Chairman Richard Judd convened the Planning Board meeting at 6:30 pm in the Brewster Town Office
Building with members: Scott Collum, William Hoag, Elizabeth Taylor and Kari Hoffmann present.
Absent: Nick deRuyter and Joseph Rinaldi

Judd - Would the Board like to go through his comments?
Hoag- Reads comments from the Summary section.
Taylor- Reads comments and corrections from Purpose, Section F: j
Collum - This is implied under construction. Construction is construction.
Hoag- Reads comments and corrections from Applicability, Section A.
Hoag - Rinaldi puts in Violations and Penalties. Shouldn't those be in regulations? Those should be
left out.
Collum - Reads Performance Standards, Section B:
Collum - Should this be under regulations? 'There are no criteria here. Should it be Linder
Applicability? What criteria does a homeowner follow?
Leven-They are required to keep stormwater on their property. The building permit will explain
how the homeowner deals with stormwater.
Collum - Where would we go to get the criteria? Who writes the criteria that the homeowner
follows?
Leven - We can do that when we write the Regulations. We can include the standard calculations
for stormwater. I can send the material that Horsley Witten wrote up for us.

Leven --The Building Commissioner enforces the bylaw and sends out his staff to see what is going
on.
Hoag-- I think that includes his whole office.
Judd -We can go to Definitions
Collum - Reads 999-3. Definitions

Taylor- Were we going to define "Disconnection?"
Hoffmann - We had a discussion about what"Disconnection" means.
Leven - Will ask Anne Kitchell for the definition.
Collum - Continues to read Definitions
Hoag- Has a question about reservoir. What is the difference between reservoir and rain gardens?
Is that.similar?
Leven - Yes, it's a place where you collect water.
Taylor- The Town doesn't have rain gardens. The town has drainage structures.
Judd - It's a bit different. A reservoir is to store water. A retention area is to slow down or break
velocity.
Collum - Continues to read Definitions. Comments on definition of New Development. What is a
vegetated state? If it's a grassed area is it a vegetated state?
Leven -- It doesn't say undisturbed. It has to be a disturbed area. Crass had to be disturbed at some
point. It's new development vs. redevelopment. Point Source needs to be defined. Will look into
that definition. 1
Taylor- Weren't we going to define NPDES and add it as an acronym?
Collum -- Reads Pre-Development definition.
Leven - Post Construction or Post Development- deleted "that reasonably may be; or anticipated;
and Post-construction refers to the phase of a new development or redevelopment project after
completion." Now reads: "The conditions expected to exist after completion of the proposed
development activity in accordance with approved plans on a specific site or tract of land, and does
not refer to or include the construction phase of a project."
Hoffmann- Why does Redevelopment not allow increase of impervious cover?
Leven - I don't believe that belongs there but I will ask why it is there.
Collum - Road Improvements: Add "tributary."
Leven - Explains what"intersecting the sub-base" means.
Collum - Reads definition of Site: Has issue with the words "entire site." Should this be the area of
land disturbance by construction or development? Will you have to redevelop the entire site if you
disturb a piece in the back.
Judd - Should it be the point of impact?
Leven - "Area of land disturbance by construction or redevelopment" is good language. I will ask
about this.
Callum - Reads Stormwater Management Practice.
Hoffmann -- Has questions about controlling stormwater or controlling pollutants.
Hoag- Definition should stop at peak flow rates.
Leven - Stormwater Management Practice: Definition is changed to: Engineered structures and
non-structural (e.g., site design, vegetation) measures used to control discharge volumes, manage
peak flow rates and/or prevent pollutants from coming into contact with stormwater.
Taylor- Should we also add a Stormwater definition. We also don't have discharge volumes or
peak flow rates.

Collum -- 1 still don't get how it comes into contact with stormwater.
Leven - If it rains and water runs down the street it's stormwater-- it picks up whatever is in the
road. Ifyou have just put fertilizer on your lawn and it rains and that runs into the street that's
pollutants.
Hoffmann- Is this more about controlling the stormwater or the pollutants?
Collum - We are preventing pollutants from leaving the lot.
Hoffmann - So it's controlling the pollutants from leaving the property?
Hoag-We should have a definition for peak flow rates.
Judd - There should be a definition for peak flow rate and discharge volumes
Hoffmann- We need to have a definition of stormwater.
Collum - Concludes reading definitions.
Hoffmann -We need to discuss the calendar. We need to post a public hearing.
Leven - It must be published twice before the public meeting.
Judd -- I think we need one more final read through before the public meeting.
Collum- We need to post and we will finish this next meeting.
Hoffmann - Do we need to have it ready by the end of February?
Leven -- The Board needs to vote that the Bylaw is in final form when it goes to the Finance
Committee.
Hoag- We will need to have work sessions. Why can't we have a public hearing the first week of
February and be done with it. When do the regulations need to be finalized?
Leven -The regulations need to be worked on now but they do not need to be voted on until after
Town Meeting, The Board needs to work on it before Town Meeting.
Judd- Board agrees to have a public hearing and work session on December 16, 2015, at 6:30 p.m.

3 stormwater management facility that poses a threat to public health or safety or as
4 deemed necessary by the Planning Board,Board of Health,Conserva€ion

7 Commission for which all necessary approvals and permits have been issued

24 A. The Review Board may in its discretion,and after due consideration,decide to waive
25 and exempt strict compliance wilt any requirement or this Bylaw or the Regulations
26 promulgated hereunder,where it makes a written finding that such action is:
27 1. Allowed by federal,state and local statutes and/or regulations;
28 2. In(lie public interest;and
29 3. Consistent with the purpose and intent of this Bylaw under ' 9� 99-5`M-4.
30 B. Criteria for granting a waiver shall be defined and included as part of the Regulations
