HomeMy Public PortalAboutOrdinances-1980-93 . 1 ORDINANCE NO. 1980-93 CITY OF TIFFIN, 'IOWA, MOBILE HOME PARK ORDINANCE. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF TIF IN, IOWA: . SECTION I. Purpose. The purpose of this ordinance shall be to promote the public health, safety, morals, order, convenience, prosperity and general welfare; to prevent the overcrowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewage, schools, parks, and other public requirements. SECTION II. Title. This ordinance shall be known and may be cited and referred to as "The City of Tiff iri, Iowa, Mobile Homes Ordinance." SECTION III. Definitions. 1. Annex. An accessory structure attached and appurtenant to a mobile home, other than a porch or entryway that exceeds four (4) feet by six (6) feet in size. 2. Dependent Mobile Home. A mobile home which does not have a flush toilet and a bath or shower; including travel trailers, shall not be allowed in a mobile home park in Tiff in, Iowa except, as provided in dependent mobile home ordinance. 3. Independent :Mobile Home. A mobile home which has a flush toilet and a bath or shower: 4. Inspector. The legally designated inspection authority`of the city, or his authorized representative. 5. Licensee. . Any person flicensed to operate and maintain a mobile home park under provisions1of this ordinance. 6. Mobile Home. Any vehicle or similar portable structure having been constructed with wheels (whether or not such wheels have been removed) and having no foundation other than wheels, jacks or skirtings, and so designed or constructed as to permit occupancy for dwelling or , sleeping purposes. 7. Mobile Home Park. Any plot of ground on which two or more mobile homes, occupied for dwelling or sleeping purposes, are located, regardless of whether or not a charge is made for such accomodation. 8. Mobile Home Space. A plot of ground within a mobile home park designed for-the accomodation of one mobile home. 9. Park. A mobile home park. 10. Permittee. Any person to whom a permit is issued to maintain or operate a mobile home park under the provisions of this 'ordinance. 11. Person. Any natural individual, firm, trust, partnership, association or corporation. SECTION IV. License And Temporary Permit. 1. Requirements. It shall be-unlawful for any person to maintain or operate a mobile home park within the limits of Tiffin, Iowa, unless such person shall first obtain a license therefore, except that the maintenance or operation' of a mobile home park in existence on July 11, 1980 may be continued under a permit for such period of time and under such conditions as are hereinafter prescribed. { page 2 Ordinance 1980-93 2. Issuance. A permit, upon written request therefore, shall be issued by the City Clerk of every mobile home park in existence upon the effective date of this Ordinance. 3. Duration Of Permit. The term of the permit shall be extended, upon written request, for not to exceed one additional period of one year, if (1) the permittee shall have filed application for a license in conformity with Section VI of the Ordinance within 90 days after. July 11, 1980 (2) the permittee is of good moral character, and the park plans and specifications accompanying the application for license comply with all provisions of this ordinance and all other applicable ordinances and statutes, (3) the permittee shall have diligently endeavored to make the existing park conform fully to the plans and specifications submitted with the application, (4) failure to make the existing park conform fully to such plans and specifications shall have been due to causes beyond the control of the permittee. SECTION V. License Fees And Temporary Permit Fees. 1. Annual Fee. The annual license fee or permit fee for each mobile home park shall be fifteen dollars ($15.00). 2. Trandfer Fee. The fee for transfer of a license or permit shall be five dollars ($5.00). SECTION VI. Application For License. , 1. Application For Initial License. Application for initial mobile home park license shall be filed with the City Council. The application shall be in writing, signed by the applicant and shall include the following: a. The name and address of the applicant. b. The location and legal description of the mobile home park. c. A complete plan of the park in conformity with the requirements of Section I of this Ordinance where applicable. d. Plans and specifications of all buildings, improvements and facilities constructed or to be constructed within the mobile home park. e. Such further information as may be requested by the City Council to anable it to determine if the peoposed Park will comply with legal requirements. f. As a further condition,for issuance of a license the applicant must give consent for the City Council to enter upon the premises of the park without a warrant to inspect for conformance to the applicable provisions. g. Ten copies of the application and all accompanying plans and specifications shall be filed. The Clerk shall file one copy and transmit the other copies of the plans and specifications to the Planning and Zoning Commission for study and recommendation, one copy to the City Attorney and one copy to the City Engineer. h. The Commission shall examine the plans and specifications as to its compliance with this Ordinance, and the laws of the State of Iowa, and the comprehansive plan of the City and shall have thirty (30) days within which to submit a recommendation to the Council. The owner or developer may agree to an extension of time not to exceed sixty (60) days. page 3 Ordinance 1980-93 i. The Council, upon receipt of the Commission's recommendation, or after the thirty (30) days, or any extension thereof shall have passed, shall by resololution grant approval to or reject the plans and specifications. If approved, the City Council will issue the license. j. A fee in the amount of $2.50 for each of lots -1 .50 and $1.00 for each lot 50 and up, plus a base charge fee of fifty dollars ($50.00). 2. Application For Renewal License. Upon application in writing by a licensee for renewal of license and upon payment of the annual fee, the City Council upon approval by the City Inspectors shall issue a cer-tificate -renewing.--such---license--for--another—year.--__.____ ____- 3. Application For Transfer Of License. Upon application in writing for transfer of a'license and payment of the transfer fee, the City Council shall issue a transfer if the transferee is of good moral character. SECTION VII. Mobile Home Park Location. A mobile home park may be located as provided by the zoning ordinance. Where any boundary of a park directly abuts property which is improved with a permanent residential building located within twenty-five (25) feet of such boundary or directly abuts unimproved property which may under existing laws and regulations be used for permanent residential construction, a fence, wall or hedge as approved by the City Council, shall be provided along such boundary and shall in addition, create a twenty-five (25) foot buffer strip around the boundary on which grass shall be grown and shall not be part of any adjoining lot. SECTION VIII. Mobile Home Park Plan. 1. Drainage. The park shall be located on a well-drained site, properly graded to insure rapid drainage and free from stagnant pools of water. 2. Space Requirements. Each park shall provide mobile home spaces, • and each space shall be clearly defined or delineated. Each individual space shall have an area of not less than five thousand (5,000) square feet and a width of not less than fifty (50) feet. 3. Clearance Between Homes. Mobile homes shall be so located on each space that there shall be at least a twenty (20) foot clearance between mobile homes, provided, however, that with respect to mobile homes parked end to end, the end to end clearance may be less than twenty (20) feet but not less than fifteen (15) feet. In determining the clearance requirements, an annex shall be considered an intergral part of the mobile home, provided, however, that where the annex is less than half of the length of the mobile home to which it is attached, the clearance may be less than twenty (20) feet but not less than fifteen (15) feet. No mobile home shall be located closer than fifteen (15) feet from any building within the mobile home park or closer than twenty-five (25) feet from any property line bounding the mobile home park. 4. Streets. All streets located within the mobile home park shall conform to the existing streets of the City of Tiffin, Iowa and all deadend streets shall include adequate vehicular space or cul-de-sac. Parking will be allowed on one side only of all streets and shall be marked accordingly. { page 4 Ordinance 1980-93 5. Walkways. Walkways not less than two feet wide shall be provided. Walkways shall be constructed of four inch portland concrete cement to service and connect in a logical pattern all facilities within mobile home park. 6. Public lighting. Walkways and driveways shall be properly maintained and shall be lighted at night with electric lamps of not less than 100 watts each, spaced at intervals of not more than 100 feet, or equivalent illumination as may be supplied by other sources approved by the City Council. 7. Electrical Outlets. An electrical collet, supplying at least 220 volts shall be provided for each mobile home space with a minimum of 100 amphere individual service. 8. Parking. Each park shall provide one automobile parking space with dimensions of eighteen (18) feet by twenty (20) feet for each mobile home space which may be included within the square foot requirements of the lot. SECTION IX. Water Supply. 1. An adequate supply of pure water.for drinking.and domestic purposes shall be supplied by pipes to all buildings and mobile homes within the park, to meet the requirements of the park. Each mobile home space shall be provided with a cold water tap of 3/4 inch pipe , above the ground. 2. The park shall provide a complete water main supply system including hydrants, valves and all other appurtenances which shall be exte ;ded into and through the park to the bouandary lines, and which shall provide for a water connection for the park and shall be connected to the municipal water system when installed, and meet all current city specifications. SECTION X. Service Buildings. 1. Structure. Service buildings shall be permanent structures complying with all applicable ordinances and statutes regulating buildings, electrical installations and plumbing and sanatation systems. 2. Maintenance. All service buildings and the grounds of the park shall be maintained in a clean, sightly condition and kept free of any condition that will- menace the health of any occupant or the public or constitute a nuisance. SECTION XI. Sewage And Refuse Disposal. 1. Application.OfOther Ordinances. Waste from showers, bath tubs, flush toilets, urinals, lavatories, and slop sinks in service and other buildings within the park shall be discharged into the public sewer system in compliance with applicable ordinances. 2. Connections.. Each mobile home space shall be provided with a sewer at least four inches in diameter which shall be connected to receive the waste from the shower, bath tub, flush toilet, lavatory and kitchen sink of the mobile home harbored in such space and having any page 5 Ordinance 11980-93 or all of such facilities. The sewer in each space shall be connected to discharge the home waste into the public sewer system in compliance with applicable ordinances. SECTION XII. Garbage Receptacles. 1. Garbage cans, with tight-fitting covers, or other suitable system, approved by the City Council, shall be provided in quantities adequate to perm it disposal of all gar b age and rubbish.ish. Garbage cans shall be located not farther than 300 feet from any mobile home space. The cans shall be kept in sanitary condition at all times. Garbage and rubbish shall be collected and disposed of as frequently as may be necessary to insure that the garbage cans shall not overflow. SECTION XIII. Fire Proteaction. 1. Fire Hydrants. Standard fire hydrants shall be located within • three hundred (300) feet of each mobile home. 2. Use Of Petroleum Products. Natural gas may be used at individual home spaces; provided that the installation is connected by suitable matalic tubing that complies with the regulations of the State Fire Marshall. 3. Prohibition Of Open Fires. No open fires shall be permitted at any place which may endanger life or property. No fires shall be left unattended at any time. SECTION XIV. Animals And Pets. 1. No owner or person in charge of a dog, cat or other pet animal shall permit it to run at large or commit any nuisance within the limits of any mobile home park. SECTION XV. Supervision. 1. The licensee or permittee, or a duly. authorized attendant or caretaker, shall be in charge at all times to keep the mobile home park, its facilities and equipment in a clean, orderly and sanitary condition. The attendant or caretaker shall be answerable with the licensee or permittee, for the violation of any provision of this Ordinance to which the licensee or permittee is subject. SECTION XVI. Revocation Of License., 1. The City Council may revoke any license to maintain and operate a park when the licensee has been found guilty, by a court or competent jurisdiction, of violating any provisions of this Ordinance. After such conviction, the license may be reissued but only if the 'circumstances leading to conviction have been remedied and the park is being maintained and operated in full compliance with law. ' page 6 Ordinance 1980-93 SECTION XVII. Applicability. 1. Non-conforming Parks. All existing mobile home parks and spaces not meeting the requirements of this Ordinance shall be declared non-conforming and shall not be permitted to add spaces or make any improvements inconsistent with the terms and conditions of this Ordinance. 2. Non-Applicable Provisions. All provisions and conditions of this Ordinance are applicable to non-conforming parks SECTION XVIII. Posting Of License And Temporary Permit. 1. The license certificate or temporary permit shall' be conspisuously posted in the office of or on the premises of the mobile home park at all times. SECTION, XIX. Penalties. 1. Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and shall, upon conviction, be punished be a fine of not more than one hundred dollars ($100.00) or be sentencea to not more than thirty (30) days and;each day's failure to comply with any such provisions shall constitute a separate violation. SECTION XX. Confilct Of Ordinances, Effect Or Partial Invalidity. 1. In any case where a provision of this ordinance is found to be in conflict with a provision of any zoning, building, fire, safety, or health ordinance or code of this city existing on the effective date of this ordinance, the provision which established the higher standard for the promotion and protection of the health and safety of the people shall prevail. SECTION XXI. Repealer. 1. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION XXII. Saving Clause. 1. If any section, provision or part of this ordinance -shall be adjudged invalid or unconstitutional, such adjucication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. SECTION XXIII. When Effective. 1. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.
