THE CITY COUNCIL OF THE CITY OF TEMPLE CITY: APPROVING A MODIFICATION TO VARIANCE NO. 79-565 THE ~CITY'COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. Based on the discussion set forth in the minutes of the Planning Commission and-City-Council, a. modification of Variance No. 79 -565 o .build-.a new. storage facility, substantially as set forth on Plan A, IF however; to all -15 of the following conditions: 1. The following Fire Department-requirements shall be met: a. The installation: of :one public fire hydrant 6" X 4" X 2 -1/2" within 400 feet from any part of the structure by vehicular travel. b_. A: fire flow. requirement of . 4,.500 gpm for a 4 hour duration shall be provided... c. One private °on-site ,. hydrant shall be located on the property subject to the review and approval of the Fire Chief. A -fire flow requirement of 1250 gpm for a 2 hour duration shall be provided. d. The access from Las. Tunas::Drive shall be designated a fire lane and shall be-a• minimum of 26 feet in width. e. Construction.: of :a-4 : hour : rated fire .wall on the Southwest side of the building:;: and a:-2. hour rated fire wall on the North side of the_.b.uilding. Additional structural details must°.be'reviewed at time of plan check by the Fire Depart- ment. f. Fire.. Department - access openings per the approval of the Fire Chief. All interior: walls shall be -l: hour rated. Doors shall, be a minimum' of 1- hour assemblies. h. The entire_- building shall be sprinklered to standards set by the Fire Department. i. There shall be provisions in each and every lease agree- ment'for each-storage space which shall guarantee the Los Angeles - County Fire- Department access to the storage areas without prior- notice• to the leases. These lease provisions shall be subject to the review and approval of the City Attorney and a standard .lease agreement shall be prepared for review and approval of the City Attorney prior to issuance of building permits. 2 All circulation': and parking, : except- number of spaces as re- quested, shall-meet the Zoning- Code-standards and shall be functional. 3. Signage.: for: the,: site_shali be::limited to 1..sign. not to'' exceed 40 sqd:: ft.: in_ area__or; exceed 20: ft..._ in_height and shall be sub - ject to the review- and - approval -of the Planning Director. 4. Unless :: specifically _provided..for_herein, all Zoning. and /or Building requirements shall' be met. 5 All paved areas _shall be .;p4operly. surfaced, .striped, and main- taine in accordance with-Section ction 9296 of the Ordinance Code. 6. Six' ft. high solid.masonry. walls: shall be provided along all exterior :property_lines_except.in .those areas where a structure abuts_ the_ property line- and- along Las Tunas Drive where access is provided. Resolution No. 8i2O22 - Page 2 7. A_2-1/2 ft, wide_by.95.ft. long landscape planter shall be installed_along the_easterly and:westerly sides of the access driveway. A landscapeiplanter, a minimum of 2-1/2 ft, in width,.shall.be provided_adjacent to_the southerly property IineApetween the-existing and proposed structure. 8. An exterior lighting.plan shall be submitted for review and approval by_the_Planning Director prior to issuance of a building permit. 9. If applicants_property_is contiguous to Noel Drive, then public_improvements_shall be provided_at the terminus of Noel Drive which may include.but_shall not be limited to curbs and gutter.. improvement_plans shall_be submitted to the City for approval prior to issuance of a construction permit. 10. Trash receptacle areas_shall be_specified on plans submitted for plan check_and shall_meet_the:minimum_standards established by the_City._ Trash receptacle areas shall be constructed of solid masonry walls and solid-wood or metal gates. 11. All roof_equipment shall.be_properly screened from nearby residential and commercial _areas. .A:screening plan shall be submitted_for_plan check_for-review and approval by the Planning Director prior to issuance of building permits. 12. No outdoor storage shall be permitted. 13. The hours of operation_shall be limited from 7 a.m. to 9 p.m.; Sundays 10 a.m. to-5 p.m. 14. A.removable post shall be_placed and_maintained at the easterly access_to theaccess:drive located_northerly of the proposed new building, so as to restrict vehicular access. 15. Because of limited parking, the property shall be used as a public_storage facility_in the_west_building, and office and warehouse in the east building. No change of use shall be allowed-without the_specific approval.of the City of Temple City. This restriction shall be recorded in form satisfactory to the City Attorney as :a.. covenant running with the land and enforceable by the-City_at_the_expense_of the owners of said land, including reasonable_attorney_fees. This recordation shall be a condition precedent to the use of the variance. 16. That prior to obtaining_a_building_permit and within 30 days hereof,_the applicant_shall_file_with_the City Clerk of the City of Temple_City-written acceptance_of the conditions stated herein on forms provided by the City. SECTION. 2, The_City_Clerk_of_the:.City_of Temple City shall certify to the_passage_and adoption of_this_Resolution_and to its approval by the Mayor..andsha1L.cause the same to be published and circulated in the City of Temple City.
