HomeMy Public PortalAboutOrdinances-1980-96 ORDINANCE NO. 1980-96 AN ORDINANCE AMENDING ORDINANCE NOS. 55, 62 and 63 of the Ordiriarioes of the City of Tiffin, Iowa, said ordinances regulating connections with water,and__sewer systems and providing rules, regulations aria conditions of service of municipal waterworks and sewer systems. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF TIFFIN, IOWA: :IOSECTION I. Purpose. The purpose of this ordinance is to amend the present City of Tiffin Ordinance nos. 55, 62 and 63 so as to establish connection fees for water and sewer service, to charge. property owner for cost of stop-box, water meters and outside visual meters and to delegate cost of installation of water and sewer lines to the property owner. SECTION II. Amendment. Section 3 of Ordinance No. 62 of the City of Tiffin Ordinances is repealed and the following Section III is substituted in lieu thereof: SECTION III. Applications for water service shall be filed with the City Clerk upon a form supplied by the City. The application shall state the name of the applicant and the premises to be served. All applications filed after the commencement of the operation of the water system shall be accompanied by a fee of seventy-five dollars ($75.00) payable'to the City Clerk of the City for the connection charge. (Rate set by Council motion on December 12, 1979 and effective January 1, 1980.) SECTION III. Amendment. Section 9 of Ordinance No. 55 of the City of Tiffin Ordinances is/repealed and the following Section IX is substituted in lieu thereof: SECTION IX. Fee for connection. Before any permit is issued the person who makes application shall pay one hundred fifty dollars ($150.00) connection charge to the superintendent or designated repre- sentative of the council to cover the cost of issuing the permit and ti supervising, regulating and inspecting the works. These fees shall be turned over to the city treasurer not later than the tenth day of the month following the month in which collected, with a written report of the amount and source. (Rate set by Council motion on December 12, 1979 and effective January 1, 1980.) SECTION IV. Amendment. Amendment of Section 3 of Ordinance No. 63 of the City of Tiffin Ordinances is repealed and the following Section III is substituted in lieu thereof: b . page 2 Ordinance No. 1980-96 City of Tiffin r,a SECTION III. The customer shall install' and maintain at his expense that portion of the service from the main to the lot or easement line, including the necessary tap, fittings and shut-off valve, and the customer shall also install and maintain at his expense that portion of the service from said lot or easement line to his premises, including a stop and waste cock at the end of the house side of his service. The minimum- earth cover of the customer's service shall be five (5) feet. The company shall determine the size and kind of service to be installed. (Set by Council motions on December 12, 1979 effective January 1, 1980 and November 14, 1979 effective immediately.) SECTION V. Amednment. Section 10 of Ordinance No. 63 of the City of Tiffin Ordinances is repealed and Section X is substituted in lieu thereof: SECTION X. All meters and outside visual meters shall be installed and maintained and renewed by the municipality at the expense of the customer, and the municipality reserves the right to determine the size and type of meter used. (Set by Council motion on December 12, 1979 and effective January 1, 1980.) SECTION VI. Sewer installation costs. The customer shall install and maintain at his expense that portion of the service from the main to the lot or easement line and shall also install and maintain at his expense that portion of the sewer service from said lot or easement line to his premises. (Set by Council motion on November 14•, .1979 and effective immediately.) SECTION VII. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. SECTION VIII. Saving Clause. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. SECTION IX. When Effective. This ordinance shall be in effect after its final passage, approval, and publication, as provided by law.
