeting. In addition, if anyone else intends to audio or video tape this meeting he or she is required to inform the chair." 6:30 pm Planning Board Discussion Comprehensive Plan Process Outline Judd — Reviews the amended draft. Hoffmann —Agrees with the amendments Collum — Suggests 5 core members, two PB members, three other members. Huge process that requires a board to lead and direct, not to rule. That is not what the board is for. Judd —Agrees to 5 people to manage the work with floating members based on expertise. Ultimately the Selectmen will appoint the committee. Hoag --Thinks up to 7 members could be core group. Hoffmann- Committee is a guiding body, not a voting committee. Collum — Needs to be a voting committee. Each piece needs to be voted on so it's final. Hoffmann — Thinks it needs to start with 7 members. It may be that some members may not be available all the time. Government Study Committee started with a lot of members and has gone down in numbers. Wants Board to agree to 5 to 7 members. Judd — Goals and visioning aspect needs to be addressed. Hoag — Need a consultant. Need a basis of where the town is before the process is started. What does the Town look like now. Hoffmann — In order to know where the Town wants to go, the Town needs to know where it is now. Possibly having certain items available for the visioning session. Judd — Surveys will help give direction. Collum — Believes a facilitator should be hired to start this process. This is a great outline to start with. Judd — Section 5 of the outline is very comprehensive. Board needs to address any additions. Collum —Wants to clarify "Air Quality." Consider another topic "Residential Heritage." Judd - Suggests the Board take a break and do the public hearing. Hoffmann --Wants to return to this discussion. Pagel of 4 PB Regular Meeting Minutes 9/9/2015 Ana Brady,Senior Dept.Assistant 7:00 pm Public Hearing Site Plan Review/Special Permit/Change of Use: (Continued Hearing) #2015-16 — Applicant: Manuel Ainzuain: For the property located at 2628 Main St., Assessors' Map 89, Lot 14 (formerly Map 15, Lots 113-2) in the VB and RM Zoning District. The applicant is proposing to operate a small batch coffee roaster and Limited Service Restaurant to serve coffee and other consumables on site. Ainzuain — Synopsis of application and soft opening. Collum — Concerned about drainage grate. Has pipe sticking out. Is it getting fixed? Will you be able to drive over it? Ainzuain — Has discussed with owner about improvements for the commercial space. Owner has a plan and it will be fixed. Collum - Parking is very important. Ainzuain —There is a plan for parking. Hoffmann — Parking needs to be safe. Handicap spots need to be made available. Has issue with the zoning. Judd — Explains the zoning usage issue. Is there a parking plan? Are there 30 spaces? Ainzuain — Owner is having the parking lot redesigned. Judd —Wants revised plan with handicap spots designated. Ainzuain -- Can he submit the parking plan through the Planning Dept. or does he have to return to the Board. Judd — It might be a condition. Collum — Questions if the amount of parking spaces are sufficient. Wheel stops are needed for delineation. Clarifies that patio is concrete for smooth transition with handicap parking. Ainzuain — Has noticed the parking at different times and how public parks in lot. Will talk to all the owners of businesses. Judd —Advises that applicant come back with a parking lot plan. Suggests at least 3 handicap spots. Hoag — Concerned because of the age dynamics of the Town, there are a lot of handicap stickers. Hoffmann — Questions stormwater runoff. Collum — Order of conditions to make the storm drain passable by a vehicle. It's within the curb cut of the 50 ft. way. Judd —Ask DPW to inspect the curb cut of the property. Ainzuain —Will make sure all of the issues be addressed with the owner. Judd —Will keep this hearing open and request DPW director to make a determination where the catch basin lies. Hoffmann — What are the landscaping plans? Has this application gone before the Historic Committee? Ainzuain — Explains the color of the building, the seating area, landscaping and planter boxes. The Historic Commission approved the color of the building. Hoffmann — Requests lighting verification. Ainzuain -- Explains new lighting on sign and new solar lighting in the planters. Hoag — Questions if the 50 ft. way is a joint driveway or a way? Should there be a designation? Judd -- It would be beneficial to have owner come with master plan. Direction is to have parking on side or back. Plan sketch will need to have 3 handicap spots, 27 designated spots, the sizes of parking spots, preferably 90'x20', where lighting will occur on the site; Building Commissioner and OKH will need to approve signs. Ainzuain — Sign is on the roof of the building and on Rt. 6A will be a sign cluster with all the businesses. Applicant can get those from Planning Dept. Hoag — Questions why new business across the way has anything to do with applicant. Ainzuain — Explains that it is a joint parking with all businesses. Judd —Where is the Dumpster Ainzuain — Explains it is shared with all businesses. Collum - Clarify the site, the shared 50ft way, is it an association together with co-ownership private way, three businesses share a dumpster. Properties are a community. Delineations between your properties. Responsible for site plan Ainzuain — Does owner need to apply for site plan. Collum - Leasee brings site plan. Hoffmann — Site Plan encompass the entire property. Whole property should be considered. Judd — Site plan encompasses the whole picture, where the cars are, size of spaces, sketch lighting, outdoor lighting, signage, where the ground sign is, where the dumpster is. Business interacts with other businesses. 50 ft strip of land, is it a way or driveway? Hoffmann — Now that septic system is done what landscaping is being done. Ainzuain —Will bring the owner to next meeting. Trying to create nice space and will address the Issues. Judd —Advises applicant to come back on 9123. Motion by Scott Collum for continuance until September 23, 2015. Seconded by William Hoag. VOTE 4-0-0 Special Permit: #2015-16A— Applicant: Manuel Ainzuain: For the property located at 2628 Main St., Assessors' Map 89, Lot 14 (formerly Map 15, Lots 113-2) in the VB and RM Zoning District. The applicant is proposing to operate a small batch coffee roaster and Limited Service Restaurant to serve coffee and other consumables on site. Pursuant to Brewster Zoning By-laws Section 179-5E, the applicant is seeking a permit to extend the operation of the Limited Service Restaurant into the western portion of the existing structure which is in an RM zoning district. Ainzuain — synopsis of application. Hoffmann — Clarifies RM and VB zoning issue. Board has no other comments. Motion by Scott Collum to close the public hearing on the Special Permit Application #2015-16A. Second by Kari Hoffmann. VOTE 4-0-0. Board Discussion Judd — Wants to add a condition to keep the extent of the applicant's business within the existing structure and patio area. Collum — Special Permit is conditioned on future approval of 2015-16 Site Plan. Hoag — Concerns with parking in RM zone. Judd — Keep the parking issue with the Site Plan and the function of the business with the Special Permit. Collum —Asks Chair to repeat the condition. Judd - Condition to keep the business contained within the existing structure and patio footprint. Ainzuain — Clarifies that the patio can have seating. Judd - No more concrete to the west. VOTE 4-0-0 Approval of Minutes of August 12, 2015. MOTION by Kari Hoffmann to approve minutes of August 12, 2015. Second by William Hoag. 1 Vote: 4-0-0. Proposed meeting on September 14th with the Selectmen and the two candidates for the vacancy on the Planning Board. Judd — Reads email from Board of Selectmen Administrative Assistant. What Board members are available for that meeting? Hoag —Available. Hoffmann —Available. Collum — Cannot commit to attend the meeting due to previous commitments. Judd —Will contact other Members to check for availability. Judd —Would like to continue discussion of Comprehensive Plan from earlier in the meeting. Hoffmann —Wants to table Stormwater Bylaw and Regulations and Discussion of Planning Board Support of Proposed State Zoning Reform Judd —Asks for any comments from the Board. Board continues discussion regarding hiring a consultant. Topics Not Anticipated by the Chair Hoffmann -- Maplewood Senior Living has installed new signs. Collum —Advises a phone call to the Building Commissioner for enforcement. MOTION by William Hoag to adjourn the meeting. Second by Kari Hoffmann. Vote: 4-0-0.
