The Chair read the Recording or Taping Notification: "As required by the Open Meeting Law we are informing you that the Town will be audio and video taping this public meeting. In addition, if anyone else intends to audio or video tape this meeting he or she is required to inform the chair." 6:30 pm Executive Session 7:45 pm Public Hearing Application for Modification of a Definitive Subdivision Plan: #015-18 —Applicant: Pamela Lloyd-Baker, Owner: Pamela Lloyd-Baiter; Representative: Peter Soule, PLS, for property located at 42 Warrens Rd., Assessors' Map 38, Lot 75 (formerly Map 2, Lot 33) in the RM Zoning District. The applicant is proposing to modify a previously approved subdivision to create two buildable lots and two non-buildable lots. Board Discussion Roger O'Day, Trustee and Legal Counsel of Brewster Conservation Trust, gives synopsis of.. application. Hoag -- Concerned that the new road has room for emergency vehicles. Wf Leven --Area is undeveloped at that point. Existing cul de sac is for setbacks. Hoffmann — Inquires as to how many lots share the road. O'Day—Three homes share'the driveway. Collum —Wants history of Lot 39. Lloyd-Baker— Gives history of land. Taylor— Is fine with waiver, deRuyter— Has no objection. O'Day — Reads Department review from Conservation Commission. Judd —Will take motion to close public hearing. Motion by William Hoag to close public hearing. Second by Scott Collum. Vote 6-0-0 Page 1 of 3 PB Regular Meeting Minutes 10/14/2015 Ana Brady,Senior Dept,Assistant Leven — Board will approve modification and include road construction waiver; after 20 day appeal period Board will sign the Plan. Judd — Calls for motion. Motion by Nick deRuyter to approve application for modification of definitive subdivision plan with the waiver for road construction with the condition that Certificate of Compliance is issued by the Conservation Commission. Second by Elizabeth Taylor. Vote 6-0-0. Leven — Board will sign plan after Certificate of Compliance is received from the Conservation Commission. Discussion Items Liaison Reports Taylor—WQRC: Jay Merchant from Cape Sand and Recycling is due to come to the Planning Board regarding revegetation. Taylor—Water Planning Committee; No recent meetings. Taylor- CPC: Received one application for Spring Town Meeting. Annual meeting on October 28, 2015, at 4:30 p.m., would like anyone who is interested in applying for funding to come to the meeting. Judd — Inquires if there are any citizen petitions for the Special Town Meeting. Leven — Not aware of any. Specifically for the Fire Station. deRuyter— Zoning Board of Appeals: Crocker Land Realtor Trust, approved; 3811 Main St., approved. Stormwater Bylaw and Regulations Board commences draft Bylaw section 999-5.A. Hoffmann — Reads 999-5.A through 999-5.DA, Applicability. Judd — Questions language on 999.5 B Leven — Explains scenario for patching and reworking roadway and parking lots. Hoag — Concerned about unpaved roads and overgrown roads and permits. Inquires about private roads after damage. deRuyter-- Reads 999-6 Procedures and 999-7, Performance. Collum — Questions definition of"disconnection" in the 999-7.B, Leven —Will request definition from Horsley Witten. Hoag -- Reads 999-8, Waivers. Judd — Inquires who is the "review board." Hoag — If State bylaw less stringent and Brewster is more stringent can we waive to the State bylaw. Leven —You can waive to the less stringent State bylaw. Taylor— Reads 999-9, Stormwater Mitigation. Leven — Review Board cannot allow someone to drain into a private road or Town road. Needs to get examples from Horsely Witten. Title needs to be Stormwater Management not Stormwater Mitigation. Should change that language all through the section. Taylor— Reads 999.10, Enforcement 9990-11, Severability. Judd — Questions working of 999-11.A. Leven — Explains its legal language. Finds new language to substitute in place of 999-11.A. Taylor— Questions moving "Definitions" to the front of the Bylaw. Board agrees to review 999-3, Definitions at the October 28, 2015, meeting. Hoffmann — Inquires as to the date of the Spring Town Meeting. Leven —Advises that it is usually the first week in May and deadlines for the Warrant is January. Ideally, the Stormwater Bylaw and Regulations should be ready by January 15, 2016. Judd — Inquires if Horsley Witten approves the draft. Leven — They are given the updated draft on a regular basis. Taylor— Requests "review board" and "disconnection" be added to definitions. Leven —Will change heading to "Definitions and Acronyms." Hoffmann --What needs to be finalized before the deadline for the Warrant? Judd — Edits need to be done prior to Warrant. Collum —Wants public hearings to be held in December and January. Leven—We may have a little time after that. Judd — Calls for Motion to adjourn. MOTION by Nick deRuyter to adiourn the meeting. Second by Kari Hoffmann. Vote: 6-0-0.
