HomeMy Public PortalAboutOrd. 0661ORDINANCE N0. 661 AN ORDINANCE OF THE CITY OF LYNWOOD AMENDING SECTION 1 OF ORDINANCE NO. 624 AND SECTION 154 OF ORDINANCE N0. 493 BY PROVIDING FOR CERTIFI- CATE OF NECESSITY FOR ALL-NIGHT PARKING IN CASES OF HARDSHIP, AND PROVIDING FOR A SINGLE INVESTIGATION TO COVER AN ENTIRE PARCEL OF LAND AND ALL DWELLINGS LOCATED THEREON, AND FOR A SINGLE INVESTIGATIVE FEE TO COVER THE INVESTI- GATION AS A WHOLE. The City Council of the .City of Lynwood does ordain as follows: Section 1: That Section 1 of Ordinance No. 624 and Section 154 of Ordinance No. 493 are amended to read. as follows: "Section 154: All-night Parking Prohibited.. Exoept -- Certificate of Necessity Required. No person shall stop, stand., or park a vehicle on any street for a period of time longer than two hours between the hours of 1:00 a.m. and. 6:00 a.m. of any day except in accordance with a certificate of necessity issued by the Traffic Authority as hereinafter provided.; that said. certificate of necessity, or a decal or other reasonable facsimile thereof, furnished. by the Traffic Authority, shall be attached. to each vehicle to which the Traffic Authority has, in writing, made the said. certificate applicable, as hereinafter provided.. "Section 154.1: Intention of the Framers of this Ordinance; Investigation; Application. "A. That it is the intention of'the.City Council in enacting this amendment of Ordinance No. 624 and Section 154 of Ordinance No. 4g3 to cause, insofar as practicable, a single investigation to be made of the question as to whether or not there exists sufficient necessitous circumstances affecting the occupancy of a particular dwelling or a, group of dwellings and. their appurtenances upon a particular lot or parcel of land. in said. city to warrant the issuance by the Traffic "B. Therefore, in accordance with the foregoing preamble, be it ordained. that any occupant of a dwelling,.located in said. city, who, for reasons of hardship or necessity believes that there should be issued. to him a certificate of necessity which would. exempt him. from the provisions of Section 154 of Ordinance No. 593, as amended. by Section 1 of Ordinance No. 624 and. as amended. by Section 1 of this ordinance, may file an application for a certificate of necessity; that said. application shall meet ,the following requirements: "(a) It shall be in writing on a form furnished. by the Traffic Authority; "(b) It shall set forth: (1) The .name and. address of the applicant; (2) The name and. address of the owner, or agent of the owner, if said. property is being managed by an agent; (3) The number of separate dwellings on a particular lot or parc el of land affected by the application; (4) The number of vehicles insofar as known by the applicants possessed by the occupants of said lot and/or parc el of land.; (5) The license nu mber and motor vehicle number of the vehicle; (6) The make, model, and. type of vehicle; ~7) The necessity for the certificate requested., and ~8) Such other information as the Traffic Authority shall require. "C. The application first to be filed. affecting a particular lot and/or parcel of land. shall be designated for the purposes of this ordinance as the "original" application. said city. "E. Upon the filing of each such original application, the Traffic Authority shall cause to be made such investigation as he may deem proper to ascertain whether or not there exists sufficient necessitous circumstances affecting the particular lot and./or parcel of land. and. the dwellings located thereon, described in the application, to warrant the issuance by him of a certificate of necessity to the applicant. If, after such investigation, the Traffic Authority deter- mines that there is not adequate off-street parking space reasonably obtainable by the applicant at the place of,his residence or within 600 feet thereof, for the parking of the vehicle described. in the application, a certificate of necessity shall be granted to the appli- cant for a period. of one year from the date said. permit is granted.. Should. such certificate.of necessity be denied., the investigative fee shall not be refund.ed.. "F. The Traffic Authority shall cause a permanent file to be made of all °original" a:pplica.tions, and. all of the investigative written data. made and. compiled. in aonneetion with each investigation, l with the intent and. purpose that such file and. the information therein contained. shall constitute the found.ation.for the processing of all subsequent applications affecting the same lot and/or parcel of land described. in the original application. "Section 154.2: Renewal. "A11 applications for certificates of necessity filed. sub- Sequent to the filing of the "original" application shall be referred to for the purposes of this ordinance as "subsequent" applications. For each subsequent application filed., a fee of one and No/100ths ($1.00) Dollars shall accompany said. application and shall be paid. to the Gity Clerk of said. City. Should. such certificate of necessity be d.enied., issued under an "original" or "subsequent" application, the holder of the ce'rtifica.te is desirous of renewing his certificate, the same procedure shall be followed as provided. herein in the case of a "subsequent" application, except as follows: if the holder of the certificate shall file application for renewal of a certificate with the Traffic Authority at least ten days before the expiration of the term thereof, the fee of .$1.00 shall be waived. "Section 154.4: Substituted. Vehicle. °If the holder surrendered. an unexpired. certificate for a. certain vehicle, he may obtain a permit for a substituted. vehicle for an unexpired. term upon payment to the City Clerk of said. city of a fee of $1.00. "Section 154.5: Existing permits not affected.. "Nothing cantained. in this ordinance shall be deemed. to invalidate or otherwise affect unexpired. permits heretofore issued. by the Traffic Authority under and by virtue of City Ordinance No. 493 as amended by City Ordinance No. 62'4." Section 2: The City Clerk shall certify to the passage a.nd. adoption of this ordinance and. shall cause the same to be published. once in the Lynwood Press, a weekly newspaper published, printed., and. circulated in the City of Lynwood., California. First read at a regular meeting of the City Council of said. City held. on the 16th day of April, 1957, and finally adopted. and. ordef~ed published. at a regular meeting of said. Council held on the 7th day of May, 1957 by the following vote: Ayes: Councilmen .Comp ton, Finch, McMeekin,. and. .Summers. Noes: Councilmen:.
