HomeMy Public PortalAbout1997/09/25 SEPTEMBER 25. 1997 An Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING Carteret preceding the Regular Meeting of October 2, 1997, was held on September 25, 1997, 7:00 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: ROLL CALL Mayor Peter J. Sica Councilmember Bialowarczuk " DuPont " Failace " Feingold " Gutowski Also noted present was Borough Attorney Craig Coughlin. Noted absent was Councilmember Fazekas. NOTED ABSENT Statement of Meeting Notice was mailed to the Home News Tribune, the Star Ledger and posted on the bulletin board on September 19, 1997. STATEMENT OF MEETING NOTICE To Address Governing Body: Borough Engineer TO ADDRESS GOVERNING BODY BOROUGH ENGINEER Borough Engineer Pratap Parmar - Engineer's Report 1. Shalom International has agreed to allow us to work while the paper work for land acquisition is under process. 2. The improvements to Mathew, Lexington and Harrison Avenue will all be grouped together as one bid. 3. Requested authorization for the Purchasing Department to advertise Sabo Street Wastewater Pump Station, Etheridge Drive Wastewater Pump Station Abandonment and Gravity Sewer Connection. 4. Yearly Sewer Maintenance Contract was awarded to Ritacco Construction Incorporated on June 20, 1996. 5. Bid for roof work on the Police and Fire Buildings will be advertised next week. 6. Recreation Center keys will be available as of next week. 7. Field lights were damaged while the tanks were removed. Cables have already been repaired and wires will be repaired as of tomorrow. At approximately 7:10 P.M. Councilmember Fazekas was noted FAZEKAS PRESENT present. :PTEMBER 25. 1997 JISCUSSION MINUTES FOR APPROVAL ORDINANCES RESOLUTIONS REPORTS MATTERS FOR DISCUSSION Councilmember Gutowski said while we are on the subject (inaudible) been down there because his daughter is cheerleading. He said there are a lot of little things wrong and he has advised them to make a list (inaudible) and we will work on it. He said one of things that concern him is if there is a smoke detector system in the Recreation Building. Councilmember Gutowski said there are some fire extinguishers but he does not see any smoke detectors. Borough Engineer Parmar spoke, however most of which was inaudible. Mayor Sica instructed someone to get a price for the installation of smoke detectors. MINUTES FOR APPROV AL: May 15, 1997 ORDINANCES: Public Hearing- 1. #97-33 Bond Ordinance Appropriating $650,000.00 for the purchase of a Fire Truck. RESOLUTIONS: 1. Directing the Issuance of Various Raffle Licenses. 2. New Jersey Recycles Day. 3. Budget Insertion - Nursing Services, Non - Public Schools. 4. Deferred Compensation Plan Amendment. REPORTS: 1. Board of Health - June, July & August. 2. Clerk's Office - September 1997. 3. Fire - August 1997. MATTERS FOR DISCUSSION: 1. Mayor Sica - Am Quip proposal. Mayor Sica said he had a call from a realtor (inaudible). He said there is a piece of property towards Federal Blvd. close to Minue School that has a big gas line that runs through it. He said there have been other people interested in the property in the past but when they find out about the gas line they do not want it. Mayor Sica said they have an easement through Florence (inaudible) property to get in there. He said the Company that is interested in the property is Amquip. He said he explained to them that the property is actually in an enterprise zone. He said Amquip is asking about a tax abatement. Mayor Sica said he 2 SEPTEMBER 25. 1997 would get back to them and tell them that the Council was receptive to MATTERS FOR DISCUSSION the idea and he will wait for a letter from their Attorney. (CONTINUED) 2. Bid - Removal of Street Sweepings Mayor Sica said to hold this. 3. Carteret Welfare Board - Appointment to unexpired term. Mayor Sica asked if anyone had a name. He said let's think about it and if we come up with a name then we will discuss it. Borough Clerk Kathleen Barney said it had to be a woman according to their (inaudible). 4. Fire Supt. Greenberg - Commendations, Re: Fire at 86 Washington Ave. Mayor Sica said let him get a (inaudible) and we will make him up a (inaudible). 5. Carteret Middle School History Club - Requesting financial assistance. Mayor Sica said we can not do that. He said we can not give City money to any organization unless it is something on the line of a Kiddie Keep Well Camp or the First Aid Department. 6. Scottsdale Insurance Company - Requesting payments: a) Osipovitch, $6482.08 b) Lynch, $427.60 Mayor Sica said before we approve any of these we should give them to Borough Attorney Craig Coughlin to look at. 7. Ambrose Ginda - Requesting re-appointment to housing Authority. Councilmember Gutowski asked if we were not to (inaudible) attend the school before they become commissioned. Mayor Sica said these guys were all Commissioners when the law came in. He said if you want to appoint someone they have to go to school. 8. Donald Nelsen - Requesting payment of legal fees. Mayor Sica said we are not paying any legal fees. He said this guy threatened to kill the Volunteer Chief. He said we took him to court, he pleaded guilty, so why would we have to pay his legal fees. 9. Pat Holden - a) Urban Neighborhood Empowerment Program. b) Status of Industrial Road Expansion Project. Mayor Sica said tell her to move forward on it. He said we are for anything that will bring in money. He said tell Pat to meet with him. 3 PTEMBER 25, 1997 ATTERS FOR DISCUSSION 10. CONTINUED) John Spoganetz, Esq. - Resident interested m purchasing property. Mayor Sica said he would get in touch with Mr. Spoganetz. 11. County of Middlesex - Interlocal Service Agreement for Hazardous Materials Recovery Costs. Mayor Sica said he would sign it. He said if we have (inaudible) we could get some money back. 12. Borough Attorney - a) Nagy hearing b) Gates Realty. Borough Attorney Craig Coughlin said we never set a date for the Nagy hearing. He said it has been a while since the charges were (inaudible). Mayor Sica said set a date. He said any date that is convenient for everyone. Borough Attorney Coughlin said in regard to Gates Realty, we got the map from Mr. Walkerson who is the planner who did the outline. He said we need a Resolution. Mayor Sica said get Walkerson to give us a number and let's get this done. 13. Joseph Schiappa, Esq. - Billboard Ordinance Borough Attorney Coughlin said he would review this. 14. Carteret Health Department - Muskrat infestation. Mayor Sica said we have to do something so let's go ahead. 15. Margaret Knudsen - B&L Towing Mayor Sica said we received a letter from a woman who said that B&L towed her car off of the Turnpike. He said B&L told the woman that her AAA would pay the cost of the towing and her insurance company says they will not. Mayor Sica said we have no control of the towing that is done off of the Turnpike. Borough Attorney Coughlin said he would send her a letter referring her to the Turnpike Authority. BUSINESS TO BE ADDED BUSINESS TO BE ADDED: Mayor Sica said yesterday we met with potter Architects and this morning he called Attorney John Spoganetz. He said regarding Foodtown, Toth and the Liquor Store, Mr. Spoganetz said he sent the contracts to the Borough and he can not go any further until he has a signed contract from us. 4 SEPTEMBER 25. 1997 Borough Attorney Coughlin said he drafted the changes and he will get them to Spoganetz. DISCUSSION (CONTINUED) Mayor Sica said the other day he received a call from Mr. Vitale from Woodbridge. He said Mr. Vitale is starting a new organization called "Habitat for Humanity" and he wanted to know if we would be interested in selling him one of the houses that we foreclosed on. Councilmember Gutowski said Recreation Commission (inaudible) appoint some new members next week. He asked could we utilize the office space downstairs in Borough Hall for meetings. Mayor Sica said yes. Councilmember Fazekas said this week we issued a fine to Conrail. He said he had a meeting with Pat Holden regarding the designation of three (3) areas in Carteret. He said the three (3) areas are West Carteret, Lower Roosevelt and the Civic Center Park Area. Councilmember Feingold said (inaudible) Grants Contract. Borough Attorney Craig Coughlin said he has a contract for the Mayor to sign. He asked what was the Recreation Commission planning. Mayor Sica said they were doing the Halloween Parade and the SoapBox Derby. He said it is just a matter of setting the date. Councilmember Failace asked what department is responsible for the medians in the road. Mayor Sica it would have to Streets and Roads. Councilmember Failace questioned Mayor Sica on a police issue. RESOLUTION # 97-299 was introduced by the Mayor and referred to RESOLUTION 197-299 the Council for action. CLOSED SESSION Upon MMS&C, by Councilmembers Failace and Fazekas RESOLUTION # 97-299 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote Councilmembers ADOPTED Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. At approximately 7:40 P.M. a Closed Session was held. At approximately 8:05 P.M. upon MMS&C, by Councilmembers OPEN TO PUBLIC Failace and Fazekas and unanimous affirmative vote of the six (6) members present, this meeting was opened to the public. 5 PTEMBER 25. 1997 DJOURNED At approximately 8:06 P.M. upon MMS&C, by Councilmembers Fazekas and DuPont and unanimous affirmative vote of the six (6) members present, this meeting was adjourned.
